In the Matter of the Petition and Proceedings
to vacate that, Part of Eva Street in Morn son' s
Addition to West. St . Paul 'yin,- between Blocks
Eleven and Nineteen in said' Addition and ex-
tending from Eaton Avenue to the center of
O'Dell Creek.
To the Common Council of the City of St . Paul.
Your petitioners respectfully petition and request, your
honorable body to vacate and discontinue that, part of Eva Street in
Morrison's Addition to West St. Paul, lying and being between Blocks
Eleven and Nineteen in said addition and extendin ; from Eaton Avenue
to the center of O'Dell Creek; and colored green on attached plat.
Your petitioners alle go that North Western Fuel Co. is a
corporation organized under the laws of the Rate of Wisconsin and
is the owner of the following property situate in the City of St.
Paul, in the County of Ramsey and State of Miniesota, on the line of
that portion of Eva Street hereby sought to be disarntinued and
vacated and which property is known and described as follows, to-wit
Lots numbered One, Two and Three in Block numbered Nineteen and Lot
numbered Six in Block numbered Eleven in Morrison' s Addition to West
St . Paul; and,
That Chicago, Great Western Railway CO. is the owner of
the land and property abut`ing on and' lyin,g immediately south of the
southerly end of said Eva Street.
That said property hereinbefore described as owned by
North Western Fuel Co. constitutes all of the property and premises
on the line of that portion of Eva Street lying between Blocks
Eleven and Nineteen in Morrisons Addition to West St . Paul and
Eaton Avenue on the north;and the center of O'I)el t Creek on the
south. And

That all the property abutting on and lying immediately
south of the southerly end of said Eva Street is owned and in the
possession of the Chicago Great Western Railway Co.
That a plat of the portion of said street sought to be
vacated and the property on the line of and adjoining or abutting
upon the same is hereto attached andmade a part hereof and marked
"Exhibit, A" .
Your petitioners further allege that there is no bridge
'across O'Dell Creek at the southerly end of said Eva Street and
there is no street in any manner connecting the say ie with Clintom
Avenue on the southerly side of the tracks and property of said
Chicago Great Western Railway Co. , and that the character of the
ground at said pace is such that a cros sing at said point is im-
practicable and is not demanded by either the convenience or requiro-
ments of the public and that the portion of said street, hereby
sought to be discontinued and vacated is not used by the public.
That North Western Fuel Co. is also the owner of Lot s
Eight , Nine , Ten and Eleven in Block Six of Eaton & Morrison' s
Addition to West St . Pail, being property immediately adjoining the
property hereinbefore described as owned by the said company, and it
is the intention of said North Western Fuel Co. if your honorable
body vacates the portion of Eva Street , hereinbefore referred to and
hereby sought to be vacated, to place valuable improvements on the
entire property owned by it , which it will be impracticable to place
,(`upon the same if this petition is not granted.
WHEREFORE, your petitioners pray that your honorable body
take such proceedings ac; may be requisite and necessary to vacate
said portion of said Eva Street hereinbefore described, and that
your petitioners may have such other further and proper r relief as to

your honorable body may be just and equitable in the premises.

investigate the matter of said proposed
vacation, and did then and there hear all .

part of the petitioners and other persons
interested in the matter of said proposed
'vacation, and did take and hear proof of
—the matters averred in said petition, and
being of the opinion that the prayer of
said petition should be granted, reported .
its conclusions to said Board of Alder-
men, recommending the adoption of a
proper resolution declaring said vacation,
and said Common Council has duly ap-
proved and adopted said report;
Now, Therefore, Be It Resolved by the
Common Council of the City of St. Paul,
That all that portion of said Eva street ly-
ing and being between blocks numberel
eleven (11)and nineteen(19),in Morrison's
Addition to West St. Paul, in said City of
St. Paul, and extending from Eaton ave-
nue to the center of O'Dell Creek, as
shown upon the plat attached to said pe-
tition, and colored green thereon, be and
the same Is hereby vacated and discon-
tinued as a public street.
Resolved further, That said petitioners,
as a condition to such vacation, shall
pay into the City Treasury the sum of
Twenty-five dollars ($25.00), which is •
hereby fixed as the compensation to be
paid to said city in consideration of said •
vacation.
