Pursuant to instruction of the Committee on Streets of the
Assembly, I transmit herewith an amended resolution relating to the
vacation of Goff avenue , between West Isabel street and West Congress
street, limiting such vacation to the portions of Goff avenue lying
outside of a strip eight feet in width on each side of the center line ,
thereby preserving a sixteen-foot roadway in the center of the street .

matters averred in said petition, and being of the opinion that the
prayer of said petition should be granted.Aupon the terms hereinafter
stated, did duly report its conclusions to said Board of Aldermen,
recomrnen frig the adoption of an appropriate resolution declaring said
vacation; now therefore , it is hereby
Resolved, By the Common Council of the City of St . Paul, that
all that part of said Goff avenue as shown upon the plat annexed to said
petition, lying between West Isabel and West Congress streets, except
a strip eight (8) feet in width on each side of the center line of said
street , be and the same is hereby vacated and discontinued as a public
street (it being the intention of this resolution to retain and preserve
the center sixteen feet of said street as a public street and roadway) ,
subject , however , to the following conditions, that is to say:
Such vacation is based upon the condition that said petition-
ers shall , before this resolution takes effect, pay into the treasury of
said City the sum of Fifty Dollars (50 ,00) in addition to the expenses
of this proceeding, which is hereby fixed as the compensation ,to be paid
to said City in consideration of said vacation .

WHEREAS , There was heretofore presented to the Board of
Aldermen, one of the branches of the Common Council of the City of
St. Paul, the petition of John C . Stuhiman and others, the owners of a
majority of the land and property abutting upon and adjoining that por-
tion of Goff avenue hereinafter described, praying for the vacation of
all that part of said Goff avenue lying between West Isabel and West
Congress streets , in St . Paul, Minnesota, and more particularly described
and shown upon the plat annexed to said petition, which said petition is
duly verified as required by law and sets forth the facts and reasons
for such vacation; and
WHEREAS , The said Board of Aldermen deemed it expedient that
the matter therein referred to should be proceeded with and ordered said
petition and accompanying plat to be filed of record in the office of
the City Clerk of said City, and ordered said City Clerk to give notice
by publication in the official paper of said City in the manner and for
the time required by law, that said petition and the subject matter
thereof would be heard and considered by the Committee on Streets of
said Board of Aldermen at its regular meeting to be held in the Council
Chamber in the Court House and City Hall Building in said City on the
28th day of June, 1906 , at four o' clock in the afternoon, which said
notice was duly published and given, and said Committee did meet at said
time and place and did then, and from time to time , at each successive
regular meeting of said Committee duly appointed and held, duly adjourn
the hearing of said matter to its regular meeting appointed to be held
on the 2nd day of August, 1906 , at four o' clock P. M. at the same place,
as will more fully appear from the records of the proceedings of said
Committee ; and
WHEREAS , Said Committee on Streets of said Board of Aldermen
did meet at the time and place last mentioned and appointed, pursuant to
said adjournment for the hearing, investigation and consideration thereof,
and did then and there duly investigate and consider the matter of said
proposed vacation, and did then and there hear all testimony and evidence
adduced on the part of the petitioners and all other persons interested
in the matter of said proposed vacation, and did take proof of the

Gentlezmen:-
The undersigned, your petit i!oners, re--or gent, that they
are the owners of a major portion of all the property on the line of
that portion of Goff Avenue, in the City of St.Paul , Ramsey County,
and State of Minnesota, to-wit :
Commencing at a point on the Northeasterly corner of Block
numbered fifty-five ( 55) west St.Paul Proper, according to the plat
thereof on file and of record in the office of the Register of Deeds
of said Ramsey County; thence Southerly along the Easterly line of
said Block fifty-five ( 55) to the Southeasterly corner thereof, thence
Easterly along the Northerly line of West Congress Street to the South-
westerly corner of block fifty-fotax ( 54 ) said rest St.Pa'zl Proper;
thence Northerly along the Westerly line of said Block fifty-four ( 54 )
to the Northwesterly corner of said block fifty-four ( 54); thence
westerly along the southerly line of West Isabel Street to the place
of begining, being all that part of said Goff Avenue lying and being
between the said blocks fifty-five ( 55) and fifty-four ( 54) aforesaid,
Your petitioners further represent that that part of said.
Goff Avenue hereinbefore described runs along the side of a high bluff
and no part of said Avenue is now in condition to be used for travel
thereon by the public and has never been opened for travel by said.
City although dedicated to 'Public use nearly fifty ( 50 ) years ago and
cannot be of any value for public travel or any other public purpose
in the event , that, it was opened, improved or graded and cannot be
opened for public use or travel except at great expense and the same
is not now needed for use by the public because there are sufficient
other streets giving all desired access to and from all property in
the vicinity of the said Part of sa Ld Avenue so described.
That your petitioners olvn the major portion or majority
of the property on both sides of said Goff Avenue, abutting the portion
of the said Avenue asked to be vacated, as shown upon the plan or
