Pursuant to instruction of the Committee on Streets of the
Board of Aldermen, I transmit herewith proper form of resolution for
the vacation of the alley between Lots 2, 3 and 4 on the northwest,
and Lot 5 on the southeast, in Custer Street Addition to St . Paul,
upon petition of the Drake Marble & Tile Company; the compensation
being fixed at Twenty-five Dollars, in addition to the cost of the
proceeding.

plat, be and the same is hereby vacated and discontinued as a public
alley, subject, however, to the following conditions, that is to say:

The Drake Marble & Tile Company and Dickerman Investment Com-
pany, corporations organized under the laws of the State of Minneso-
ta, petitioners herein, allege that they are the owners of all the
? property on the line of the public alley hereinafter described, which
your petitioners ask to have vacated.
Your petitioners hereby petition and pray that your honorable

ibody vacate and discontinue all that certain alley situated between
Lots Two (2) , Three (3) and Four (4) on the northwest, and Lot Five
(5) on *he southeast, in Custer Street Addition to St.Paul, uk,
/ Your petitioners further allege and show that no portion of said
; alley so proposed to be vacated has ever been opened, used or travell-
ed; that the same is a cul de sac and is wholly unnecessary as an
! alley; that there is no occasion, and there will be none in the future ,
1for the use of the same as a public alley, and that the public inter-
est requires that the same should be vacated as an alley; that there
is hereto attached a plat of said alley proposed to be vacated.
WHEREFORE your petitioners pray that said alley hereinbefore des-
