1 BE IT RESOLVED, that, upon the petition of the City of Saint Paul (City), as documented in Real
2 Estate Division File Number 22-2004, the City's interest in public property hereinafter described is
3 hereby vacated and discontinued as public property:

5 The property being vacated of its City interest is described as follows:
6
7 Lots 5, 19, 20 and 21, Block 26, Rice and Irvine's Addition;
8
9 Subject to an easement for right of way purposes retained on,over,under
10 and across those parts of Lots 5, 19, 20 and 21,Block 26,Rice and
11 Irvine's Addition to St. Paul,according to the recorded plat thereof,
12 Ramsey County, Minnesota, which lie northeasterly of a line
13 drawn from a point on the southeasterly line of said Lot 21
14 distant 38.34 feet southwesterly of the most easterly corner of said
15 Lot 21 to a point on the northwesterly line of said Lot 5 distant
16 17.40 feet southwesterly of the most northerly corner of said Lot 5
17 and said line there terminating; and
18
19 Subject to a permanent encroachment and maintenance easement
20 retained on,over, under and across that part of Lot 5, Block 26,
21 Rice and Irvine's Addition lying northwesterly of a line 5.00 feet
22 southeasterly of and parallel to the northwest line of said Lot 5.

24 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
25 Saint Paul Legislative Code as amended, and to the following conditions:
26
27 1. That a permanent right-of-way easement shall be retained by the petitioner(City), on, over, under
28 and across that portion of the vacated area as described in Exhibit"A", on behalf of the City of
29 Saint Paul, Department of Public Works.

31 2. That, on behalf of the Board of Water Commissioners, a permanent utility easement.shall be
32 retained on, over, under and across that portion of the vacated with any existing water utility
33 facilities, reserving the right of the Board of Water Commissioners to maintain and operate its
34 said existing water facilities in, on or under said easement, and to enter upon said easement or
35 any portion thereof at any time, and from time to time, for the purposes of future reconstruction,

3 inspecting, maintaining or repairing the same or any part thereof. Any development or use of the
4 property within the said utility easement shall be subject to the following restrictions stated in the
5 attached Exhibit `B".

7 3. That, at the recommendation of the City of St. Paul, Department of Planning and Economic
8 Development, the property being released of its City interest should be conveyed to the Housing
9 and Redevelopment Authority of St. Paul for future development.

11 4. That the petitioner, its successors or assigns, shall by this resolution and any future conveyances
12 of this property, allow said property to be included in any new re-platting process being
13 presently worked on by the City of St. Paul.

15 5. That with any conveyance of the vacated property, the grantee, their successors and assigns,
16 agree to indemnify, defend and save harmless the City of Saint Paul, its officers and employees
17 from all suits, actions or claims of any character brought as a result of injuries or damages
18 received or sustained by any person, persons or property on account of this vacation or grantee's
19 use of this property, including but not limited to, a claim brought because of any act of omission,
20 neglect, or misconduct of said petitioners or because of any claims or liability arising from any
21 violation of any law or regulation made in accordance with the law, whether by the grantee or
22 any of their agents or employees.

24 6. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
25 resolution, file with the City of St. Paul, Department of Public Works, an acceptance in writing
26 of the conditions of this resolution and shall, within the period(s) specified in the terms and
27 conditions of this resolution, comply in all respects with these terms and conditions.

NOTICE OF PUBLIC HEARING
Notice is hereby given that the petition of the City of St. Paul to vacate and release City interest
in Lots 5, 19, 20 and 21, Block 26, Rice and Irvine's Addition, as more fully described on file
and on record in the office of the City Clerk of Saint Paul, Minnesota, will be heard and
considered by the Saint Paul City Council at a meeting to be held in the Council Chambers on the
3rd floor of City Hall and Court House on the 22nd day of September, 2004 at 5:30 P.M.
