RESOLVED, that upon the petition of East Side Neighborhood Development Company, Inc.,
per Finance Department File No. 2-1994, that part of the east-west alley in Block 26, Chas.
Weide's Subdivision, bounded by Edgerton St. Sims Ave. York Ave and Payne Ave, hereinafter
described, is hereby vacated and discontinued as public property.
The vacated area is described as follows:
That part of the east-west alley which adjoins lots 36 through 42 and lots 15
through 21 in Block 26, Chas. Weides Subdivision of Blocks 25 and 26 Arlington
Hills Addition to St. Paul. Also, all of the easement for slopes and cuts
condemned for the grading and paving of said alley lying in and adjoining said
vacated alley.
This vacation shall be subject to the following conditions:
1. That this vacation shall be subject to the terms and condition of Chapter 130,
codified March 1, 1981, of the Saint Paul Legislative Code as amended.
2. That the petitioner, its successors and assigns shall pay $500.00 as an
administrative fee for this vacation within 60 days of the publication date of this
resolution.
3. That a permanent utility and drainage easement shall be retained on, over, under
and across the vacated area on behalf of the City of Saint Paul, Department of
Public Works to reserve the right of the City to maintain and operate any sewer
in or upon said easement and to enter upon said easement or any portion thereof
at any time and from time to time, for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the same or any part thereof
and shall be subject to the following conditions:
a. No buildings, structures, or trees are permitted within the easement
area nor any temporary structure, material storage, fixture, or any other
objects that will prohibit normal access to utility facilities for
maintenance purposes.
b. Improvements in or upon the above described easement that do not
prohibit the City from exercising its reserved rights may be allowed by
obtaining written permission from the Department of Public Works
Sewer Division with the understanding that the restoration and costs of
such improvements shall be the sole responsibility of the petitioner, its

successors and assigns in the event the City exercises its reserved
ORIGINAL easement rights.
c. No change from-the existing grade is permitted within the easement
area without written permission from the Director of the Department
of Public Works. _ _
d. No change in surfacing within the easement area is permitted without
written permission from the Director of the Department of Public
Works.
e. That the petitioner, its successors and assigns shall indemnify, defend,
and save harmless the City of Saint Paul, its officers, agents, employees,
and servants from all suits, actions, or claims which shall arise from any
injuries or damages received or sustained by any break in any service
pipe or connection in said reserved easement arising out of or resulting
from any action or negligence of the petitioner, its employees, agents, or
business invitees.
4. That the petitioner, its successors and assigns, shall design according to the
specifications of the Department of Public Works, and then install under a Paving
Permit and at its own expense, a Storm Water Drainage System in said Block 26.
The Storm Water Drainage System shall be a public facility within the utility and
drainage easement.
5. That a permanent utility easement shall be retained within the vacated area to
to protect the interest of Northern States Power Company.
6. That a permanent utility easement shall be retained within the vacated area to
to protect the interest of U.S. West Communication, Inc.
7. That a permanent utility easement shall be retained within the vacated area to
protect the interest of Continental Cablevision of Saint Paul, Inc.
8. That the petitioner, its successors, and assigns, by acceptance of the terms and
conditions of this resolution agree to indemnify, defend and save harmless the
City of Saint Paul, its officers, and employees from all suits, actions, or claims
of any character brought as a result of injuries or damages received or
sustained by any person, persons, or property on account of this vacation or
petitioner's use of this property, including but not limited to a claim brought
because of any act of omission, neglect, or misconduct of said petitioner or
because of any claims or liability arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioner or any
of its agents or employees.

DEDICATION OF EASEMENT
FOR RIGHT-OF-WAY PURPOSES

Minnesota, Grantor, for good and valuable consideration, to them in hand paid and the
receipt of which is hereby acknowledged, does hereby grant, bargain, sell and convey to
the CITY OF ST. PAUL, a municipal corporation of the State of Minnesota, its
successors, and assigns, as Grantee, a permanent easement for public right-of-way
purposes on, over, under and across the following tract of land being in the County of
Ramsey, State of Minnesota, described as follows:
That part of the southwesterly 1/2 of Lot 13, Block 53, Rice and Irvine's
Addition to Saint Paul, according to the recorded plat thereof, Ramsey
County, Minnesota, lying easterly of a line drawn from a point on the
northeasterly line of said southwesterly 1/2 of Lot 13 distant 10.02 feet
northwesterly of the most easterly corner of said southwesterly 1/2 of Lot 13
to a point on the southwesterly line of said Lot 13 distant 0.50 feet
northeasterly of the most southerly corner of said Lot 13.
To have and to hold the same forever. The Grantor does covenant that it is well
seized in fee of the land and premises aforesaid, and has good right to sell and convey the
same free of all encumbrances.
The Grantor also covenants that the above granted easement is in the quiet and
peaceable possession of the Grantee. The Grantor will warrant and defend against all
persons lawfully claiming the whole or any part thereof, subject to encumbrances, if any,
hereinbefore mentioned. It is intended and agreed that this agreement shall be a covenant
running with the land and shall be binding to the fullest extent of the law and equity for
the benefit of the public. It is further intended and agreed that this agreement and

I'm trying to find out why a certain alley vacation was never recorded. I
don't have any request for a drawing from the City Clerk's Office, nor a
copy of the adopted resolution. I found the minutes of June 1, 1994 which
has the Council Resolution # 94-772 and it says no one appeared in
opposition and it was unanimously approved. The petitioner was the East
Side Neighborhood Development Co. (ESNDC).
The issue came up because we have a meeting next Wed. with the ESNDC to
discuss another development in that same block, on that same alley. Have
they paid the compensation? Can I get a copy of the vacation resolution to
see what they were required to do?
I need to find out what's going on before I meet with them Wed. AM. Thanks

The East Side Neighborhood Development Company does hereby petition the
Council of the City of Saint Paul to vacate the public land described below:
A portion of the east-west alley in Block 6, C. Weide's Subdivision of
the City of Saint Paul. Please refer to the attached survey showing the portion
of the alley that we are petitioning to vacate.
The purpose for the vacation is to allow for the creation of a more
secure common area/play space for the children and families who will reside
in new housing to be developed on the Sims and York Avenue sides of this
block. The property to be vacated will become the common area linking new
family leasehold co-op homes to be built to the north and south of it. Please
refer to the attached preliminary site plan showing the placement of the new
homes.

Vacation of Part of East/West Alley in Block 26, C. Weide's Subdivision
bounded by Sims, York, Payne, Edgerton.
The proposed vacated alley receives storm water drainage from a relatively large
area of property from the east which includes commercial properties that front on
Payne Avenue and adjacent north/south public alley. The Sewer Division has
reviewed the petitioner's Grading And Drainage Plan dated 3-22-94. The alley
vacation will need to be subject to the following conditions:

The East Side Neighborhood Development Company does hereby petition the
Council of the City of Saint Paul to vacate the public land described below:
A portion of the east-west alley in Block 6, C. Weide's Subdivision of
the City of Saint Paul. Please refer to the attached survey showing the portion
:.t alley that we are petitioning to vacate.
The purpose for the vacation is to allow for the creation of a more
secure common area/play space for the children and families who will reside
in new housing to be developed on the Sims and York Avenue sides of this
block. The property to be vacated will become the common area linking new
family leasehold co-op homes to be built to the north and south of it. Please
refer to the attached preliminary site plan showing the placement of the new
homes.

The East Side Neighborhood Development Company does hereby petition the
Council of the City of Saint Paul to vacate the public land described below:
A portion of the east-west alley in Block 6, C. Weide's Subdivision of
the City of Saint Paul. Please refer to the attached survey showing the portion
of the alley that we are petitioning to vacate.
The purpose for the vacation is to allow for the creation of a more
secure common area/play space for the children and families who will reside
in new housing to be developed on the Sims and York Avenue sides of this
block. The property to be vacated will become the common area linking new
family leasehold co-op homes to be built to the north and south of it. Please
refer to the attached preliminary site plan showing the placement of the new
homes.
