Gentlenen: -
As requested by the Committee on Streets of the Board of
Aldermen,, I beg to transmit herewith proper form of resolution for
the vacation of the southerly 7.73 feet of Water street lying between
the west line of Block 1 of Dawson' s Addition and Block 204 of
Irvine ' s Addition to West St. Paul.
As far as the City is concerned in this natter , the question
as to whether Water street has been dedicated or platted as a public
thoroughfare , is a matter which concerns the petitioner, for if the
City has no right to this street as a public highway, then the
resolution of vacation woul,', be without any effect.

Tthe Honorable, the Common Council of the City of St. Paul: .
The undersigned, a resident of the City of St. Paul, being
the sole owner of all the property on the south line of Water street
between the west line of Block 1 of Dawson' s Addition to the City of
St. Paul and the southerly line of Block 2o4 of Irvine' s Addition to
West St . Paul, respectfully petitions your honorable body to vacate
and discontinue the southerly 7.73 feet of said Water street lying
between the west line of Block 1 of Dawson' s Addition to the City of
St. Paul and Block 204 of Irvine 's Addition to West St. Paul.
That the facts and reasons of your petitioner for said vaca-
tion are as follows:
That said Water street between the points above indicated is
sixty feet in width and that no more than forty feet thereof has
ever been graded, and that said strip of 7.73 feet in width along
the southerly line of said street between the points above set forth
is largely below the grade of the cent portion of said street and
that the part of said Water street wh has been graded as aforesaid
is wide enough for all practical purposes.
That the condition of said southerly 7. 73 feet of the afore-
said portion of said Water street is such that it greatly damages
abutting property thereon and greatly lessens the value thereof fdr
sale or building purposes, and that the condition of said portion of
said street is such that during heavy rains, part of said street so
graded is washed out and the foundations of the sidewalk on the south-
erly side of said street are washed away, and your petitioner being
the owner of all the property on the said southerly side of Water
street between the points above set forth, is willing and anxious
to fill in said southerly 7. 73 feet of said Water street between
said points if the same shall be vacated, and that said filling will
materially benefit and make permanent that portion of the said Water
street and will be a substantial benefit to the property owned by
