1 BE IT RESOLVED, that, upon the petition of 175 Fort, LLC, as documented in the Technology
2 Department File Number 02-2002, public properties hereinafter described are hereby vacated and
3 discontinued as public property: and, subject to the herein stated exceptions.

6 The propeity to be vacated is described as follows:
7 That part of West Seventh Street as platted and dedicated in Fort Road Addition,
8 according to the recorded plat thereof, Ramsey County, Minnesota, described as
9 beginning at the most easterly corner of Lot 2, Block 1, said Fort Road Addition;
10 thence South 11 degrees 16 minutes 30 seconds East, the northeasterly line of said
11 Lot 2 has an assumed bearing of South 56 degrees 16 minutes 30 seconds East, a
12 distance of 10.69 feet; thence South 28 degrees 27 minutes 27 seconds West, a
13 distance of 195.90 feet to the southeasterly extension of the southwesterly line of
14 said Lot 2; thence North 51 degrees 27 minutes 45 seconds West, a distance of
15 11.34 feet, to the most southerly corner of said Lot 2; thence northwesterly along
16 the southeasterly line of said Lot 2 a distance of 202.35 feet to the point of
17 beginning.

20 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
21 Saint Paul Legislative Code as amended, and to the following conditions:

26 2. That the petitioner will dedicate to the City of Saint Paul Department of Public Works an
27 easement for street purposes legally described as follows:

29 An easement over and across that part of the southwesterly l of Lot 13, Block 53, Rice
30 and Irvine's Addition to Saint Paul, according to the recorded plat thereof, Ramsey
31 County, Minnesota, lying easterly of a line drawn from a point on the northeasterly line of
said southwesterly 1/2 of Lot 13 distant 10.02 feet northwesterly of the most easterly
corner of said southwesterly 1/2 of Lot 13 to a point on the southwesterly line of said Lot
13 distant 0.50 feet northeasterly of the most southerly corner of said Lot 13.

1 3. That this vacation shall be for the life of the existing improvements within the encroachment
2 (All of which are herein after refered to as the "Improvements") and/or the repair or
3 reconstruction of the foregoing Improvements. At such time as the Improvements no longer
4 encroach upon the vacated property, the vacated property shall revert back to the City as public
5 right-of-way.

7 4. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
8 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
9 brought as a result of injuries or damages received or sustained by any person, persons or
10 property on account of this vacation or petitioners' use of this property, including but not limited
11 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
12 because of any claims or liability arising from any violation of any law or regulation made in
13 accordance with the law, whether by the petitioners or any of their agents or employees.

15 5. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
16 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
17 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in
18 all respects with these terms and conditions.
