1 BE IT RESOLVED, that, upon the petition of the James T. Sorensen, as documented in Technology
2 Department File Number 1997-25, the public property hereinafter described is hereby vacated and
3 discontinued as public property and, subject to the herein stated exceptions.

5 The property to be vacated is described as follows: See Attached Exhibit "A"

7 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of
8 the Saint Paul Legislative Code as amended, and to the following conditions:

10 1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
11 for this vacation which is due and payable within 60 days of the effective date of this
12 resolution.

14 2. That an easement shall be retained for Northern States Power Company, Electric, over, under
15 and across said vacated area for the purpose of protecting its distribution facilities.

17 3. That an easement shall be retained for US West Commuications over, under and accross a
18 16 foot wide strip from the Southwesterly corner of Lots 6,7 and 8, Block 3, Lexington Park
19 Place Plat 11 to the Northeasterly corner of said Lots, for the purpose of servicing their
20 facilities.

22 4. That the petitioner's their successors, and assigns agree to indemnify, defend and save
23 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of
24 any character brought as a result of injuries or damages received or sustained by any person,
25 persons, or property on account of this vacation or petitioner's use of this property, including
26 but not limited to a claim brought because of any act of omission, neglect, or misconduct of
27 said petitioner or because of any claims or liability arising from any violation of any law or
28 regulation made in accordance with the law, whether by the petitioner or any of their agents or
29 employees.
