Pursuant to the direction of the Committee on Streets, of the
Assembly, I herewith transmit a resolution for the vacation of certain
streets in Indian Mound Park, under Assembly File No. 073.

\lcx.WHEREAS, There was heretofore presented to the Assembly, one
of the branches off' the Common Council of- the City of Saint Paul, Minne-
sota, the petition of Robert A. Smith, as Mayor, and Joseph A. Wheelock,
as President of the Board of Park Commissioners, of said City of St.
Paul, for and on behalf of said City, which is the owner of all the land
and property abutting upon and adjoining all the streets and alleys
hereinafter named, praying for the vacation of all those portions of
Earl street, Thorn street, Mound street, Clifton Place , Hiawatha street,
Reserve street and Prospect Place , and also the alley in Block twenty-
two (22) of Clifton Park, an addition to said City, which lie within
the boundaries of Indian Mound Park in said City, as more particularly
shown and described upon the plat attached to and made a part of said
petition, and included within the red colored boundary line of said
Park shown upon said plat , which said petition is duly verified as re-
quired by law and duly sets forth the facts and reasons for such vaca-
tion; and
WHEREAS, The said Assembly deemed it expedient that the matter
therein referred to should be proceeded with, and ordered said petition
and accompanying plat to be filed of record in the office of the City
Clerk of said City, and ordered said Clerk to give notice , by publi-
cation in the official paper of said City, in the manner and for the
time required by law, that said petition and the subject matter thereof
would be heard and considered by the Committee on Streets, of said
Assembly, at its regular meeting to be held on the 31st day of August,
1903, at four o'clock in the afternoon of that day, at the Council
Chamber in the Court House and City Hall Building in said City, to
which said Committee said matter was duly referred for hearing and
at
report thereof, and thereupon said petition and plat were duly filed in
the office of said City Clerk and said notice was duly given and pub-
lished as required by law; and
WHEREAS, The said Committee on Streets, of said Assembly, did
meet at the time and place above mentioned and appointed for the hearing,
investigation and consideration thereof, and did then and there hear all
testimony and evidence adduced on the part of the-petitioners and all

Gentlemen: -
Herewith I transmit a petition signed by the Mayor and
the President of the Board of Park Commissioners, for the vacation
of certain streets and alleys in Indian Mound Park, accompanied by a
proper form of resolution directing the sere to be filed and the City
Clerk to give the necessary published notice of hearing thereon.

other persons interested in the matter of said proposed vacation, and
did take proof o°' the matters averred in said petition, and being of
the opinion that the prayer of said petition should be granted, did duly
report its conclusions to said Assembly, recommending the adoption of
a proper resolution declaring said vacation;
NOW, THEREFORE, Be It Resolved, By the Common Council of
the City of St. Paul, "pat all those portions of Earl street, Thorn .
street, Mound street, Clifton Place, Hiawatha street, Reserve street
and Prospect Place and also the alley in Block twenty-two (22) of
Clifton Park, an addition to said City, which lie within the boundaries
of Indian Mound Park in said City, as more particularly shown and des-
cribed upon the plat attached to said petition, and included within the
red colored boundary line of said Park shown upon said plat, be and
the same are hereby each and all vacated and discontinued as public
streets and alleys.
Resolved Further, That such vacation shall take effect with-
out the payment of any sum whatever therefor, for the reason that the
same is made wholly and exclusively for the interest and benefit of
the public and said City, and for the reason that said Board of Park
Commissioners have provided in lieu thereof, ample and sufficient drive-
ways, streets and walks to and from and through said Park, in lieu of
the streets and alleys hereby vacated.
