1 WHEREAS,on July 24,2002,the Council approved CF#02-691,vacating part of the east one-half of Block 5, Stinson,Brown and
2 Ramsey's Addition,and part of Toronto and Daly Streets;and
3 WHEREAS,approximately 6,000 square feet of the property vacated thereby described as:
4 that part of Toronto street lying south of a line 65.00 feet southerly of and parallel to the north line of said Section 12,easterly of the
5 centerline of said Toronto Street,and northerly of the line described as:
6 Beginning at a point on the centerline of St.Clair Avenue in St. Paul,distant 124.99 feet easterly of the Northwest Corner
7 of Section 12,Township 28 North,Range 23 West;thence run southerly at an angle of 89 degrees 37 minutes 42 seconds
8 with said centerline(when measured from west to south)for 200 feet to the point of beginning of the line to be described;
9 thence deflect to the right at an angle of 67 degrees 08 minutes 49 seconds for 633.42 feet;thence deflect to the left on a
10 curve having a radius of 110 feet(delta angle 67 degrees 10 minutes 19 seconds)for 128.67 feet and there terminating.
11 and its northeasterly extension to the west line of A.Vance Brown's Subdivision of Block 4 and the East half of Block 13,Brown,
12 Stinson and Ramsey's Addition to St. Paul:
13 accrues to the St.Clair Playground;and
14 WHEREAS,on August 14,2002 the Saint Paul Parks and Recreation Commission approved resolution number 2-18,authorizing
15 the sale of the said part of Toronto Street to the developer of the property to the south;
16 BE IT THEREFORE RESOLVED,that the underlying fee title of the above described part of Toronto Street is hereby vacated,
17 and the proper City officials are hereby authorized and directed to dispose of the said property as provided in Chapter 51 of the
18 Administrative Code.
19 BE IT FURTHER RESOLVED,that, as provided in Paragraph 13.01.1.of the City Charter,the purchaser of that said part of
20 vacated Toronto Street shall pay full market value,as established by independent appraisal,to the Department of Parks and
Recreation,and shall reimburse the City for the cost of the said appraisal.

41 because of any claims or liability arising from any violation of any law or regulation made in
