In this connection we queried the Cor- poration Counsel as to his recommendation of the amount of bond to be required. We have recently been advised by Richard Battis that a suit has been commenced to enjoin the Council from granting the vacation and that no recommen- dation will be forthcoming until the suit is resolved. The Planning staff has reviewed this matter and it is our understanding that the following utilities are involved: 1. The Water Department wishes to retain an easement for a 12" main located aporoximstely 31 feet east of the west pro- perty line of Pillsbury. 2. Northern States Power reports power line in R.O.W., a 4" low pressure gas mein located 26 feet west of the east property line of Pillsbury, and a 1-1/2 inch gas service off this line to serve 2231 University Avenue. It should be pointed out also that the Planning board is preparing a study and plan for the Midway Area which study was initiated at the request of the Midway Civic Club. The areas of concern are traffic circulation, off- street parking, baling and unloading. The study will not be completed until early in 1965. Our Electric Engineering Department reports that we have a pole line with attached overhead wires in the area to be vacated. Attached is a sketch showing in red the vacated area with the pole locations and the attached wires marked thereon. Our Gas Engineering Department reports that we have a 4" low pressure gas main located 26' west of the east property line of Pillsbury Street and a lk" gas service off this main to serve 2201 University Avenue located 44' north of the north property line of University within the boundaries of the proposed location. Nilva and Bertram Getsug, as Co-Executors of the Estate of Herman Paster, deceased, the owner of all of the land lying easterly and westerly of that part of Pillsbury Street, a public street in the City of Saint Paul, situate between Charles Avenue and University Avenue, also public streets in said City, hereby petition your Honorable Body to vacate and discontinue as a public street the following described portion of said Pillsbury Street, to-wit: All that part of Pillsbury Street lying between the southerly boundary of Charles Avenue on the north and northerly boundary of University Avenue on the south, for the following reasons: 1. On August 14, 1962, your Honorable Body, Council File Number 209091, vacated that portion of Pillsbury Street lying immediately north of that portion of Pillsbury Street hereinabove described, which is the subject matter of this Petition.
