1'' Whereas, There was heretofore pre-
sented to the Board of Aldermen, one of
the branches of the Common Council of
the City of St. Paul, the petition of Joseph
Hahn and others, a majority of the own-
ers resident within the City of St. Paul Ck,... of property abutting upon and adjoining 41--•
the alley in Hahn's Subdivision of Its
one (1), two (2), eight (8), nine (9), ten
(10) and twenty (20) of Block four (4) of
Whitney's Subdivision of Brewster's Ad-
dition to St. Paul, Ramsey County, Min-
nesota, praying for the vacation and dis-
continuance of the alley in said Hahn'S
Subdivision, and more particularly de-
scribed and shown upon the plat annexed
to said petition, which said petition is

23 said Board of Aldermen at its regular meeting to be held on the 25th
24 day of February, 1904, at four o' clock P. M. at the Council Chamber in
25 the Court House and City Hall Building in said City, to which said
26 Committee said matter was duly referred for hearing and report thereof,
27 and thereupon said petition and plat were duly filed in the office of
28 said City Clerk and said notice was duly given and published as requir-
29 ed by law; and .
3o WHEREAS, The Committee on Streets of said Board of Aldermen
31 did meet at the time and place above mentioned and appointed for the
32 hearl"ng and consideration thereof, and did then and there duly adjourn
33 such hearing and investigation to the 10th day of March, 1904, at four
34 o' clock P. M. at the same place , and said Committee did again meet at

4 the time and place of said adjournment for the hearirk, and consider-
5 ation thereof, and did again duly adjourn said hearing and consider-
ation to the 31st day of March, 1904, at four o' clock P. Y. at the same
7 place ; and
8 WHEREAS , Said Committee on Streets did again meet at the
9 place above mentioned on March 31st, 1904, at four o'clock P. M. for
10 the hearing, investigation and consideration thereof, and did then and
11 there duly investigate and consider the matter of said proposed vacation
12 and did then and there hear all testimony and evidence adduced on the
13 part of the petitioners and all other persons interested in the matter
14 of said proposed vacation, and did take proof of the matters averred in
15 said petition, and being of the opinion that the prayer of said petition
16 should be granted, did duly report these conclusions to said Board of
17 Aldermen, recommending the adoption of an appropriate resolution, de-
18 Glaring said vacation.
19 Now, Therefore , It is resolved by the Common Council of the
20 City of St. Paul, that the alley in Hahn' s Subdivision of Lots 1, 2 ,
21 8, 9 , 10 and 20 in Block 4 of Whitney' s Subdivision of Brewster' s
22 Addition,nbe and the same is hereby vacated aid discontinued as a public
23 alley.
24 Such vacation, however , is upon the condition that said
25 petitioners shall, before this resolution takes effect, pay into the
26 treasury of said City the sum of Five Dollars (*5.00) in addition to
27 the expenses of this proceeding, which is hereby fixed as the compen-
28 sation to be paid to said City in consideration of said vacation.
