Assembly , I transmit herewith a proper form of resolution vacating a
portion of •E 6th. Street, in front of Lot five, Block five of Whitney
and Smith's Addition to St. Paul, on petition of J. H. Allen & Co.
The Committee didnot designate any compensation, and I have fixed the
compensation at $10 .00 in addition to the expenses of the proceeding;
ti,at sum, I beleive, being the customary minimum.

averred in said petition, and being of the opinion that the prayer of
said petition, should be granted upon the terms hereinafter stated, did
duly report its conclusions to said Assembly recommending the adoption
of an appropriate resolution declaring such vacation; now therefore, it
is hereby
Resolved, By the Common Council of the City of St. Paul , that all
that portion of East Sixth Street in said City in front of and across
the front of Lot five in Block five of Whitney and Smith' s Addition to
St . Paul, colored red and shown upon the plat annexed to said petition,
be and the same is hereby vacated and discontinued as a public street,
subject, however, to the following conditions , that is to say: Such
vacation is upon the condition
That said petitioners shall pay into the Treasury of said City the
sum of Ten Dollars in addition to the expenses of this proceeding, which
is hereby fixed as the compensatiom to said City in consideration thereof.

said lot 5 having been taken for Sixth street is such as to necessi-
tate the constructi-,n of an irregular shaped and unsightly building
unless such vacation is granted. t
That said Petitioner , J. H. Allen & Company, does not
desire such vacation to the extent of interfering with the maintenance
and use of the sidewalk , as shown and indicated upon said plat, but it
is their desire to secure such vacation to the extent of permitting the
second and succeeding stories of the building they propose to construct
upon this property to extend over a portion of the sidewalk to the
regular property line of said lot five (5) , the same to be supported by
a column or pier , as indicated upon said plat, which will give free and
and unimpeded use of said sidewalk to the public the same as if such
vacation had not been made .
Hereto attached is a plat of the aforesaid portion of said east
Sixth street and of the surrounding location, which is made a part of
this petition.
WHEREFORE , your petitioners pray for the vacation o.f that por-
tion of East Sixth street hereinbefore mentioned , in the manner and •
