3 BE IT RESOLVED,that, upon the petition of Mark Gergen, as documented in Real Estate Division
4 File Number 2003-09, public properties hereinafter described are hereby vacated and discontinued as
5 public property: The property to be vacated is described as:

8 That part of Curtice Street dedicated as View Street in JACKSON AND BIDWELLS
9 ADDITION TO WEST ST.PAUL which lies between the east line of Hall Avenue and
10 the east addition line of said JACKSON AND BIDWELLS ADDITION TO WEST ST.PAUL;
11 and that part of Curtice Street as opened under an order of the Common Council
12 June 8, 1889 and as recorded in the Ramsey County Recorder's Office.

15 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
16 Saint Paul Legislative Code as amended, and to the following conditions:

19 1. That the petitioner's, their successors and assigns shall pay $1,200.00 as an administrative fee for
20 this vacation which is due and payable within 60 days of the effective date of this resolution.

23 2. That a permanent utility easement shall be retained within the vacated area to protect the interest
24 of Xcel Energy (Electric) over, under and across the west 160 feet of the north 10 feet of the area
25 to be vacated and any re-platting of easements shall provide service to the property at766 Curtice.

28 3. That a permanent utility easement shall be retained within the vacated area to protect the interest
29 of Xcel Energy (Gas Division) for accessing existing facilities.

32 4. That a permanent utility easement shall be retained within the vacated areas to protect the interest

3 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character

6 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
7 because of any claims or liability arising from any violation of any law or regulation made in
8 accordance with the law, whether by the petitioners or any of their agents or employees.

Dear Mark:
Bohlen Surveying& Engineering, Inc. has prepared the legal description for the vacation of
Curtice Street to assist the platting of the Hall Avenue housing development in the southeast
corner of Hall Avenue and Curtice Street in St. Paul. The Curtice Street right-of-way does
not currently contain a public street or public utilities.
The following is the legal description of the Curtice Street right-of-way to be vacated:
Curtice Street east of Hall Avenue and west of Humboldt Avenue.
Attached is a copy of the City section map, a map of the Curtice Street right-of-way and the
area to be developed. Please note that Parcel A will go to Harold Dokmo, fee owner, Parcel
B will go to Matthew Monzel, fee owner and Parcel C will go to Mark Gergen, fee owner.
All fees related to the vacation process will be paid by Mark Gergen& Associates, fee owner
of 766 Hall Avenue.
Site plans for the 766 Hall Avenue parcel are also included in this submittal. Building pads
12 and 13 are located on the Curtice Street right-of-way (Parcel C). Trees will be removed
and grade will be altered to accommodate the construction of units 12 and 13 (assuming City
of St. Paul approval of this site plan.).
