1 BE IT RESOLVED,that, upon the petition of the United States Postal Service (USPS), as documented
2 in Real Estate Division File Number 26-2002, public properties hereinafter described are hereby vacated
3 and discontinued as public property:

5 The City right-of-way interest to be vacated is in the following described parcel:

7 An 80.5 foot wide aerial easement for skyway purposes over and above that part of Sibley Street
8 right-of-way, the centerline of which is described as follows:

10 Commencing at the northwesterly corner of Block 29, City of St. Paul, according to the recorded
11 plat thereof, Ramsey County, Minnesota; thence North 34 degrees 36 minutes 00 seconds West,
12 an assumed bearing, along the northwesterly extension of the southwesterly line of said Lot 29, a
13 distance of 7.37 feet; thence South 10 degrees 39 minutes 55 se3conds west, 49.26 feet; thence
14 South 34 degrees 36 minutes 00 seconds East 126.34 feet to the point of beginning of the
15 following described center line; thence South 55 degrees 15 minutes 57 seconds West 79.84 feet
16 to the westerly right-of-way of said Sibley Street and there terminating. Sidelines of said skyway
17 easement are prolonged or shortened to terminate at the easterly and westerly right-of-way of said
18 Sibley Street.

20 The bottom plane of the vertical space contained within said easement shall be 726.00 feet (based
21 on the NVGD 1929 data, City of St. Paul, Bench mark location northeastern corner of Second
22 Street and Jackson Street, top nut hydrant elevation is 708.20 feet) on the eastern right-of-way
23 line and 728.00 feet at the western right-of-way line of said Sibley Street; and a top plane
24 elevation of the vertical plane of said easement shall be 32.00 feet above said elevations cited for
25 the bottom plane.

27 BE IT FURTHER RESOLVED, that, subject to the herein stated exceptions and with the
28 accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily on behalf of Qwest
29 Communications, Incorporated,Northern States Power Company, d.b.i. Xcel Energy, District Energy St.
30 Paul, Incorporated, MCI Worldcom, Comcast, formerly A.T. & T. Broadband, Saint Paul Regional
31 Water Services, and The Department of Public Works, made a part hereof by this reference and filed in
32 the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these corporations and
33 departments, waives the right to the utility easements in the vacated area described above.

1 BE IT FURTHER RESOLVED, that the said vacation of City interest and release of the said
2 easements shall remain in effect as long as the skyways therein shall remain in place. Except that the
3 said skyways may be renovated or removed and replaced without reversion, upon abandonment,
4 demolition or removal of the said skyways the vacated area shall revert to City right-of-way and all
5 utility easements shall be restored.

7 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
8 Saint Paul Legislative Code as amended, and to the following conditions:

10 1. That the petitioner's, their successors and assigns shall pay $1,200.00 as an administrative fee for
11 this vacation which is due and payable within 60 days of the effective date of this resolution.

13 2. That petitioner shall comply with all requirements applicable to the USPS for skyway bridges.

15 3 That the vacated area shall be no lower than as provided by the permit for the existing skyway or
16 13. 5 feet above ground level, whichever is higher.

18 4 Subject to and in accordance with the provisions of the Federal Tort Claims Act, 28 U.S.C. 1346
19 ss (b) and ss 2671, et seq.,the USPS expressly agrees to be responsible for claims, losses,
20 damage, actions, causes of action, expense and/or liability resulting from the negligent or
21 wrongful act or omission by any employee of the USPS while acting within the scope of
22 employment under circumstances where the USPS, if a private person would be liable in
23 accordance with the laws in the State of Minnesota
24 .
25 5 That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
26 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
27 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in
28 all respects with these terms and conditions.

NOTICE OF PUBLIC HEARING
Notice is hereby given that the petition of the U. S . Postal
Service for the vacation of an aerial easement for skyway
purposes over and above Sibley Street between Second Street and
Kellogg Boulevard as more fully described on file and on record
in the office of the City Clerk of Saint Paul, Minnesota, will be
heard and considered by the Saint Paul City Council at a meeting
to be held in the Council Chambers on the 3rd floor of City Hall
and Court House on the 28th day of May, 2003 at 5 :30 P.M.

This letter is in response to your request for a formal articulation of the operational
imperatives which have necessitated the USPS's decision to construct a second skyway
connecting the dock operation with the mail processing area of our facility on Kellogg
Boulevard in downtown St. Paul. It is my understanding that you were previously briefed
in detail on this matter at a July 22, 2002 meeting in St. Paul by Edward Rynne of our
Headquarters Realty Asset Management Group. The following is provided for your
information, and as substantiation of the USPS's need for a permanent second skyway
structure to serve its customers in eastern Minnesota and western Wisconsin.
During the mid-1970's the present skyway was constructed over Sibley Street to
connect the Main Post Office and Processing & Distribution Facility (MPO and P&DC)
with the new dock ("K-Dock") facility. The structure is approximately 20 feet wide and
spans a distance of approximately 85 feet. It is used as a pedestrian crossing from the
K-Dock to the MPO and P&DC, as well as the only access for mechanical mules,
forklifts and tugs. In a one-week period approximately 8,500 containers are pulled from
the K-Dock to the MPO and P&DC and back. Currently, an estimated 98% of the mail
processed in this facility enters and exits from this dock, making the skyway an
inherently integral part of the success of the dock operation. During peak volume
periods, the skyway is a constant bottleneck of containers and mechanical equipment
queuing up to cross.
Since its construction, use of the skyway has only intensified. In addition, several recent
engineering studies commissioned by the USPS have confirmed the need for major
repairs and renovation. To prevent undue stress on the skyway, its use by tugs, forklifts
and mechanical lifts has had to be reduced to alternating one-way traffic, and to only
one tug at a time. These movement limitations severely hamper postal operations at
peak times causing delays. Because these operations must remain uninterrupted, the
repairs that are necessary at this time cannot be accomplished without a second
skyway. Quite simply, there are no other viable alternatives. The only available path
the mail could take would be via a circuitous route, and entail the use of elevators, the
crossing of three lanes of Sibley Street, while employing a mixed caravan of tugs,
forklifts, and mechanical mules transporting mail in public automobile and pedestrian
lanes over a distance of approximately 2,000 feet.

Most importantly, the additional skyway is proposed not only as an expedient which
allows for the repair of the current structure, but as the only available means to
permanently address its inadequacy with respect to current mail processing needs. The
absence of a second skyway will only perpetuate current operational conditions which,
over time, have forced inefficiencies in the handling of dispatches within the service
area, The USPS's Initial inclination, for a widening of the existing skyway either to the
south or to the north, has upon detailed study proven not to be feasible, given the
respective constraints associated with an existing expansion joint and truck clearance
requirements. Accordingly, the USPS again requests your cooperation in expediting the
formal vacation process of the air rights associated with this project.

PURPOSED SKYWAY EASEMENT (October 16, 2002)
An 80.5 foot wide Aerial Easement for Skyway Purposes over and above that part of Sibley Street right of way,
the centerline of which is described as follows:
Commencing at the northwesterly corner of Block 29, City of St. Paul, according to the recorded Plat thereof,
Ramsey County Minnesota; thence North 34 degrees 36 minutes 00 seconds West, on assumed bearing, along
the northwesterly extension of the southwesterly line of said Lot 29, a distance of 7.37 feet; thence South 10
degrees 39 minutes 55 seconds West 42.26 feet; thence South 34 degrees 36 minutes 00 seconds East 126.34
feet to the point of beginning of the following described center line; thence South 55 degrees 15 minutes 57
seconds West 79.84 feet to the westerly right of way of said Sibley Street and there terminating. Sidelines of
said Skyway Easement are prolonged or shortened to terminate at the easterly and westerly right of way of said
Sibley Street.
The bottom plane of the vertical space contained within said easement shall be 726. 00 feet (based on the
NVGD 1929 data, City of St. Paul, Bench mark location northeastern corner of Second Street and Jackson Street,
top nut hydrant elevation is 708.20 feet) en the eastern right of way line and 728.00 feet at the western right
of way line of said Sibley Street; and a top plane elevation of the vertical plane of said easement shall be 32.00
feet above said elevations cited for the bottom plane.
