Gentlemen: -
Pursuant to instruction of the Committee of the Whole, I
transmit herewith a new resolution vacating streets and alleys in Dicker-
man Park upon petition of Griggs, Cooper & Company and others; the amend-
ment embodied being the widening of Aldine street and Fairview avenue to
one hundred feet , the dedication of Lots 16 to 30 in Block 7 , and Lots
16 to 30 in Block 8 , facing on University avenue , for park purposes, and
a provision that the City shall not be liable for damages for any future
change of grade on Aldine street from University avenue to Thomas street .

WHEREAS, There was heretofore presented to the Assembly, one

of the branches' of the Common Council of the City of St . Paul , the
petition of Griggs, Cooper & Company, a corporation , and others, the
owners of all the land and property abutting upon and adjoining the
streets and alleys hereinafter described, praying for the vacation of
Edmund street from Fairview avenue to Aldine street , also Charles street
from Fairview avenue to Aldine street , Sherburne avenue from Fairview
avenue to the eterly line of Lot 27 in Block 5 and the easterly line
of Lot 4 in Block 8, of Dickerman Park, also Wheeler avenue from
University avenue to Thomas street, also all of the alleys in Blocks
1, 2 , 3 , 4, 6 , 7 and 8 , and the alley in Block 5 , from Wheeler avenue
to the easterly line of Lots 4 and 27 in said Block 5 of Dickerman Park
Addition to St. Paul, Minnesota, and more particularly shown and des-
cribed upon the plat annexed to said petition , which said petition is
duly verified as required by law and sets forth the facts and reasons
for such vacation; and
WHEREAS , Said Assembly deemed it expedient that the matter
therein referred to should be proceeded with and ordered said petition
and accompanying plat to be filed of record in the office of the City
Clerk of said City, and ordered said City Clerk to give notice by publi-
cation in the official paper of said City in the manner and for the time
required by law, that said petition and the subject matter thereof would
be heard and considered by the Committee on Streets of said Assembly at
its regular meeting to be held in the Council Chamber in the Court House
and City Hall Building, in said City, on'' the 2nd day of November, 1908,
at four o' clock P . Y. , which said notice was duly published and given; and
WHEREAS, Said Committee on Streets of said Assembly did meet
at the time and place above mentioned and appointed therefor, and did
