Gentlemen: -
Pursuant to instructions of the Committee on Streets of the
Board of Aldermen, I transmit herewith a resolution for the vacation
of that portion of Parnell street lying southerly of Colorado street ,
pursuant to the petition of the Church of St. Michaels and others.

stated, did duly report its conclusions
to said Board of Aldermen, recommending
14 the adoption of an appropriate resolution
WHEREAS The Board of Aldermen deeme declaring said vacation;

15 by the Common Council of the City of

33 adduced on the part of the eti tioners and all other
p persons interested
34 in the matter of said proposed vacation, and did take proof of the
35 matters averred in said petition, and being of the opinion that the

Gentlemen:

The undersigned petitioners, being the owners of all of the
7
$ property and real estate fronting and abutting upon that part of
Parnell street in said City, hereinafter described, respectfully re-
9
quest your Honorable Body to vacate and discontinue all that part of
10
said Parnell street, lying southerly of Colorado street, which is more
11
x
particularly described and shown upon a plat thereof hereto annexed and
12
made a part of this petition; the part so sought to be vacated being
13
colored red upon said plat.

That the facts and reasons for such vacation are that the por-
15
tion of said Parnell street so sought to be vacated has never been used
16
by said City for street purposes, and lies about thirty feet below the
1.�
grade ofel:Lvmio street adjacent thereto. That said Starkey street is
13
open, graded and improved for public travel, and by reason thereof and
19
of said Parnell street not being improved or graded, it shuts off
20
your petitioners' property from access to said Starkey street. That
21
although not abutting thereon, your petitioners' property has been
22
assessed for improving said Starkey street and the construction of side-
23
walks on the isAtAIA4 side thereof.

That your petitioners desire to fill up and improve that
25
portion of said Parnell street so sought to be vacated so as to get
26
access to Starkey street. That such vacation will not interfere with
27
ample street facilities for any other property in the vicinity and will
28
not injuriously affect any other property owner or the public, but, as
29
your petitioners believe, will be for the benefit and best interest
30
of said City.

Wherefore, your petitioners pray that all that part of
32 Parnell street, lying southerly of Colorado street, as shown upon
33 said plat, be vacated and discontinued as a
public street.

prayer of said petition should be granted to the extent and upon the

12 same is hereby vacated and discontinued as a public street , subject ,
}13 however , to the following terms and conditions , that is to say;
14 Such vacation is upon the condition that said petitioners
