The vacated area is described as follows: That part of the east-west alley which adjoins lots 36 through 42 and lots 15 through 21 in Block 26, Chas. Weides Subdivision of Blocks 25 and 26 Arlington Hills Addition to St. Paul. Also, all of the easement for slopes and cuts condemned for the grading and paving of said alley lying in and adjoining said vacated alley. This vacation shall be subject to the following conditions: 1. That this vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the Saint Paul Legislative Code as amended. 2. That the petitioner, its successors and assigns shall pay $500.00 as an administrative fee for this vacation within 60 days of the publication date of this resolution. 3. That a permanent utility and drainage easement shall be retained on, over, under and across the vacated area on behalf of the City of Saint Paul, Department of Public Works to reserve the right of the City to maintain and operate any sewer in or upon said easement and to enter upon said easement or any portion thereof at any time and from time to time, for the purposes of future construction, reconstruction, inspecting, maintaining or repairing the same or any part thereof and shall be subject to the following conditions: a. I don't have any request for a drawing from the City Clerk's Office, nor a copy of the adopted resolution. I found the minutes of June 1, 1994 which has the Council Resolution # 94-772 and it says no one appeared in opposition and it was unanimously approved. The petitioner was the East Side Neighborhood Development Co. (ESNDC). The issue came up because we have a meeting next Wed. with the ESNDC to discuss another development in that same block, on that same alley. Have they paid the compensation? Can I get a copy of the vacation resolution to see what they were required to do? I need to find out what's going on before I meet with them Wed. AM. Thanks for your help. Weide's Subdivision of the City of Saint Paul. Please refer to the attached survey showing the portion of the alley that we are petitioning to vacate. The purpose for the vacation is to allow for the creation of a more secure common area/play space for the children and families who will reside in new housing to be developed on the Sims and York Avenue sides of this block. The property to be vacated will become the common area linking new family leasehold co-op homes to be built to the north and south of it. Please refer to the attached preliminary site plan showing the placement of the new homes.
