RESOLVED, that upon the petition of The House of Hope
Presbyterian Church of St. Paul, Minnesota, per Fina'ce
Department File No. 8-1992, that part of Portland . enue lying
between Avon Street and Grotto Street, hereinafte► described, is
hereby vacated and discontinued as public proper y.
The vacated area is described as follows.
All that part of Portland Aven• = . ying easterly
of Avon Street and westerly • . e arc of a 90-foot
diameter circle, the radius o hich is located 12
feet north of the centerli e' ' f said Portland Avenue
and 39.8 feet east of a s:• erly extended line
located 16 feet east of a : parallel to the
east line of Lot 26, Bloc 13 , Palace Addition to
St. Paul. '
This vacation shall be subj =ct to the following conditions:
1. That this vacation shall be subject to the terms
and conditions of Chapter 130, codified March 1,
1981, of theraint Paul Legislative Code as
amended.
2 . That the vtitioner, its successors, and assigns
shall pa $29,717 as compensation for this
vacatiwyi which shall be paid within 60 days of the
publica ' ion date of this resolution.
3 . . _t ' e petitioner, its successors, and assigns
sha grant the City an easement, by recordable
dee. , for right-of-way purposes, on, over, and
ac•oss that part of Lots 27, 28, and 29, Block 3,
P. ace Addition to St. Paul, which lies southerly
• the arc of a 90-foot diameter circle, the
adius of which is located 12 feet north of the
centerline of said Portland Avenue and 39.8 feet
easterly of a line located 16 feet easterly of
and parallel to the east line of Lot 26, Block 3,
Palace Addition to St. Paul.
4. That the petitioner, its successors, and assigns
shall pay all costs for the construction of a 90-
foot diameter cul-de-sac, the center of which
shall be located at the point described in

condition 3 . listed above, including but not
limited to, all costs for new curbing, sidewalks,
boulevards, drainage structures, and signage to
remove all appearances of public right-of-way,
subject to the approval of the Department of
Public Works. /5. That the petitioner, its successors, and assigns
shall pay all costs for the reconstruction Of
the street intersection at the westerly end of
Portland at Avon Street, including but not
limited to, all costs for construction/Of new
sidewalks, curbing, boulevards, drainage
structures, and signage to removal all
appearance of public right-of-way, ,6ubject
to the approval of the Department of Public
Works.
6. That the petitioner, its successors, and
assigns shall make application for and receive
approval from the Department of Public Works
for the construction and/or reconstruction of
all projects as described above. Construction
of all projects shall be completed during the
1993 construction season or before.
7. That the petitioner, its successors, and assigns
shall pay all costs, including but not limited to,
all costs for the removal and reinstallation of
street lights, conduit, wiring, pull boxes and
any other City }Utility equipment which may be
affected by this vacation.

8. That a permayent Water Utility Easement be
retained on,, over, under, and across the
south 30 feet of the north 37 feet of the
vacated lea on behalf of the City of Saint
Paul, BoArd of Water Commissioners and shall
be sub ' ct to the following conditions:
a. o buildings, structures, or trees are
%permitted within the easement area, nor
/ any temporary structure, material
storage, fixture or other objects that
will prohibit normal access to water
facilities for maintenance purposes.
b. No change from the existing grade is
permitted without written permission
from the Water Utility.
c. No change in surfacing within the easement
area is permitted without written permission
from the Water Utility.

d. That the petitioner, its successors, and
assigns shall fully indemnify, defend, and
save harmless the Board of Water
Commissioners, its officers, agents,
employees, and servants from all suits,
actions, or claims which shall arise from
any injuries or damages received or sustaine• ,/
by any break in any service pipe, water mai- ,
or connection in said reserved easement,
arising out of or resulting from any
action or negligence of the petitioner
its employees, agents or business inv:tees.

9. That a permanent 30-foot Sewer :sement be
retained on, over, under, and - ross the vacated

by acceptance of the terms and conditions of this
resolution, hereby agree to indemnify, defend,
and save harmless the City of Saint Paul, its
officers, and emplopyees against all suits,
actions, or claims of any character brought as
a result of injuries or damages received or
sustained by any person, persons, or property
on account of this vacation or petitioner's
use of this property including but not limited
to a claim brought because of any act of

omission, neglect, or misconduct of said
petitioner or because of any claims or
liability arising from any violation of
any law or regulation made in accordance
with the law whether by the petitioner or
any of its agents or employees.
14 . That the petitioner, its successors, and assigns
shall within 60 days of the publication date of
this resolution, file with the City Clerk, an
acceptance in writing of the conditions of this
resolution and shall within the period(s)
specified in the terms and conditions ,of this
resolution, comply in all respects with these
terms and conditions.

The House of Hope Presbyterian Church located at 797 Summit Avenue has
petitioned for the vacation of part of Portland Avenue between Grotto and Avon
Streets. The Petitioner owns the property on both sides of the subject
Portland Avenue and has petitioned for this vacation to provide a traffic free
area for children attending Church School and Pre School and also use of the
church playground on the north side of Portland Avenue. The Department of
Fire and Safety Services and Neighborhood District 8 have recommended denial
of this vacation, the reasons for which are stated in letters by the
respective agencies and are attached hereto.

Provides the petitioner with one contiguous parcel and an area free from
vehicular traffic.

Dear Mr . McCann:
This is in regards to the Community Issues Meeting sponsored by the
Summit University Planning Council on Wednesday, July 15 , 1992
concerning the House of Hope Church' s proposal to vacate a portion
of Portland Avenue.
Thirty six area residents attended this meeting . The Church was
represented by Alan James . The Church' s major concerns were
children' s safety and expanding the green space in the area.
Among the residents ' concerns were that the green space would
become an attractive nuisance, similar to the problems the
neighborhood is currently experiencing with area parking lots , that
the Church is attempting to take over parts of the neighborhood for
the benefit of churchgoers who live outside the area, and that the
Church could easily turn the green space into more parking in the
future without input from area residents .
A motion to recommend to the City to deny the vacation request was
passed, with 30 in favor and 1 opposed.

The City Council has referred to this office for recommendation the
petition of The House of Hope Presbyterian Church of St. Paul for
the vacation of part of Portland Avenue between Avon and Grotto.
The purpose of this vacation is to: eliminate through traffic which
now exists between the Church on the south side of Portland and the
playground on the north side of Portland. This will provide safe
departure from buses for pre-schoolers and primary schoolers
arriving at the Church.
Will you please advise me of any existing utility easements or of
any concerns over the intended future use of this proposed
vacation. I would like to receive your comments before June 15,
1992 so I can prepare a report to the City Council on this matter.

The Water Utility has a 6-inch public water main in Portland Avenue between Avon
Street and Grotto Street. To provide for access should the water main require
maintenance, repair or replacement, the Utility requires that an easement be
retained over the south 30 feet of the north 37 feet of the proposed vacation.
Restrictions within the easement area are as follows:
1 . No buildings, structures, or trees are permitted within the easement
area, or any temporary structure, material storage, fixture or other
objects that will prohibit normal access to water facilities for
maintenance purposes.
2. No change from the existing grade is permitted without written
permission from the Water Utility.
3. No change in surfacing within the easement area is permitted without
written permission from the Water Utility.
4. That the petitioner, its successors and assigns shall fully in-
demnify, defend and save harmless the Board of Water Commissioners,
its officers, agents, employees, and servants from all suits, actions
or claims which shall arise from any injuries or damages received or
sustained by any break in any service pipe, water main, or connection
in said reserved easement, arising out of or resulting from any action
or negligence of the petitioner, its employees, agents or business
invitees.
5. Water service connection piping in the street vacation shall become
the maintenance responsibility of the property owner served thereby.

Vacation of part of Portland Avenue
between Avon and Grotto Streets
The Department of Public Works has completed its review of the above referenced
vacation proposal. Portland Avenue as referenced above is a 30 foot wide paved street
within a 66 foot wide by 467.25 foot long dedicated right-of-way.
The vacation as proposed should be denied unless
1) a turn-around area is dedicated to the satisfaction of the Department of Public
Works, OR the entire block is vacated while providing for existing access off Portland
for the property at the southwest corner of Portland and Grotto; AND
2) a neighborhood meeting is held with residents on adjacent streets flyered; AND
3) the neighborhood district council recommends approval.
Provided all of the above conditions are met, the Department of Public Works could
recommend approval subject to the following requirements:
1) The petitioner shall be responsible for reconstructing the street intersections
involved in the proposed vacation, to the satisfaction of the Public Works
Department, including, but not limited to, the construction of new curbing,
sidewalks, boulevards, drainage structures, and signage, to removal all appearances
of public right-of-way.
2)A 30 foot wide permanent easement, centered on the centerline of Portland Avenue,
must be retained for the protection and maintenance of the existing sewer. The usual

conditions apply, including the fact that the City's exercise of its easement rights do
not require restoration of any improvements in the easement area.
3) The petitioner shall be responsible for all costs for the removal and reinstallation of
street lights, conduit, wiring, pullboxes, etc. affected by this vacation, as required by
Public Works Traffic Engineer. In this instance lighting requirements will include
removal of 3 street lights and foundations; reinstall 2 street lights and foundations;
install 1 pullbox; install 200 feet +1- of conduit with wiring; and reconnect 6 street
lights to the existing circuit, all at the petitioner's expense.

This letter is in response to your letter dated May 21, 1992, recommending the petition of The
House of Hope Presbyterian Church of St. Paul for the vacation of part of Portland Avenue
between Avon and Grotto.
The Department of Planning and Economic Development recommends approval with the
following comments:
The proposed vacation would require a cul-de-sac, which would take part of the
church property.
An alternative option would be to vacate the entire block and the church would give
Gary Thomas, owner of 746 Portland, land for a driveway to access Grotto.
This block of Portland appears to carry little traffic; vacating the street would not
create access or traffic problems for area residents; however, there may be some
effect on Unity Church and the Christian Science Church.
The south side of Portland Avenue is in the Historic Hill District, but the north side is
not.
City staff should have design review of the project following approval of vacation to
address site planning, materials, landscaping and the possibility of a sidewalk for
public use.

The House of Hope Presbyterian Church of St. Paul,Minnesota, (a Minnesota
Corporation), does hereby petition the Council of the City of Saint Paul to vacate the
public land described as follows:
That section of Portland Avenue between Grotto and Avon Streets that lies
adjacent to Block 3 of Palace Addition,Lots 16 through 26 and including
west 16 feet of Lot 27; and Block 4 of Bryant's Subdivision,Lots 9 through
3 and including West 19 feet of Lot 2.
Safety is the principal reason for this request to vacate. House of Hope Church has
developed a playground and park to serve its Nursery School,the Church School, the
Tutoring Program, the Webster Public School, and the neighborhood.
Each day during the school year many pre-school and primary age children are
dropped off at the Portland Street entrance to the education building. There are 94
children in the Nursery School. There are 125 children in the Choir School. There are
350 children enrolled in the Sunday Church School. There are 35 children bussed in for
the Tutoring Program.
As these children are released from cars and buses, many must cross Portland Avenue
between cars. They must cross again to use the playground on the north side of
Portland during recess or after school. This is a constant danger.
During all seasons neighborhood children and public school children use the church's
playground slides, swings,jungle bars and ball field. Children frequently chase after
balls into the street.
The safety of so many children is more vital to the neighborhood than traffic access
through this street which ends one block west of Avon at the William Mitchell Law
School.

Notice is hereby given that the petition of the House of Hope
Presbyterian Church, et al, for the vacation of part of Portland
Avenue between Avon and Grotto Streets, as more particularly shown
on the plat attached to the petition, has been ordered filed in the
Office of the City Clerk of the City of St. Paul, Minnesota, by the
Council, and said petition will be heard and considered by the
Council at a meeting thereof to be held in the Council Chambers in
the City Hall and Court House on the 29th day of December, 1992 at
9:00 A.M.
