dermen of the City of St. Paul, a body of
which,during the whole time of the publication of said notice herein- the Common Council of said city, that a
petition for the vaeenen of all that part
of Grace street in said city between the
northwest side line of Pleasant avenue,

City Clerk of the City of St. Paul, Minne-
sota,language, in the Cit of St. Paul Ramsey County, State of.Min- petitioners in and by recommend said petition the

and discontinued a new street be laid out
and opened along the northerly side of

jority of the property owners along that
portion of Grace Street in said city lying
between the northwest side line of Pleas
ant avenue, considered as produced.

of that portion of Grace street herein-
above described, which petition present-
ed and brought forth the faots and rea-
sons for such vacation and wits accom-
panied by a plat of the portion of the
street hereinabove described and pro-
posed to be vacated, and the lands ad-
joining thereto, and which petition was
duly verified, as required by law; and,
Whereas, said Board of Aldermen,
deeming it expedient that the matter
therein referred to should be proceeded
with, ordered said petition to be flied of
record by the City Clerk of the City of
St. Paul, and by resolution ordered said
City Clerk to give notice by publication
in the official paper of said city to the ef-
fect that said petition had been filed as
aforesaid; and stating in brief its object,
and that said petition would be heard
and considered by the Committee on
Streets of said Board of Aldermen, a
Committee appointed by said Board, on
the second day of November, A. D. 1899,

The attached Deed running from the Chicago, Milwau-
kee A St.Paul Railway Company to the City of St.Paul, is
deposited in escrow, to be delivered whenever the said
City shall furnish to said Railway Company a certified
copy of the proceedings of the City Council and Board of
Public Works showing Grace street duly vacated between
the west side of Pleasant avenue and the east side of
Victoria street, and in lieu thereof a new street duly
laid out upon the north side of the tracks of said Rail-
way Company,between said Pleasant avenue and Victoria

The Petition of the undersigned respectfully shows,
that they are amajority of the owners of property on the
line of Grace Street hereinafter mentioned, resident
within said City.
Your Petitioners respectfully request, that all ,that
part of Grace street in said City, between the northwest
side line of Pleasant Avenue considered as produced ac-
ross said Grace Street, and the east side line of Victoria
Street, be vacated and discontinued;
And, that in lieu of the portion of Grace street so
vacated and discontinued, a new street be laid out and

Dear Sir :-
There was referred to this office by your committee at
its last meeting , with instructions to draw up the proper form of
resolution and report at the next meeting of the board, the peti-
tion for the vacation of Grace street .
I have the honor to advise you that the petition itself
contains a condition to the effect that a new street shall be laid
out in lieu of the one to be vacated. A preliminary order for the
opening of this new street is now pending before the Board of Public
Works . Until those proceedings have reached tle proper stage , noth-
ing further ought to be done by your body . I have therefore neg-
lected to prepare resolution as requested , preferring to insure your
committee against an invalid procedure by awaiting the action of
the Board of Public Works.
