Subject: Petition of John W. Beck and Patricia D. Beck for the vacation
of Wakefield Avenue lying between Hazelwood and Barclay Avenues,
described as Block 12, Auditor's Subdivision No. 62, St. Paul,
Minn.
Hearing - April 19, 1972
The petition seeks the vacation of Wakefield Avenue lying south of the south
line of Old Hudson Road and east of the east line of the Minnesota Highway
Department Right-of-Way for I-94 as shown shaded red on the attached plan.
The street measures 60 feet wide by approximately 300 feet in length amount-
ing to 18,832 square feet. The petition states that the street is unimproved
and the vacation of the street will enable the petitioners to develop the
area with three additional double bungalow building sites.
The staff of the Saint Paul Planning Board has reviewed this matter and notes
that it is presently in the process of revising the Planning Board's Thorough-
fare Plan for the City. This study will deal with the proposed interchange
of I-94 and Trunk Highway 61 and may suggest a plan which differs from that of
the Minnesota Highway Department. There is a possibility that this study may
suggest the use of Wakefield Avenue right-of-way. These plans are not very
well defined at this time and if adopted, would take effect in the distant
future.
The State of Minnesota, Department of Highways, has no objection to the vacation
of that portion of Wakefield Avenue. Their proposed plans indicate that there
is work to be performed in the area as indicated on the attached plan and will
be required until work is completed.
The Department of Public Works reports that the easterly limits of the proposed
vacation be amended to include only that part of Wakefield lying westerly of a
line 97 feet west of the easterly line of Lot 1, Block 22, Auditor's Subdivision
No. 62, St. Paul, Minn. A slope easement 15 feet wide must also be retained in
the easterly and northerly portion of the proposed vacation area along Old Hudson
Road. This will provide additional R/W and slopes for the Hazelwood Street and
Old Hudson Road intersection.
The Department of Public Works staff, therefore, recommends that the proposed
vacation be approved, subject to the above named limits and slope easement.

There were no objections to the proposed vacation from other City or public
utility agencies concerned.
It should be pointed out that there is a possible need for portions of this
area for use in connection with the I-94 Right-Of-Way as stated in the report
of the Planning staff. This is an apparent long range need.
In view of the foregoing reports, I recommend that the vacation be granted
subject to the following terms and conditions:
1. That the description read as follows:
Vacate that part of Wakefield Avenue which lies easterly of a line
drawn from a point on the north line of Lot 2, Block 22, Auditor's
Subdivision No. 62, St. Paul Minn. acc., distant 135 feet west of
the northeast corner thereof to a point on the south line of Block
12, Auditor's Subdivision No. 62, St. Paul Minn., distant 35 feet
east of the southwest corner thereof, and westerly of a line
described as follows:
Beginning at the southeast corner of Block 12, Auditor's Sub-
division No. 62, St. Paul Minn.; thence in a southeast direction

The hearing for the proposed vacation is scheduled for April 19, 1972.
Wakefield Ave. is unimproved and is 60 feet wide and approximately 360

The easterly limits of the proposed vacation should be amended to include

WE, the owners of approximately 90 percent of the land bordering Wakefield Avenue,
an unimproved street between Hazelwood and Barclay Avenues, and with the legal
description of Block 12, Auditor's Subdivision No. 62, except all that part of the
following described tract: Block 12, Auditor's Subdivision No. 62 which lies Westerly
of a line run parallel with and distant 35 feet Easterly of the West line of the above
described tract AND Lot 2, Block 22, auditor's Subdivision No. 62 acc. except that
part which lies SW'ly of the following described lines: Beginning at a point on the E.
line of the above described lot, distant 60 feet S. of the NE corner thereof; thence
run NW'ly to a point on the N. line of the above described lot, distant 135 feet W.of
the NE corner thereof and ther terminating. Subject to the rights of the State of
Minnesota arising under acquisition of that part of Lot 2 which is excepted from this

Since we are now building double bungalows, we think it would be to the City's interest
to have this street vacated. ( See attached map). The vacation of this street will
enable us to build three more homes, thus adding much needed revenues to the City's
coffers.
The land is now very unsightly. The childred, and some grownups, use it for a dump
and create fire hazards in the summer. We would like to landscape it and we are not
unmindful of ecology. The landscaping would do much to beautify the neighborhood.

St. Paul at 10:00 a.m. on April 19, 1972 on the petition of John
W. and Patricia D. Beck for the vacation of Wakefield Avenue, an
unimproved street, between Hazelwood and Barclay Avenues. The
property is described as follows: Block 12, Auditor's Subdivision
No. 62.
For further information, contact the Valuation Bureau of the Finance

To comply with the City Charter, the Department of Finance is charged
with informing you of this public hearing.

vacation of the portion of Wakefield Ave.
described in the resolution.
The ordinance pertaining to vacations requires
that the compensation specified in the resolution
must be paid, and a surety bond in the amount
specified must be filed within thirty (30) days
after publication of the resolution.
We call your special attention to Paragraphs 2
and 3 of the resolution pertaining to certain
easements being reserved to the City of Saint
Paul and to the State Department of Highways
as described therein.
