That a permanent utility easement shall be retained within the westerly 10 feet of that part of Petit Street 38 lying easterly of Payne Avenue to protect the interest of Northern States Power Company, d.b.a. That the developer shall be responsible for all costs associated with the removal of the existing street 2 lighting system and traffic signs within the streets hereby vacated. 3 4 4. That the developer shall be responsible, to the satisfaction of the Department of Public Works Sewer 5 Engineering Division, for the proper abandonment of the existing sewer in Kenny Road and the 6 relocation of the service to 520 Payne Avenue. 7 8 5. That the developer shall be responsible for the reconstruction, as required to eliminate the appearance of 9 public thoroughfare, of the east side of Payne Avenue across Kenny Road, Hopkins and Petit Streets, 10 including but not limited to costs for new curbs, sidewalks, boulevards and storm drains, all to the 11 satisfaction of the Department of Public Works. 12 13 6. That the developer shall plat or dedicate new utility easements as required to service the planned 14 development, as well as any other properties currently served by existing facilities within the streets 15 hereby vacated. 16 17 7. That the release of easements within the streets hereby vacated shall not take effect until new easements 18 have been created. 19 20 8. That the developer shall assume all costs of relocating existing facilities to the new easements. 21 22 9. That the developer shall not remove any trees from park or trail property or from Regional Rail Property. 23 24 10. That the developer shall provide drainage from the area to be developed sufficient to prevent drainage 25 onto park or trail property. 26 27 11. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless the City 28 of Saint Paul, its officers and employees from all suits, actions or claims of any character brought as a 29 result of injuries or damages received or sustained by any person, persons or property on account of this 30 vacation or petitioners' use of this property, including but not limited to, a claim brought because of any 31 act of omission, neglect, or misconduct of said petitioners or because of any claims or liability arising 32 from any violation of any law or regulation made in accordance with the law, whether by the petitioners 33 or any of their agents or employees. 34 35 12. That the developer shall be responsible for all costs associated with the removal of the existing street 2 lighting system and traffic signs within the streets hereby vacated. 3 4 4. That the developer shall be responsible, to the satisfaction of the Department of Public Works Sewer 5 Engineering Division, for the proper abandonment of the existing sewer in Kenny Road and the 6 relocation of the service to 520 Payne Avenue. 7 8 5. That the developer shall be responsible for the reconstruction, as required to eliminate the appearance of 9 public thoroughfare, of the east side of Payne Avenue across Kenny Road, Hopkins and Petit Streets, 10 including but not limited to costs for new curbs, sidewalks, boulevards and storm drains, all to the 11 satisfaction of the Department of Public Works. 12 13 6. That the developer shall plat or dedicate new utility easements as required to service the planned 14 development, as well as any other properties currently served by existing facilities within the streets 15 hereby vacated. 16 17 7. That the release of easements within the streets hereby vacated shall not take effect until new easements 18 have been created. 19 20 8. That the developer shall assume all costs of relocating existing facilities to the new easements. 21 22 9. That the developer shall not remove any trees from park or trail property or from Regional Rail Property. 23 24 10. That the developer shall provide drainage from the area to be developed sufficient to prevent drainage 25 onto park or trail property. 26 27 11. That the petitioners,their successors and assigns agree to indemnify, defend and save harmless the City 28 of Saint Paul, its officers and employees from all suits, actions or claims of any character brought as a 29 result of injuries or damages received or sustained by any person,persons or property on account of this 30 vacation or petitioners' use of this property, including but not limited to, a claim brought because of any 31 act of omission, neglect, or misconduct of said petitioners or because of any claims or liability arising 32 from any violation of any law or regulation made in accordance with the law,whether by the petitioners 33 or any of their agents or employees. 34 35 12. Q G f' cD SPONSORSHIP RESOLUTION NO. 02-07/24- RESOLUTION AUTHORIZING ACQUISITION AND FUNDING OF PARCEL 520 PAYNE AVENUE WITHIN THE RAILROAD ISLAND-PHALEN CORRIDOR HOUSING DEVELOPMENT PHASE I, PAYNE-PHALEN DISTRICT 5 1 WHEREAS,the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota 2 ("HRA") has duly adopted and there is now in legal effect a City-Wide Redevelopment Plan for 3 the acquisition, rehabilitation and resale of properties and incorporates the Railroad Island Small 4 Area Plan all of which identifies the Payne-Phalen District 5 area as a part of this plan; and 5 6 WHEREAS, the City of Saint Paul recognizes the problems created by deteriorated and blighting 7 building, inappropriate land use and vacant/under utilized land in its neighborhoods, and also 8 recognizes the need to take the initiative to address these issues by providing a decent mix of 9 housing opportunities in a wide range of economic diversity which could include affordable 10 housing in order to revitalize and stabilize our existing neighborhoods which in turn assist in 11 preserving the City's most affordable housing; and 12 13 WHEREAS,the Housing and Redevelopment Authority of the City of Saint Paul has the power 14 to engage in development or redevelopment activities under Chapter 469 of the Minnesota 15 Statutes, Housing and Redevelopment Act("Act") and by authority of said Act engages in 16 activities relating to: 1) housing projects and development; 2) removal of prevention of the 17 spread of conditions of blight or deteriorations; 3)bringing substandard buildings and 18 improvements into compliance with public standards; 4) disposition of land for private 19 development; and 5) improving the tax base and the financial stability of the community; and 20 engages in the aforementioned activities when redevelopment or development needs cannot be 21 met through reliance solely upon private initiative, and may engage in said activities in targeted 22 neighborhoods; and 23 24 WHEREAS,the HRA engages in the aforementioned activities when these needs cannot be met 25 through reliance solely upon private initiative; and 26 27 WHEREAS, the Act gives a specific range of powers including the power to acquire land, sell 28 land, engage in planning, employ a variety of financing instruments, and establish land use 29 controls and additionally, it requires that activities be devised according to a plan or program of 30 which the Railroad Island Small Area Plan and its housing master plan together with the City 31 Wide Redevelopment Plan meets all this criteria; and 32 33 34 35 WHEREAS, this situation creates an opportunity to redevelop a property that the use is no longer 36 appropriate for the revitalization that is being undertaken in the neighborhood and with the 37 property available for sale provides an opportunity to develop new life style change housing in 38 an area that needs a variety of housing options by providing quality, moderate and affordable 39 housing thereby improving neighborhood stability and appearance; and 40 41 WHEREAS,property known as Parcel 520 Payne Avenue consists of an industrial use (Truck& 42 Auto repair& paint distribution facility) which is no longer a viable use and available for sale in 43 this mostly residential neighborhood thereby creating an opportunity to remove a use or future 44 use which could have a detrimental affect in Railroad Island with an I-1 zone and will provide 45 an opportunity to create 30-40 new housing units with possible retail allowing for another 46 housing types and mix to bring economic diversity to a neighborhood that is in need of home 47 ownership opportunities to provide stability and encourage private investment; and 48 49 WHEREAS, the acquisition of Parcel 520 Payne Avenue (Stage VI) in combination with the 50 other five stages taking place all located in the approved Railroad Island Small Area Plan within 51 Payne-Phalen District 5, will add an additional 30-40 units of housing over the next four years to 52 the current 131-148 units of new housing being started in the first five stages within this 53 residential neighborhood where the need for new housing opportunities will bring the economic 54 diversity to this neighborhood that is so essential to help it grow once again to a healthy and 55 stable neighborhood located in Payne-Phalen District 5 area; and 56 57 WHEREAS,the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota 58 ("HRA") has duly adopted and there is now in legal effect a City-Wide Redevelopment Plan for 59 the acquisition, rehabilitation, redevelopment and resale of property in the City of Saint Paul of 60 which the Railroad Island Small Area Plan is a part within Payne-Phalen District 5 area; and 61 62 NOW, THEREFORE BE IT RESOLVED by the Housing and Redevelopment Authority of the 63 City of Saint Paul, Minnesota,that the public acquisition of the property identified as: 64 65 Parcels 560-562 Payne Avenue: 66 (Lots 1, 2,3 and 4,Block 7, Brunson's Addition, Ramsey County, Minnesota, plus 67 vacated alley adjoining and except that portion of Lots 1, 2, 3 and 4, Block 7, in the 68 adjoining railroad right-of way) 69 70 which underutilized property located within the Payne-Phalen District 5 area constitutes a 71 blighting influence in the neighborhood, is hereby approved in accordance with the following: 72 73 1. That the HRA hereby authorizes staff to take all actions necessary for the acquisition of 74 the property identified above which includes the specific authorization to: 1.) make offers 75 to affected property owner and negotiate such offer to a successful conclusion; or 2.) in 76 circumstances where negotiation proves to be unsuccessful, condemn property under the 77 procedures provided in applicable Minnesota statutes, and in compliance with all 78 requirements of such statutes, using quick take procedures and Minnesota Statutes 79 469.012, Subd. 1, (6) (7) provides for the acquisition, clearance or rehabilitation of 80 blighting conditions to allow for housing for low/moderate income families together with 81 acquisition, demolition or rehabilitation providing improvements to afford maximum 82 opportunity, consistent with the sound needs of the community as a whole, and providing 83 economic stability for the area. 84 85 2. That pursuant to Chapter 548,Law of Minnesota 1984, it is hereby certified that said 86 property meets the condition of Minnesota Statutes Section 272.02, Subdivision 1, clause 87 (7) and 469.040, Subdivision 1, until sold for private redevelopment are exempt from 88 property taxes. 89 90 3. That the HRA finds that this need will otherwise not be met through reliance solely upon 91 private initiative or redevelopment and is necessary to carry out activities identified in the 92 City Wide Redevelopment Plan and the Saint Paul Comprehensive Plan which includes a 93 Land Use Plan and a Housing Plan approved by the City Council on March 24, 1999. 94 95 4. That the property will be combined with adjacent vacant property owned by HRA to 96 provide for the additional development of 30-40 units of new housing and identified as 97 Stage VI of the Railroad Island-Phalen Corridor Housing Development approved by the 98 HRA Board on March 13, 2002 thereby increasing the number of housing units from131- 99 148 to 161-178 new housing units over the next four years. 100 101 5. That HRA Board hereby approve the budget amendment to the Year 2002 HRA Budget 102 attached to this Resolution as Attachment A and made a part hereof. SPONSORSHIP RESOLUTION NO. 02-03/13- RESOLUTION AUTHORIZING DEVELOPER DESIGNATION, APPROVAL OF THE RAILROAD ISLAND -PHALEN CORRIDOR HOUSING PHASE I,ACCEPTANCE OF FUNDING GRANTS AND BUDGET AMENDMENT FOR FUNDING APPROVAL FOR RAILROAD ISLAND-PHALEN CORRIDOR HOUSING DEVELOPMENT PHASE I, PAYNE-PHALEN DISTRICT 5 1 WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota 2 ("HRA") has duly adopted and there is now in legal effect a City-Wide Redevelopment Plan and 3 a City Comprehensive Plan that incorporates a Housing Plan for the acquisition, rehabilitation 4 and resale of properties and incorporates the Railroad Island Small Area Plan all of which 5 identifies the Payne-Phalen District 5 area as a part of this plan; and 6 7 WHEREAS, there is a long history on Railroad Island and the many attempts to revitalize this 8 neighborhood and the City of Saint Paul recognizes that this neighborhood has been surrounded 9 by detrimental uses that have stifled its revitalization, large numbers of jobs loss through plant 10 closings all over the east side over the last ten years and more; and 11 12 WHEREAS, deteriorated and blighting buildings, vacant and under utilized land in the Railroad 13 Island neighborhood shows the need to take the initiative to address these issues by providing a 14 decent mix of housing opportunities in a wide range of economic diversity in housing 15 opportunities in order to revitalize and stabilize our existing neighborhoods which in turn assists 16 in preserving the City's most affordable housing; and 17 18 WHEREAS, the Housing and Redevelopment Authority of the City,of Saint Paul has the power 19 to engage in development or redevelopment activities under Chapter 469 of the Minnesota 20 Statutes, Housing and Redevelopment Act("Act") and by authority of said Act engages in 21 activities relating to: 1) housing projects and development; 2)removal and prevention of the 22 spread of conditions of blight or deteriorations; 3) bringing substandard buildings and 23 improvements into compliance with public standards; 4) disposition of land for private • 24 development; and 5) improving the tax base and the financial stability of the community; and 25 engages in the aforementioned activities when redevelopment or development needs cannot be 26 met through reliance solely upon private initiative, and may engage in said activities in targeted 27 neighborhoods; and 28 29 WHEREAS,the Act gives a specific range of powers including the power to acquire land, sell 30 land, engage in planning, employ a variety of financing instruments, and establish land use 31 controls and additionally, it requires that activities be devised according to a plan or program of 32 which the Railroad Island Small Area Plan and its housing master plan together with the City 33 Wide Redevelopment Plan and City Wide Comprehensive Plan which incorporates a specific 34 Housing Plan that identifies the need for these activities; and 35 36 WHEREAS, in an effort to make sure that this redevelopment is a realty a number of actions 37 were undertaken to secure the necessary financing tools to move this development forward, 38 applications were submitted and approved bringing together over$8.7 million of other sources to 39 assist with this housing development that will bring $27.4 million of improvements to this 40 neighborhood; and 41 42 WHEREAS the creativity of finding funding sources, one of which is the HUD 108 loan does 43 require participation by a neighborhood community organization, Dayton's Bluff Neighborhood 44 Housing Services, Inc. (DBNHS) was identified and supported by all parties as the developer that 45 could move this project forward as strongly supported by current development activities 46 undertaken by DBNHS and was recommended as the developer for the Railroad Island-Phalen 47 Corridor Housing Development Phase I; and 48 49 WHEREAS, this situation creates an opportunity to redevelop a vacant and underutilized 50 property by providing needed quality,moderate and affordable housing thereby improving 51 neighborhood stability and appearance; and 52 53 WHEREAS, the $27.5 million project offers a unique opportunity for housing styles and designs 54 and the production of 131-148 units of new ownership housing , but it also requires additional 55 expenditures for infrastructure and soil remediation. 56 57 WHEREAS, the Railroad Island-Phalen Corridor Housing Development Phase I will assist in the 58 development of over 11 acres with 131-148 new housing units within a residential neighborhood 59 that needs new housing opportunities to bring the economic diversity to this neighborhood that is 60 so essential to help it grow once again to a healthy and stable neighborhood located in Payne- 61 Phalen District 5 area; and 62 63 NOW, THEREFORE BE IT RESOLVED by the Housing and Redevelopment Authority of the 64 City of Saint Paul, Minnesota,that the following actions are hereby approved: 65 66 1. Authorization to designate Dayton's Bluff Neighborhood Housing Services,Inc. as tentative 67 developer of Railroad Island-Phalen Corridor Housing Development Phase I for stages 1-5, 68 enter into a Land Sales Contract and Development Agreement within the next 90 days and 69 schedule a public hearing for sale . 70 71 2. Authorization to accept the$1.3 million Grant awarded by Minnesota Housing Financing 72 Agency for the development of the first stage of 50 units of new housing. 73 74 3. Authorization to approve funding in the amount of$2,525,000 from the HRA Comprehensive 75 Housing Real Estate Program (117-26505) in the amount of$1.8 million, CDBG(100-96004- 76 0584) in the amount of$280,000 and land sales proceeds of$445,000 to support the acquisition 77 and development of 131-148 housing units over the next four years. 78 79 80 4. Authorization to request the City Council to Accept the HUD 108 Loan and BEDI Grant of$10.0 81 million($8.0 million loan; $2.0 million grant)for the Railroad Island Housing Development and 82 Westminster Junction Business Park,to be administered by HRA. 83 84 5. Authorization to approve creating a Redevelopment Plan for the Phalen Corridor 85 Redevelopment Project Area Phase I-Railroad Island Housing together with a Tax Increment 86 Financing Plan to repay the HRA funding assistance. 87 88 6. Authorization to approve attached 2002 Budget Amendment in Attachment A to the Resolution 89
