Resolved, By the Common Council of the City of St . Paul,
that all that part of Charles street in the City of St . Paul, Minnesota,
lying between the east line of Snelling avenue and the west line of
Pascal avenue and lying south of a line sixty-nine and seventy-eight
one-hundredths feet (69 .78) feet south of and parallel to the north line
of said Charles street between said points (being a strip thirty-three
feet in width along the north side of the south half of the southwest
quarter of the northv est Tarter, Section 34 , Township 29 N . , Range
23 W. , condemned for Charles street by the Board. of Public Works on
November 6th, 1905) , as shown upon said plat, be and the same is hereby
vacated and discontinued as a public street, subject , however, to the
following conditions , that is to say:
Such vacation is based upon the condition that said petitioner
shall_, before this resolution takes effect , pay into the Treasury of
said City the expenses of this proceeding .

Gentlemen:
We , the undersigned, being a majority of the owners fronting
on that part of Charles street between the center line of Snelling avenue
and the center lire of Pascal avenue, respectfully petition your Honor-
able Body to vacate all that part, of Charles street from the center of
Snelling avenue to the center of Pascal avenue lying south of a line
sixty-six (66) feet south of and parallel to the north lire of Charles
street in Hemline Syndicate Addition No . 3 , as shown in red upon the
accompanying plat .
The facts and reasons for such vacation are the following :
At the time when Hemline Syndicate Addition No . 3 was platted
there was dedicated for Charles street a strip of land running along the
south line of said addition thirty-three (33) feet in width. That there-
after and on November 6th, 1905 , the Board of Public Works of the City ,
intending to widen said street to a width of sixty-six (66) feet , opened
as a part of Charles street the north thirty-three feet of the south
nineteen acres of the west half of the northwest quarter of Section 34 ,
Township 29 , Range 23 , designated on the plat hereto attached.
This proceeding left a strip 36 .78 feet wide between that por-
tion of Charles street as dedicated in Hamline Syndicate Addition No . 3
and the other portion of Charles street as opened by the Board of Public
Works on November 6th, 1905 . This said strip 36 .78 feet aide , approxi-
mately one acre in area was the property of the owners of said Hamline
Syndicate Addition No . 3 , but apparently by oversight was not included
in said plat nor was the same described in the records of the County
Auditor, it being presumed, no doubt , that the said plat of Hamline
Syndicate Addition embraced the unplatted acre before mentioned.
Since that time and recently the Board of Public Works , by
proceedings duly taken, has condemned and opened the intervening strip
of 36 .78 feet in width, as also indicated on the accompanying plat , as a
part of Charles street , so that at the present time .Charles street bet-
ween the center of Snelling avenue and the center of Pascal avenue is
more than one hundred and two feet in width.
Your petitioners believe that the opening of the strip
thirty-three feet in width by the Board of Public Works on November 6th,,
1905 , was done by inadvertence and under a mistake of fact , and your
petitioners aver that if this petition is granted, t} ere will remain
for use as Charles street a strip sixty-six feet in width, which will
be uniform with said Charles street as the sane is opened east of Pascal
avenue and west of Snelling avenue .
