4 easements within those public properties are hereby released.

10 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
11 Saint Paul Legislative Code as amended, and to the following conditions:

13 1. That the petitioners, their successors and assigns shall pay $500.00 as an administrative fee for this
14 vacation which is due and payable within 60 days of the effective date of this resolution.

16 2. That a permanent utility easement shall be retained within the easterly 10 feet of the vacated area to
17 protect the interest of Xcel Energy.

19 3. That a permanent utility easement shall be retained within the vacated area to protect the interest of
20 Qwest Communications.

22 4. That a permanent utility easement shall be retained within the vacated area to protect the interest of
23 A T & T Broadband.

25 5. That a permanent and full width drainage and utility easement shall be retained on, over, under and
26 across the entire vacated area on behalf of the City of Saint Paul, Department of Public Works to
27 reserve the right of the City to maintain and operate any sewer in or upon said easement and to enter C-Iv
28 upon said easement or any portion thereof at any time and from time to time, for the purposes of
29 future construction, reconstruction, inspecting, maintaining or repairing the same or any part thereof.
30 Said utility easement shall be subject to the following conditions:

32 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
33 other objects that will prohibit normal access to utility facilities for maintenance purposes '
34 will be permitted within the easement area.

36 b. Improvements in or upon the above described easement that do not prohibit the City from
37 exercising its reserved rights may be allowed byobtaining written permission from the
38 Department of Public Works Sewer Division with the understanding that the restoration and
39 costs of such improvements shall be the sole responsibility of the petitioner, its successors
40 and assigns in the event the City exercises its reserved easement rights.

2 c. No change from the existing grade within the easement area will be permitted without
3 written permission from the Department of Public Works.

5 d. No change in surfacing within the easement area will be permitted without written
6 permission from the Department of Public Works.

8 e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless the City
9 of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or claims
10 which shall arise from any injuries or damages received or sustained by any break in any
11 service pipe or connection in said reserved easement arising out of or resulting from any
12 action or negligence of the petitioner, its employees, agents, or business invitees.

14 6. That regrading of this area and subsequent improvements shall be in conformance with a site plan,
15 reviewed and approved by the Department of Public Works within the City site plan review process.

17 7. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless the
18 City of Saint Paul, its officers and employees from all suits, actions or claims of any character
19 brought as a result of injuries or damages received or sustained by any person, persons or property
20 on account of this vacation or petitioners' use of this property, including but not limited to, a claim
21 brought because of any act of omission, neglect, or misconduct of said petitioners or because of any
22 claims or liability arising from any violation of any law or regulation made in accordance with the
23 law, whether by the petitioners or any of their agents or employees.

25 8. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
26 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and
27 shall, within the period(s) specified in the terms and conditions of this resolution, comply in all
28 respects with these terms and conditions.

11 BE IT FURTHER RESOLVED, that, subject to the herein stated exceptions and with the
12 accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily on behalf of Qwest
13 Communications, Incorporated,Northern States Power Company, d.b.a. Xcel Energy, District Energy St.
14 Paul, Incorporated, MCI Worldcom, A.T. & T. Broadband, Saint Paul Regional Water Services, and the
15 Department of Public Works, made a part hereof by this reference and filed in the office of the City
16 Clerk of Saint Paul, the City, for itself and on behalf of these corporations and departments, waives the
17 right to the utility easements in the vacated area described above.

18 2. That the erection of a fence on the vacated property shall not interfere with Excel
19 Energy's access rights to its facilities. The petitioner shall be responsible for fence
20 maintenance within Excel's easements.

22 3. That, on behalf of the Board of Water Commissioners of the City of Saint Paul, a
23 permanent utility easement shall be retained on, over, under and across the vacated area to
24 reserve the right of the Board to maintain and operate any water facility in, on or upon
25 said easement, and to enter upon said easement or any portion thereof at any time, and
26 from time to time for the purposes of future construction, reconstruction, inspection,
27 maintenance or repair of the same or any part thereof The said utility easement shall be
28 subject to the following restrictions:

31 fixture, or other object that may prohibit normal access to water facilities for
32 maintenance purposes will be permitted within the easement area.

34 b. With written permission from the Saint Paul Regional Water Services,

36 limit the full and free exercise by the Saint Paul Regional Water Services of its
37 reserved rights may be allowed, with the understanding that the restoration and
38 costs of such improvements, should the Water Services exercise its easement
39 rights, shall be the sole responsibility of the fee owner, its successors and assigns.
• 1 c. Should it be necessary that the petitioner's works or improvements be removed, or
2 should the said works or improvements be damaged as a result of the Saint Paul 001- '1S
3 Regional Water Services' operations, all removal, replacement or modification
4 costs shall be borne solely by the petitioner.

1 BE IT RESOLVED, that, upon the petition of th?City of Saint Paul, as documented in Real Estate
2 Division File Number 05-2000, public properties hereinafter described are hereby vacated and
3 discontinued as public property: and, subject to the herein stated exceptions, the easements within those
4" public properties are hereby released.

6 The property to be vacated is described as follows: See the Attached Description & Map

8 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
10 Saint Paul Legislative Code as amended, and to the following conditions:
11 That a permanent drainage easement shall be retained on, over, under and across the vacated
12 area on behalf of the City of Saint Paul, Department of Public Works to reserve the right of the
13 City to maintain and operate any sewer in or upon said easement and to enter upon said easement
14 or any portion thereof at any time and from time to time, for the purposes of future construction,
15 reconstruction, inspecting, maintaining or repairing the same or any part thereof. Any
16 development or use of the property shall be subject to the following conditions:
18 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
19 other objects that will prohibit normal access to utility facilities for maintenance purposes
20 will be permitted within the easement area.

22 b. Improvements in or upon the above described easement that do not prohibit the City from
23 exercising its reserved rights may be allowed by obtaining written permission from the,
24 Department of Public Works Sewer Division with the understanding that the restoration
25 and costs of such improvements shall be the sole responsibility of the petitioner, its
26 27 successors and assigns in the event the City exercises its reserved easement rights.
28 c. No change from the existing grade within the easement area will be permitted without
299 written permission from the Department of Public Works.
31 d. No change in surfacing within the easement area will be permitted without written
32 permission from the Department of Public Works.

34 That a permanent utility easement shall be retained within the vacated area to protect the interest
35 of Xcel Energy Company . "

37 That a permanent utility easement shall be retained within the vacated area to protect the interest
38 of AT&T Broadband.

40 That the site plan for any proposed development of the vacated area will be approved by the
41 License, Inspection, Environmental Protection Office (LIEP) before any construction occurs.

2 That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
3 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
4 brought as a result of injuries or damages received or sustained by any person, persons or
5 property on account of this vacation or sustained due to drainage within the vacated area or the
6 petitioners' use of this property, including but not limited to, a claim brought because of any act
7 of omission, neglect, or misconduct of said petitioners or because of any claims or liability
8 arising from any violation of any law or regulation made in accordance with the law, whether by
9 the petitioners or any of their agents or employees.

12 That the petitioners, their successors and assigns shall, within 60 days of the effective date of ..

This is a note to the file pertaining to the vacation of City right of way in connection with
the construction Minnesota Mutual Building on the block bounded by Minnesota, Sixth,
Seventh Place and Robert .
In attendance were representatives for the vacation petitioners, the Saint Paul
Port Authority, Minnesota Mutual and their project consultants.
In attendance for the City of Saint Paul was City Engineer, Ton Kuhfeld, Map & Permits
Technician Linda Dickhut and Real Estate Technician Juan Ortiz.
It was requested by the City that the petitioner re-plat the block and dedicate the proper
right of way needed in the new plat.
The petitioner said that this was not agreed on previously and asserted that the existing
plat remain in place and they would convey any right of way easements necessary from
the existing plat.
The City hesitantly agreed. Since it didn't detriment the City or the petition, the City
could not demand the petitioner to re-plat the property.

1 BE IT RESOLVED, that upon the petition o?Dennis Guptil, as documented in Technology Department
.2 File Number 12-00, public properties hereinafter described are hereby vacated and discontinued as

5 The property to be vacated is described as follows:

8 A portion of East Fifth Street lying between the east line of Clarence Street and the northerly
9 extension of the east line of Lot 9 Hamer's Subdivision.

12 This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the
13 Saint Paul Legislative Code as amended, and to the following conditions:
14
15 1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
16 this vacation which is due and payable within 60 days of the effective date of this resolution.
17
18 2. That a 30 foot wide permanent utility easement centered on a line 30 feet north of the south line
19 of Fifth Street, shall be retained on, over, under and across the vacated portion of Fifth Street on
20 behalf of the City of Saint Paul Department of Public Works to reserve the right of the City to
21 maintain and operate any sewer in or upon said easement and to enter upon said easement from
22 time to time, for the purposes of future construction, reconstruction, inspecting, maintaining or
23 repairing the same or any part thereof and shall be subject to the following conditions:
24
25 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
26 other objects that will prohibit normal access to utility facilities for maintenance purposes
27 will be permitted within the easement area.

29 b. Improvements in or upon the above described easement that do not prohibit the City from
30 exercising its reserved rights may be allowed by obtaining written permission from the
31 Department of Public Works Sewer Division with the understanding that the restoration
32 and costs of such improvements shall be the sole responsibility of the petitioner, its
33 successors and assigns in the event the City exercises its reserved easement rights.
34 c. No change from the existing grade within the easement area will be permitted without
35 written permission from the Director of the Department of Public Works.

37 d. No change in surfacing within the easement area will be permitted without written
38 permission from the Director of the Department of Public Works.

e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless the 00.7`q
2 City of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or
3 claims which shall arise from any injuries or damages received or sustained by any break
4 in any service pipe or connection in said rreserved easement arising out of or resulting
5 from any action or negligence of the petitioner, its employees, agents, or business
6 invitees.

-8 3. That the petitioner shall pay all costs and expenses for the reconstruction of the intersection of
9 Fifth and Clarence Street to the satisfaction of the Department of Public Works under an
10 ordinance permit, including but not limited to, the construction of new curbs, sidewalks,
11 boulevards, drainage structures and signage, to remove all appearances of public right-of-way.

13 4. That the petitioner shall be responsible for the construction, maintenance and ongoing liability of
14 their private drive in that part of Fifth Street lying east of Clarence Street and west of the portion
15 • of Fifth Street being vacated. This includes but is not limited to pavement, curb, gutter, sewer
16 construction, repair and reconstruction, snow plowing, sanding, sign installation and
17 maintenance, all to the satisfaction of the Department of Public Works.

19 5. That the petitioner shall be responsible for all costs and expenses for any work in the piblic right-
20 of-way required due to their development; all such work to be accomplished to the satisfaction of
21 the Department of Public Works under an ordinance permit.

23 6. That the private drive in the vacated portion of Fifth Street shall be designated as Fifth Street to
24 allow for continuity in house numbering and appropriate addresses shall be officially assigned by
25 the Department of Public Works.

27 7. That a permanent utility easement shall be retainedwithin the vacated area to protect the interest
28 of U.S. West Communications, Inc.
29
30 8. That a permanent utility easement shall be retained within the vacated area to protect the interest
31 of Northern States PowerElectric.

33 9. That the petitioner, their successors and assigns agree to idemnify, defend and save harmless the
34 City of Saint Paul, its officers, and employees from all suits, actions, or claims of any character
35 brought as a result of injuries or damages received or sustained by any person, persons, or
36 property on account of this vacation or petitioner's use of this property, including but not limited
37 to a claim brought because of any act of omission, neglect, or misconduct of said petitioner or
38 because of any claims or liability arising from any violation of any law or regulation made in
39 accordance with the law, whether by the petitioner or any of their agents or employees.
