WHEREAS, The Council granted the petition of Roy Spannaus
and others to vacate and discontinue for street purposes Lot 22,
Block 1, Merrill' s Division of Rice St . Villas by resolution,
C. F. 261783, adopted July 31, 1973; and
WHEREAS The City Clerk, in accordance with Section 228 .08
of the Legislative Code, has reported that the petitioner has
failed to comply with the terms and conditions of the vacation
resolution and, therefore informs the Council that the vacation
resolution is null and void; now, therefore, be it
RESOLVED, That in accordance with Section 228 .08 of the
Saint Paul Legislative Code and upon the failure of the petitioner
to comply with the terms and conditions set forth in vacation
of street resolution, C. F. 261783, the Council of the City of
Saint Paul does hereby rescind the vacation and discontinuance for
public street purposes Lot 22, Block 1, Merrill' s Division of Rice
St. Villas, and the City Clerk is hereby directed to transmit a
copy of this resolution to the petitioner and to all affected
City departments .

RESOLVED, That upon the petition of Roy Spannaus and
others, that section of public street hereinafter described,
be and the same hereby is vacated and discontinued as a
public street:
All of Lot 22, Block 1, "Merrill's
Division of Rice Street Villas" ;
subject expressly to the following conditions and reservations :
1. That the vacation be subject to all the terms
and conditions of Section 228 of the Legis-
lative Code, as amended.
2. That the petitioner pay to the City of St. Paul
the sum of $500.00 as compensation for the
vacation and provide the City with a bond in the
amount of $2,000.00.
3. Upon receipt of the compensation set forth in
paragraph 3 the proper city officers are autho-
rized to execute on behalf of the City agreement
ml.easing the City's interest in All of Lot 22,
Block 1, "Merrill' s Division of Rice Street
Villas" and deliver quit claim deed to petitioner.

We enclose a copy of Council File No. 261783, published August 4,
1973, which provides for the vacation of all of Lot 22, Block 1,
"Merrill's Division of Rice Street Villas", as more fully
described therein.
The ordinance pertaining to vacations requires that the compensation
specified in the resolution must be paid, and a surety bond in the
amount specified must be filed within thirty (30) days after publica-
tion of the resolution.
We also enclose an acceptance of the terms of the resolution which
must also be signed and filed here within said time.

Subject: Petition of Roy Spannous and others for the vacation of a permanent
easement for street purposes over and across Lot 22, Block 1, "Merrill's
Division of Rice Streets Villas".
The petitioner seeks the vacation of Lot 22, Block 1, "Merrill's Division of Rice
Streets Villas", which was deeded to the City along with other lands, by Document
No. 1790045, filed December 29, 1972, pursuant to C. F. 250755, approved October
7, 1970.
A condition of said vacation required that the petitioner grant a permanent ease-
ment for street purposes over Lots 9, 21, and 22, Block 1, "Merrill's Division of
Rice Streets Villas", to the extent deemed necessary by the Department of Public
Works. However, the Department of Public Works has since declared Lot 22 surplus
for the street so dedicated which has recently been named Camelot Street. The
Department of Public Works further recommends Lot 22 be vacated.
The City Planning staff has reviewed this matter and finds no planning objections
to said vacation.
In view of the foregoing, I recommend the vacation be granted subject to the follow-
, ing terms and conditions:
1. That the description of the easement to be vacated read as
follows:

The undersigned, as the owner of Lot 22 , Block 1,
Merrill ' s Division of Rice Street Villas to the City of St. Paul ,
does hereby petition your honorable body to vacate the permanent
easement for street purposes granted to the City of St. Paul
by deed filed December 29 , 1970 in the office of the Register
of Deeds in and for Ramsey County, Minnesota as Document No.
1790045 and filed in the office of the Registrar of Titles in
and for Ramsey County, Minnesota as Document No. 553262 . Such
termination of easement is requested by petitioner because
petitioner has been issued building permits for the construction
of an apartment project on the adjacent properties, which plans
incorporate the use of said Lot 22, in part for a driveway, and
in part for green area; the City of St. Paul does not require
said easement, and a proposed new street to the West of said
Lot does not require said easement.

June 20, 1973 on the petition of Camelot Chateau, Inc . for the

California Avenue between Park and Rice Streets .
