WHEREAS, the council of the City of Saint Paul by Council
Resolution C.F. 273136, adopted by the City Council on June 7, 1979
and approved by the Mayor on June 8, 1979, did vacate, subject to
express conditions and reservations those sections of public street
and public property described as follows:
That part of Seminary Avenue lying -E: st of the East
line of Chatsworth and West of West line of Milton
as opened, also North 40 feet of Lots 24, 25, 26,
27, 28, and 29, Block 13, Winter's Addition to St. Paul,
the North 40 feet of Lot 39 except the east 39.6 feet
thereof, and that part of Lot 23, lying northeasterly
of a line commencing on the East line of Lot 23, at a
point 40 feet south of the Northeast corner thereof,
and running thence to the Northwest corner of Block 12
Winter's Addition
and
WHEREAS, Chapter 228 .08 of the Saint Paul Legislative Code,
entitled "Rescission of Resolutions--Failure to Comply with Condi-
tions", provides that in the event the petitioner fails to comply
with the conditions of the vacation, within the time period as
prescribed in the vacation resolution, the city Council, by resolu-
tion shall rescind its previous resolution vacating the public
street; and
WHEREAS, the City Council has been advised by the City Clerk
that petitioner Minnehaha Bowling Center, Inc. has failed to comply
with the conditions set forth in said Council Resolution C.F. 273136.

NOW THEREFORE, BE IT RESOLVED, that the council of the City
of Saint Paul, by this resolution, rescinds and deems null and void
Council Resolution C. F. 273136, adopted by the City Council on
June 7, 1979 and approved by the Mayor on June 8, 1979.
