Council File# 32 Real Estate Division 140 City Hall Green Sheet# ,2o S7 7 RESOLUTION CITY OF SAINT PAUL, MINNESOTA Z� i Presented By Referred To Committee: Date 1 BE IT RESOLVED,that, upon the petition of Scott Ebel, as documented in Real Estate Division File 2 Number 15-2003, public properties hereinafter described are hereby vacated and discontinued as public 3 property: 4 5 The property to be vacated is described as follows: 6 7 That part of the alley in Block 2, Wifelburg Hills lying westerly of the northerly extension of the 8 east line of Lot 23, said Block 2, and lying easterly of the northerly extension of the west line of 9 the said Lot 23. 10 11 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the 12 Saint Paul Legislative Code as amended, and to the following conditions: 13 14 1. That the petitioner's, their successors and assigns shall pay$$600.00 as an administrative fee for 15 this vacation which is due and payable within 60 days of the effective date of this resolution. 16 17 2. That a permanent utility easement shall be retained on, over, under and across the vacated area on 18 behalf of the City of Saint Paul, Department of Public Works to reserve the right of the City to 19 maintain and operate any sewer in or upon said easement and to enter upon said easement or any 20 portion thereof at any time and from time to time, for the purposes of future construction, 21 reconstruction, inspecting, maintaining or repairing the same or any part thereof Any 22 development or use of the property shall be subject to the following conditions: 23 24 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any 25 other objects that will prohibit normal access to utility facilities for maintenance purposes 26 will be permitted within the easement area. 27 28 b. Improvements in or upon the above described easement that do not prohibit the City from 29 exercising its reserved rights may be allowed by obtaining written permission from the 30 Department of Public Works Sewer Division with the understanding that the restoration 31 and costs of such improvements shall be the sole responsibility of the petitioner, its 32 successors and assigns in the event the City exercises its reserved easement rights. 33 34 c. No change from the existing grade within the easement area will be permitted without 35 written permission from the Department of Public Works. 03- 1032- 1 d. No change in surfacing within the easement area will be permitted without written 2 permission from the Department of Public Works. 3 4 e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless the 5 City of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or 6 claims which shall arise from any injuries or damages received or sustained by any break 7 in any service pipe or connection in said reserved easement arising out of or resulting 8 from any action or negligence of the petitioner, its employees, agents, or business 9 invitees. 10 11 3. That, on behalf of the Board of Water Commissioners of the City of Saint Paul, a permanent 12 utility easement shall be retained on, over, under and across the vacated area to reserve the right 13 of the Board to maintain and operate any water facility in, on or upon said easement, and to enter 14 upon said easement or any portion thereof at any time, and from time to time for the purposes of 15 future construction, reconstruction, inspection, maintenance or repair of the same or any part 16 thereof. The said utility easement shall be subject to the following restrictions: 17 18 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or 19 other object that may prohibit normal access to water facilities for maintenance purposes 20 will be permitted within the easement area. 21 22 b. With written permission from the Saint Paul Regional Water Services, improvements in 23 or upon the above described easement that do not prohibit or limit the full and free 24 exercise by the Saint Paul Regional Water Services of its reserved rights may be allowed, 25 with the understanding that the restoration and costs of such improvements, should the 26 Water Services exercise its easement rights, shall be the sole responsibility of the fee 27 owner, its successors and assigns. 28 29 c. Should it be necessary that the petitioner's works or improvements be removed, or should 30 the said works or improvements be damaged as a result of the Saint Paul Regional Water 31 Services' operations, all removal, replacement or modification costs shall be borne solely 32 by the petitioner. 33 34 d. No change from the existing grade within the easement shall be permitted without written 35 permission from the Saint Paul Regional Water Services. 36 37 e. That the petitioners,their successors and assigns agree to indemnify, defend and save harmless 11 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character 12 brought as a result of injuries or damages received or sustained by any person, persons or 13 property on account of this vacation or petitioners' use of this property, including but not limited 14 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or 15 because of any claims or liability arising from any violation of any law or regulation made in 16 accordance with the law, whether by the petitioners or any of their agents or employees. 17 18 8. That the petitioner's,their successors and assigns shall pay$$600.00 as an administrative fee for 15 this vacation which is due and payable within 60 days of the effective date of this resolution. 16 17 2. That a permanent utility easement shall be retained on, over, under and across the vacated area on 18 behalf of the City of Saint Paul, Department of Public Works to reserve the right of the City to 19 maintain and operate any sewer in or upon said easement and to enter upon said easement or any 20 portion thereof at any time and from time to time, for the purposes of future construction, 21 reconstruction, inspecting, maintaining or repairing the same or any part thereof Any 22 development or use of the property shall be subject to the following conditions: 23 24 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any 25 other objects that will prohibit normal access to utility facilities for maintenance purposes 26 will be permitted within the easement area. 27 28 b. Improvements in or upon the above described easement that do not prohibit the City from 29 exercising its reserved rights may be allowed by obtaining written permission from the 30 Department of Public Works Sewer Division with the understanding that the restoration 31 and costs of such improvements shall be the sole responsibility of the petitioner, its 32 successors and assigns in the event the City exercises its reserved easement rights. 33 34 c. No change from the existing grade within the easement area will be permitted without 35 written permission from the Department of Public Works. 0°S- 1032 1 d. No change in surfacing within the easement area will be permitted without written 2 permission from the Department of Public Works. 3 4 e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless the 5 City of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or 6 claims which shall arise from any injuries or damages received or sustained by any break 7 in any service pipe or connection in said reserved easement arising out of or resulting 8 from any action or negligence of the petitioner, its employees, agents, or business 9 invitees. 10 11 3. That, on behalf of the Board of Water Commissioners of the City of Saint Paul, a permanent 12 utility easement shall be retained on, over, under and across the vacated area to reserve the right 13 of the Board to maintain and operate any water facility in, on or upon said easement, and to enter 14 upon said easement or any portion thereof at any time, and from time to time for the purposes of 15 future construction, reconstruction, inspection, maintenance or repair of the same or any part 16 thereof. The said utility easement shall be subject to the following restrictions: 17 18 a. No buildings, structures,trees or any temporary structure, material storage, fixture, or 19 other object that may prohibit normal access to water facilities for maintenance purposes 20 will be permitted within the easement area. 21 22 b. With written permission from the Saint Paul Regional Water Services, improvements in 23 or upon the above described easement that do not prohibit or limit the full and free 24 exercise by the Saint Paul Regional Water Services of its reserved rights may be allowed, 25 with the understanding that the restoration and costs of such improvements, should the 26 Water Services exercise its easement rights, shall be the sole responsibility of the fee 27 owner, its successors and assigns. 28 29 c. Should it be necessary that the petitioner's works or improvements be removed, or should 30 the said works or improvements be damaged as a result of the Saint Paul Regional Water 31 Services' operations, all removal, replacement or modification costs shall be borne solely 32 by the petitioner. 33 34 d. That the petitioners,their successors and assigns agree to indemnify, defend and save harmless 11 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character 12 brought as a result of injuries or damages received or sustained by any person, persons or 13 property on account of this vacation or petitioners' use of this property, including but not limited 14 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or 15 because of any claims or liability arising from any violation of any law or regulation made in 16 accordance with the law, whether by the petitioners or any of their agents or employees. 17 18 8.
