(March 22-29-April s-v5-12-09-40 -- the Laws of the State of Minnesota, and the proprietor, printer and pub-
lisher of said newspaper. That for more than one year prior to the
commencement of said publication therein, said newspaper has been, and
still is, a daily newspaper, issued, printed and published on each day of
the week, in the English language, in column and sheet form, equivalent
in space to more than four pages with five columns of at least seventeen
and three-quarter inches long to each page, from a known and establish-
ed office and place of publication equipped with skilled workmen and
necessary material for preparing and printing the same, to-wit: The
. Daily News Building in the City of St. Paul, Ramsey County, Minne-
sota, from whence it purported to be, was, and is, issued; and that dur-
ing all said time it contained and still contains general and local news
comment, and miscellany, not in any way duplicating any other pub-
lication, and not entirely made up of patents or plate matter, nor
wholly of advertisements; and that during all said time it has been
and still is, circulated in and near its said place of issue and publica-
tion to the extent of more than two hundred and forty copies regularly
delivered to paying subscribers. That on the 24th day of March, 1906
. the affidavit of J. Harry Lewis, the then Manager of said corporation
publisher of said newspaper was filed in the office of the County .Auditor
of said Ramsey County for the purpose of complying with Section 5516
the Revised Laws, 1905.

WHEREAS, There was heretofore presented to the Board of
Aldermen, one of the branches of the Common Council of the City of
St . Paul, the petition of Carl H. Metzger, the owner of all the :land
and property abutting upon and adjoining that portion of Woodbine street
from Beacons r to Chester in the City of St . Paul, and more
particularly described and shown upon the plat annexed to said petition,
which said petition is duly verified as required by law and sets forth
the facts and reasons for such vacation; and
WHEREAS, The Board of Aldermen deemed it expedient that the
matter therein referred to should be proceeded with and ordered said
petition and accompanying plat to be filed of record in the office of
the City Clerk of said City, and ordered said City Clerk to give notice
by publication in the official paper of said City in the manner and for
t' e time required by law, that said petition and the subject matter
thereof would be heard and considered by the Committee on Streets of
said Board of Aldermen, at its regular meeting to be held in the
Council Chamber in the Court House and City Hall Building in said City
on the 29th day of April, 1909, at four otclock in the afternoon of
said day, which said notice was duly published and given as required
by law; and
WHEREAS, Said Committee on Streets of said Board of Aldermen
did. meet at the time and place above mentioned and appointed therefor
pursuant to said notice, for the hearing, investigation and consider-
ation thereof, and dad then and there duly investigate and consider the
matter of said proposes: vacation, and did then and there hear all testi-
mony and evidence adduced on the part of the petitioner and all other

Gentlemen:
Your petitioner, Carl H. :'etzger, respectfully shows that he
is a citizen of the City of St.Paul and resides on Block Sixteen (16)
of Burlington Heights Division ;'''I at Highwood in said. City; that one
of the platted streets of said Burlington Heights Division rI is
Woodbine Street, which is sixty feet wide and approximately three hun-
dred eighty feet long; that petitioner owns all the property on both
sides of said 7oodbine Street; that said street is not graded and in
no manner connects thoroughfares or is used for the purpose of travel;
that petitioner proposes building a home on lots thirteen (13) and
fourteen (14) and the typography of the land is such that said pro-
posed house should project over in said ''oodbine Street in order to
meet the views of petitioner as to location and also lessen the cost
thereof; that in any event after building his home as aforesaid,
if said street is not vacated, and said house is built entirely on said
lots thirteen and fourteen, said "'oodbine Street would cut between pe-
titioner's ho se and barn and out-buildings to his great detrii ent and
inconvenience; that the location and dimensions of said „oodbine Street
proposed to be vacated as aforesaid is shown by a plat attached hereto
and made a part hereof, narked " Exhibit "; tiiat petitioner is a farmer
and owns a small tract of farming land immediately East of said Block
Sixteen, which said property is unplatted and is used by petitioner for
farming purposes together with all of said Block sixteen except lots
seventeen and eighteen, and petitioner is now farming the land on both
sides of said 'woodbine Street; that according to petitioner's belief
there never will be any necessity, or need or advantage to be gained by
the opening of said "'oodbine Street.
