1 WHEREAS, the Council of the City of Saint Paul, upon the petition of Minnesota Public Radio, as
2 contained in Technology Department File Numbered 2001-24 did, by that resolution stated in Council
3 File Numbered 02-165, approve the petition to vacate and discontinue as public property the following

10 WHEREAS, a portion of the description above mentioned in Exhibit "A" from Council File Numbered

14 NOW THEREFORE BE IT RESOLVED, that the description in Exhibit "A" from the Council File
15 Numbered 02-165 is hereby amended as follows:

17 strikethrough (remove) the words "An easement for"

19 AND BE IT FURTHER RESOLVED, that all other terms and conditions set forth in Council File
20 Numbered 02-165 shall remain in full force and effect.

2001. The resolution provides for the vacation of that part of the air rights over Cedar Street as more
fully described in the attached resolution.
Also included is an acceptance of the terms of the resolution which must be signed and filed here
with the administrative fee of$500 as stated in line 14 of the resolution.

1 BE IT RESOLVED, that, upon the petition of Minnesota Public Radio ("MPR" or"Petitioner"), as
2 documented in Real Estate Division File Number 2001-24, public properties hereinafter described are
3 hereby vacated and discontinued as public property:

5 The property to be vacated (the vacation area) is described as follows:

7 See Attached Map & Description in Exhibit"A"

10 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
11 Saint Paul Legislative Code as amended, and to the following conditions:
12

14 1. That the petitioner's, their successors and assigns shall pay$500.00 as an administrative fee for
15 this vacation which is due and payable within 60 days of the effective date of this resolution.
16
17 2. At the regttirement of the City of Saint Paul, Department Public Works, a minimum
18 clearance under any skyway bridge built in the vacated area shall be seventeen feet, four inches in
19 the vehicular area of the street. Any skyway bridge built in the vacation area shall also be
20 required to follow the "American Association of State Highway and Transportation Officials"
21 standard specifications for Highway Bridges, sixteeth addition,1996.
22
23 At the request of the City of Saint Paul, Department of Public Works, any skyway bridge
24 constructed in the vacated area shall be compatible with the guidelines for the Capitol view
25 corridor.

27 This vacation public property shall remain in place for the life of the proposed structure only.
28
29 Construction of a skyway in the vacation area described in attached Exhibit"A", shall nullify
30 the petition to vacate public property referenced in Real Estate Division File Number 2001-23
31 and all property rights mentioned in File Number 2001-23 shall revert back to the City of Saint
32 Paul.

34 3. That if no skyway bridge is built within five years of the approval of this resolution, all rights to
35 vacated area shall revert back to the City of Saint Paul.

2: 4. The City of Saint Paul, Department of Planning and Economic Development will agree with the
3 petition to vacate air rights across Cedar street, subject to the following conditions: 0)-_ (65

6 #2001-23 or#2001-24). Should MPR's final design require different or adjacent air rights, they
7 will be allowed to submit a new petition for vacation.

9 b)That prior to issuance of a building permit for the construction of this air bridge, MPR will be
10 required to submit, in writing, the specific purpose and intended use of this air bridge to Public
11 Works and Planning and Economic Development. .

13 c) That the location, height and transparency of the air bridge maximize the view of the State
14 Capitol. the Capital Area Architectural Planning Board and
15 District 17 Planning Council
16 d)That MPR continue to work with the Design Cent re:to explore at-grade solutions for a
17 connection between their headquarters and the Fitzgerald Theatre consistent with the Saint Paul
18 on the Mississippi Development Framework as well as public access and future
19 e. That MPR understancl; tha the City wishes to connections to the skyway system
keep the ublic skyway option open and available.
20 5. ThaI the petitioners, their successors and assigns agree to indemnify, defend and save harmless
21 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
22 brought as a result of injuries or damages received or sustained by any person, persons or
23 property on account of this vacation or petitioners' use of this property, including but not limited
24 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or •
25 because of any claims or liability arising from any violation of any law or regulation made in
26 accordance with the law, whether by the petitioners or any of their agents or employees.

28 6. That the petitioners, their successors and assigns shall, within 60 days of the effective date of
29 this resolution, file with the City Clerk an acceptance in writing of the conditions of this
30 resolution and shall, within the period(s) specified in the terms and conditions of this resolution,
31 comply in all respects with these terms and conditions.

1 BE IT RESOLVED, that, upon the petition of Minnesota Public Radio ("MPR" or"Petitioner"), as

10 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
11 Saint Paul Legislative Code as amended, and to the following conditions:

14 1. That the petitioner's, their successors and assigns shall pay$500.00 as an administrative fee for
15 this vacation which is due and payable within 60 days of the effective date of this resolution.

17 2. At the requirement of the City of Saint Paul, Department Public Works, a minimum
18 clearance under any skyway bridge built in the vacated area shall be seventeen feet, four inches in
19 the vehicular area of the street. Any skyway bridge built in the vacation area shall also be
20 required to follow the "American Association of State Highway and Transportation Officials"
21 standard specifications for Highway Bridges, sixteeth addition,1996.

23 At the request of the City of Saint Paul, Department of Public Works, any skyway bridge
24 constructed in the vacated area shall be compatible with the guidelines for the Capitol view
25 corridor.

27 This vacation public property shall remain in place for the life of the proposed structure only.

29 Construction of a skyway in the vacation area described in attached Exhibit"A", shall nullify
30 the petition to vacate public property referenced in Real Estate Division File Number 2001-23
31 and all property rights mentioned in File Number 2001-23 shall revert back to the City of Saint
32 Paul.

34 3. That if no skyway bridge is built within five years of the approval of this resolution, all rights to
35 - vacated area shall revert back to the City of Saint Paul.

3 petition to vacate air rights across Cedar street, subject to the following conditions:

5 a)That only one of the two vacation petitions submitted by MPR be granted at this time (File
6 #2001-23 or#2001-24). Should MPR's final design require different or adjacent air rights, they
7 will be allowed to submit a new petition for vacation.

9 b) That prior to issuance of a building permit for the construction of this air bridge, MPR will be
10 required to submit, in writing, the specific purpose and intended use of this air bridge to Public
11 Works and Planning and Economic Development.

13 c) That the location, height and transparency of the air bridge maximize the view of the State
14 Capitol. the Capital Area Architectural Planning Board and
15 District 17 Planning Council
16 d) That MPR continue to work with the Design Center,to explore at-grade solutions for a
17 connection between their headquarters and the Fitzgerald Theatre consistent with the Saint Paul
18 on the Mississippi Development Framework. as well as public access and future
e. That MPR understands that the City wishes to connections to the skyway system
19 keep the public skyway option open and available.

21 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character

Minnesota Public Radio("MPR")intends to build a skyway over the portion of Cedar Street whose air rights are
proposed to be vacated. The proposed skyway would connect the 480 Cedar Street building,which is proposed to
become a part of MPR's new business campus,to the skyway connecting to the World Trade Center Parking Ramp.
The skyway will enhance pedestrian mobility to,from and within MPR's proposed new business campus. This
connection would create access to the Saint Paul skyway system for MPR's employees,as well as establish more
efficient access to the World Trade Center Parking Ramp for MPR's employees utilizing that facility.
