1 BE IT RESOLVED, that, upon the petition of Three Bears LLC, as documented in Technology
2 Department File Number 4-2000, public properties hereinafter described are hereby vacated and
3 discontinued as public property.

5 The property to be vacated is described as follows:

9 Drewry Lane lying between the south line of Payne Avenue extended northeasterly to the east
10 line of said Drewry Lane and the south line of Lot 7, Block 3, Irvine's 2°d Addition extended
11 easterly.

15 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
16 Saint Paul Legislative Code as amended, and to the following conditions:

18 1. That the petitioner's, their successors and assigns shall pay$500.00 as an administrative fee for
19 this vacation which is due and payable within 60 days of the effective date of this resolution.

21 2. That the petitioner shall pay the depreciated value of the publicly funded portion of the cost paid
22 to improve this street in 1984. The depreciation to be calculated on a straight line basis assuming
23 a 40 year life of the street improvements. The amount is calculated to be $8,213.34 based on a 40
24 percent depreciation. This amount is to be paid within 60 days of the effective date of this
25 resolution.

27 3. That the petitioner shall be responsible for all costs associated with the removal of the existing
28 street lighting system within the vacated area.

30 4. That the petitioner shall dedicate additional right-of-way for a turn-around at the north end of
31 remaining Drewry Lane, and construct said turn-around, all to the satisfaction of the Department
32 of Public Works Street Engineering.

34 5. That the petitioner shall be responsible for the rreconstruction of the intersection of Payne Avenue
35 and Drewry Lane and Drewry Lane at the south limits of the vacation, which will be necessary to

1 properly eliminate the appearance of a public thoroughfare, including but not limited to, costs for
2 new curbs, sidewalks, boulevards, storm drains and signs, all to the satisfaction of the
3 Department of Public Works.

5 6. That a permanent utility easement shall be retained within the vacated area on behalf of the City
6 of Saint Paul, Board of Water Commissioners subject to the following restrictions:

8 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
9 other object that will prohibit normal access to water facilities for maintenance purposes
10 will be permitted within the easement area,.

12 b. No change from the existing grade will be permitted without written permission from the
13 Water Utility.

15 c. No change in surfacing within the easement area will be permitted without written
16 permission from the Water Utility.

18 d. The petitioner, its successors and assigns shall fully indemnify, defend and save harmless
19 the Board of Water Commissioners, its officers, agents, employees, and servants from all
20 suits, action or claims which shall arise from any injuries or damages received or
21 sustained by any break in any service pipe, water main, or connection in said reserved
22 easement, arising out of or resulting from any action or negligence of the petitioner, its
23 employees, agents or business invitees.

25 7. That a permanent utility easement shall be retained within the vacated area to protect the interest
26 of Northern States Power Company.

29 of U.S. West Communication, Inc.
