vacating the alleys in Frost 's Subdivision , upon petition of Theodore
Michel and others; the compensation being fixed at Twenty-five Dollars .

The undersigned petitioners respectfully represent ; ,

That they constitute a majority of the resident owners of the props
ty on the line of the public allays in Frost's Subdivision as said 0

40/alleys are shown by the plat accompanying this petition;and that the '
undersigned constitute all of the owners on the line of the said alleys
and abutting thereupon.
That the said alleys in the said Frost's Subdivision as shown by
the said plat have never been opened and have never been used by the
public. That from the time of the dedication of the said alleys the
whole thereof have been used by the abutting owners and are now so
used by then. That the said alleys have no outlet or connection with
any other alley or public street to the West,rast or South thereof,
and that the said part of said alleys running in a Northerly direction
halffi an outlet of only five feet in width to Aurora Avenue.
That it is the purpose of the undersigned,r.dward S.Frost,to con-
struct a brick building upon all of the said property included in the
said Frost' s Subdivision and not now improved by buildings ,a,nd that it
is the purpose and desire of the said Edward S.Frost to extend the
said building over said alleys and to cover the whole thereof by such
building,and that it is the purpose of the said petitioner to commence
the construction of said building and to use the same for business
purposes immediately upon the vacation of the said alleys by your
honorable body. And your petitioners further allege that Aaalia
Time is the owner of the property situated at the Southwest corner
of Rice street and Aurora Avenue in said city narked upon said plat
"Herman H.Tinnne" ,and that the said petitioner Theodore. Michel is the
owner of lot No. 7 of the said Frost's Subdivision, and that the sae d
petitioner Edward S.Frost is the owner of all of the property in said
Frost' s Subdivision excepting said lot No. 7,and that the said peti-
tionersAmalia Time & Theodore Michel are residents of the said city
of St.Paul, and that the said petitioner F,dward S.Frost is a resident
of Willinar,in the State of Minnesota.

WHEREAS, Said Committee on Streets of said Board of Aldermen
did meet at the time and place above mentioned and appointed for the
investigation and consideration thereof and did then and thereafter duly
adjourn the hearing of said matter to a regular meeting of said committee
at the same place at four o' clock P . M. on October 15th, 1908 , at which
said last named time and place said Committee did duly meet and did
then and there hear all testimony and evidence adduced on the part of
said petitioners and all other persons interested in the matter of said
proposed vacation, and did take proof of the matters averred in said
petition, and being of the opinion that the prayer of said petition
should be granted upon the terms hereinafter stated, did duly report its
conclusions to said Board of Aldermen, reconnUer ding the adoption of an

appropriate resolution declaring such vacation; now therefore, it is
hereby
RESOLVED, By the Con on Council of the City of St . Paul, that
all of the alleys in Frost ' s Subdivision, an addition to said City of
St. Paul, as shown upon said plat , be and the same are hereby vacated
and discontinued as public alleys, subject , however, to the following
conditions , that is to say:
Such vacation is upon condition that said petitioners shall,
before this resolution takes effect , pay into the treasury of said City
the sum of Twenty-five Dollars ($25 .00) in addition to the expense of
this proceeding, which is hereby fixed as the compensation to be paid to
said City in consideration of said. vacation .
