1 BE IT RESOLVED,that, upon the petition of Louis Phillip Gravel III, as documented in Real Estate
2 Division File Number 20-2003, public properties hereinafter described are hereby vacated and
3 discontinued as public property:

5 The property to be vacated is described as follows:

7 That part of Hoyt Avenue lying westerly of the west line of Cumberland Street and easterly of the
8 southerly extension of the east line of the north-south alley in Idaho Addition.

10 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
11 Saint Paul Legislative Code as amended, and to the following conditions:

13 1. That the petitioner's, their successors and assigns shall pay$600.00 as an administrative fee for
14 this vacation which is due and payable within 60 days of the effective date of this resolution.

16 2. That a permanent drainage easement shall be retained across the south 3+60-feet of the vacated
17 area on behalf of the City of Saint Paul, Department of Public Works. Any development or use
18 of the property on which thee easement is retained shall be subject to the following conditions:

20 a. No buildings, structures, trees or any temporary structure,material storage, fixture, or any
21 other objects that will restrict the normal flow of surface water will be permitted within
22 the easement area.

24 b. Improvements in or upon the above described easement that do not prohibit the City from
25 exercising its reserved rights may be allowed by obtaining written permission from the
26 Department of Public Works Sewer Division with the understanding that the restoration
27 and costs of such improvements shall be the sole responsibility of the petitioner, its
28 successors and assigns in the event the City exercises its reserved easement rights.

30 c. No change from the existing grade within the easement area will be permitted without
31 written permission from the Department of Public Works.

33 d. No change in surfacing within the easement area will be permitted without written
34 permission from the Department of Public Works.

1 e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless the
2 City of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or
3 claims which shall arise from any injuries or damages received or sustained by any break
4 in any service pipe or connection in said reserved easement arising out of or resulting
5 from any action or negligence of the petitioner, its employees, agents, or business
6 invitees.

8 3. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
9 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
10 brought as a result of injuries or damages received or sustained by any person,persons or
11 property on account of this vacation or petitioners' use of this property, including but not limited
12 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
13 because of any claims or liability arising from any violation of any law or regulation made in
14 accordance with the law, whether by the petitioners or any of their agents or employees.

16 4. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
17 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
18 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in
19 all respects with these terms and conditions.

I am requesting a date of September 22, 2004 for a Public Hearing to approve the
attached Council Resolution. The purpose of the resolution is to approve the petition of
Phil Gravelt to vacate a portion of West Hoyt Avenue. I have enclosed photocopies of the
Green Sheet, the Council Resolution and a map of the area to be vacated. Please let me
know if there is any additional information you might need.
The resolution is currently being routed for signatures along with the responses from the
utilities and other pertinent information.

I the undersigned, being a majority of the owners of abutting properties, do hereby
petition the Council of the City of St. Paul to vacate its interests in the property legally
described as follows:
The Hoyt Avenue right-of-way located west of the
Cumberland Street right-of-way and east of the alley
running north-south between Cumberland Street and Arundel
Street.
I request this vacation in order to improve my yard. I own the property on both sides of
the property being vacated. This section of right-of-way is unimproved and will never be
improved because of the steep slopes. There are no utilities in this section of right-of-
way. Previously I have been granted a permit for land alteration on the right-of-way.
However, I have been reluctant to invest any money on landscaping or other
improvements without ownership.
As a point of clarification, my Legal name is Louis Phillip Gravel III. However, I have
gone by Phil Gravel my whole life and one of the properties adjacent to the property to be
vacated is recorded under that name.
I will attest to the authenticity of the signatures below. The following information is
included with this petition per City guidelines.
