2 BE IT RESOLVED, that, upon the petition of Grant Conklin, as documented in Real Estate Division
3 File Number 06-2004, public properties hereinafter described are hereby vacated and discontinued as
4 public property:

6 The property to be vacated is described as follows: See Attached Map & Description in Exhibit"A"

8 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
9 Saint Paul Legislative Code as amended, and to the following conditions:
10
11 1. That the petitioner's, their successors and assigns shall pay$600 as an administrative fee for this
12 vacation which is due and payable within 60 days of the effective date of this resolution.
13
14 2. That a permanent utility easement shall be retained within the vacated area to protect the interest
15 of Northern States Power Company, d.b.a. Xcel Energy.
16
17 3. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
18 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
19 brought as a result of injuries or damages received or sustained by any person, persons or
20 property on account of this vacation or petitioners' use of this property, including but not limited
21 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
22 because of any claims or liability arising from any violation of any law or regulation made in
23 accordance with the law, whether by the petitioners or any of their agents or employees.

25 4. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
26 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
27 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in
28 all respects with these terms and conditions.

Phis is a petition to vacate the portion of Groveland Avenue running from the Northerly line of
Oakridge Street to the property corners 150 feet north, abutting
BURLINGTON HEIGHTS DIV NO. 2; LOT 17; BLOCK 12
And BURLINGTON HEIGHTS DIV NO 2; LOT 1; BLOCK 16.
This street vacation is requested to correct faulty surveying done over the years that has shorted
Lots 1, 2, and 3 of Block 16 by approximately 10 feet in the front, and 15 feet in the rear. These
3 lots have been re-split into 2 larger lots, and both will be built upon eventually. We are also
petitioning to have the utility rights to the property waived by the city.
