SUBJECT: Petition of Vernon P. Michel and others for the vacation
of the alleys in Block 39, the West St. Paul Real Estate
and Improvement Syndicate Addition No. 2
Hearing - November 29, 1961
The alleys involved in this petition are located in the block bounded
by Stickney, Wyoming, Concord, and Annapolis Streets. As is common
in the area abutting Concord Street, the block is primarily sidehill
in character, and the development to date consists of eleven houses,
all but one of which have direct access from adjoining streets.
There are great differences in the elevations of these dwellings and
the improvement of the alleys would pose very serious grading and
slope problems. Because of the nature of the terrain the present
use of private driveways seems a more satisfactory access than the
alleys could provide. Inasmuch as all of the adjoining owners have
ff
signed the petition, I recommend that it be granted, subject to the i
following terms and conditions:
1. that the vacation be subject to all the terms and
conditions of Ordinance No. 3394, approved March
16, 1915, as amended, regulating the procedure and
prescribing conditions for the vacation of public
ground, streets, alleys and highways in the City
of St. Paul;
2. that the petitioners pay to the City the sum o $725
as compensation for the vacation and provide the i y
with a bond in the amount of $1,000.

The undersigned owners of properties located in block No. 39 of the
West St. Paul Real Estate and Improvement Syndicate Addition No. 2 do
hereby petition the city council of the City of St. Paul to vacate both
the East-West and the North-South alleys in the afore mentioned block.
WHEREAS: The alleys are unimproved and when improved would render no
service to property owners whos^properties abutt the afore mentioned
alleys.
WHEREAS: Garages on the properties are currently served by private
driveways and improving would only be of added expense to the city
and property owners.
WHEREAS: At least one property owner owns lots on both sides of the
alley and the alley which if improved would decrease its value.
WHERFAS: East Wyoming Street is unimproved and which if improved would
serve no purpose because of the hill it would create when adjoining
Concord Street and the fact that East Wyoming Street is a dead end
street three blocks west of Stickney Street.
WHEREAS: The undersigned petitioners would like to purchase the property
which would be freed by vacation of the alleys and improve it.
THEREFORE: The undersigned do hereby this day petition the City Council,
City of St. Paul, County of Ramsey, State of Minnesota, to vacate both
East-West and North-South alleys in Block No. 39, of the West St. Paul
Real Estate and Improvement Syndicate Addition No. 2, bounded on the
South by East Annapolis Street, on the North by East Wyoming Street,
on the West by Stickney Street, and on the East by Concord Street.

Dear Mr. Michel:
The matter of your petition was assigned to me in the latter
part of October, 1964. You may recall our past conversation con-
cerning this petition wherein I raised the question of the invalid-
ity of any present attempt to give effect to the original vacation
proceedings . I regret not having written to you sooner, but did
want the opportunity to review this file once more .
I note that the original petition was submitted to the City
Clerk on or about October 11 , 1961. The petition was approved as
to form by the Corporation Counsel on or about October 18. There
was a hearing on November 29, subsequently a resolution, C. F.
205244 was published on December 23, 1961 , providing for the vaca-
tion of the alleys in Block 39. Such vacation was pursuant to the
terms of Ordinance No. 3394 as amended, codified as Chapter 228 of •
the St. Paul Legislative Code , which in Section 228 . 04 (e) specif-
ically provides that within 30 days after the publication of any
vacation resolution the petitioner must file an acceptance of the
conditions of the resolution in writing with the City Clerk. In
this instance , the resolution set forth the conditions that a bond
in the amount of $ 1,000. 00 be filed with the City Clerk and that
the sum of $ 725 . 00 together with the costs of the vacations pro-
ceedings be paid to the 'City. These conditions were not complied
with.

Vacation proceedings were instituted for an alley
between Wyoming Street and Annapolis Street with entrance
to said alley from Stickney Street in St. Paul.
Mr. and Mrs. Charles Janecek were instrumental
in following this matter through after several delays were
met with.
Finally we received information from Mr. Forest
Crowley that this had been presented to your office for
dispostion. Is it possible now to have this matter taken
into consideration?
The passage of time causes more minor obstacles
being placed in our path, and the people involved in this
vacation would appreciate your kind attention.

C. F. 205244, approved December 20, 961,
provided for the vacation of the alleys in Block 39, The West
St.Paul Real Estate and Improvement Syndicate Addition No. 2.
The petitioners were supposed to have filed an acceptance of
the terms of the vacation within thirty days after the pas-
sage of said council file but failed to file the acceptance.
Recently Mrs. Ruth Janecek and Vernon Michel,
two of the petitioners, revived the matter through consulta-
tions with Mr. Dehn and Mr. Sheehan. Apparently it was agreed
that the matter would be re-opened by extending the time for
compliance if signatures were obtained for properties which
had changed hands since the original petition was filed.
Mrs. Janecek has now submitted the attached
additional signatures, and since there has been some delay due
to the illness of Mr. Dehn and the death of Mr. Sheahan, has
requested that the matter be processed at the earliest pos-
sible date in order that some of the grading and sodding re-
quired may be accomplished this fall.
Also attached is the complete City Clerk
file on this matter, with the request that you take such steps
as are required to reinstate this matter. The terms and con-
ditions of the vacation are the same as those noted in the re-
port of Mr. Dehn to the Council at the time of the original
petition.
