that the prayer of said petition should be granted upon the terms herein-
after stated, did duly report its conclusions to said Board of Aldermen,
recommending the adoption of an appropriate resolution declaring said
vacation; now therefore , it is hereby
Resolved, By the Common Council of the City of St . Paul,
that all that part of Jefferson avenue in said City , lying between
Colborne street and the right of way of the Chicago , St . Paul , Minneapolis
and Omaha Railway Company , as shown upon the plat annexed to said
petition , be and the same is hereby vacated and discontinued as a public
street , subject , however, to the following conditions , that is to say:
Such vacation is based upon the condition that the Board of
Control of Ramsey County , one of the above named petitioners , shall ,
before this resolution takes effect., pay into the Treasury of said City
sum of One Dollar in addition to the expenses of this proceeding,
which is hereby fixed as the compensation to be paid to said City in
consideration of said vacation .

Pursuant to instruction of the Committee on Streets of the
Board of Aldermen, I transmit herewith a proper form of resolution for
the vacation of that part of Jefferson avenue lying between Colborne
street and the right of way of the Chicago, St . Paul , Minneapolis and
Omaha Railway Company, at the instance of the Board of Control, for the
use and benefit of the City and County Hospital .

a Llt*The undersigned respectfully represent and state that the
County of Ramsey and the City of St . Paul, Minnesota, and the Estate of
Frank Kohout, Sr. , are the owners of all the land and property abutting
upon and adjoining Jefferson avenue between Colborne street and the right
of way of the Chicago, St . Paul, Minneapolis and Omaha Railway Company,
in said City of St . Paul , and they petition your honorable body to vacate
all that portion of Jefferson avenue above described.
The facts and reasons for such vacation are that all of the
property on either side of the aforesaid portion of said Jefferson avenue,
except Lots 39 and 40 of Sloan' s Subdivision, is owned, used and occupied
by said City and. County for City and. County hospital purposes, and said
Lots 39 and 40 are now under a contract of purchase by said City for the
same purpose .
That said street is of no value as such to the public, and
its use by said City and County for public hospital purposes, for
grounds and buildings used in connection therewith and as a part thereof,,
is of the utmost importance to the public, and is absolutely necessary
to carry out the extensions and improvements to said hospital now in
progress under directions of the Board of Control in charge thereof, and
will result in great benefit to the public at large .
Hereto attached is a plat of said Jefferson avenue and the
adjoining property, which is made a part of this petition .
WHEREFORE, Your petditionerp« ray that all that part of said
Jefferson avenue lying between thoegasterly line of Colborne street and
the westerly line of the right of way of the Chicago, St . Paul, Minne-
apolis and Omaha Railway Company , in said City of St . Paul , be vacated
and discontinued as a public street .
