Parkway to the Soo Line Railroad right-of-way;
The alley in Block 1, Dawson' s Fifth Addition
from the south line of Wheelock Parkway to the

from the south line of Edgemont Street to the
Soo Line Railroad right-of-way;
Subject expressly to the following conditions and reservations:
1. That the vacation be subject to all the terms and conditions
of Section 228 of the Legislative Code as amended.
2. That a specific sewer easement be retained in Idaho Avenue
and that part of Arkwright Street north of the extended

Re: Vacation of East Idaho and Arkwright Street - C. F. 251110
Dear Sir:
You inform us that the City Council has requested preparation of
the necessary resolution so as to reactivate and repass Council
File No. 251110 in order that the petitioners named therein may
comply with the terms and conditions set forth for the vacation
of certain streets and alleys . In my opinion it would not be
proper for the City Council to attempt to reactivate and repass
this resolution for the reason set forth below:
The authority to vacate streets and other public property is con-
tained in Section 129 of the Saint Paul City Charter. Pursuant
thereto Chapter 228 of the Saint Paul Legislative Code was enacted
by the City Council. Section 228.04(e) provides as follows:
"Within thirty days after the publication of any vacation
resolution, the petitioner shall file with the City Clerk
an acceptance in writing of the conditions of such resolu-
tion, and shall within said period, comply in all respects
with the terms and conditions of such resolution. In case
of failure to file such acceptance and to comply with such
conditions within the said period of thirty days, the res-
olution shall be ipso facto null and void."
Examination of the records in your office pertaining to this matter
discloses that the City Council on November 6, 1970, approved the
vacation of portions of East Idaho Avenue and Arkwright Street,
and portions of public alleys in Block 1 and Block 4, Dawson' s
Fifth Addition, and, further, conditioned the said vacation upon
the petitioners ' compliance with certain terms and conditions,
among which included the requirement that the petitioners pay the
.

City the sum of $10,000.00, provide the City with a bond in the
amount of $2,000.00, and deposit $200.00 with the Ramsey County
Treasurer. As of the date of this opinion, no bond or compensa-
tion has been received by the City of Saint Paul pursuant to the
above Council resolution, nor have the petitioners filed a letter
of acceptance with the City Clerk. These conditions not having
been complied with within the thirty-day period specified in
Section 228 .04(e), the resolution vacating the streets is "ipso
facto null and void" in accordance with Section 228 .04(e) of the
Saint Paul Legislative Code.
If the petitioners desire to request that these streets and alleys
be vacated, it will be necessary that they submit a new application
at such time as the new City Charter may be amended so as to con-
tain provisions and procedures for the vacation of public streets,
alleys and other public grounds.

The subject petition was laid over from September 2, 1970 and rescheduled
for the same date as the related rezoning matters in this area. I have
attached my report dated August 31, 1970 concerning this vacation petition.
If the rezoning petitions for the property outlined in brown on the
attached plan, are granted, I would recommend that the vacation be granted
subject to the following terms and conditions:
1. That the description_,of the lands to be vacated read as
follows:
East Idaho Avenue from Edgemont Street to the west line
of Arkwright Street.
Arkwright Street from the south line of Wheelock Parkway
to the Soo Line Railroad right-of-way.
The alley in Block 1, Dawson's Fifth Addition from the
south line of Wheelock Parkway to the north line of
Edgemont Street.
The alley in Block 4, Dawson's Fifth Addition from the
south line of Edgemont Street to the Soo Line Railroad
right-of-way.
2. That the vacation be subject to all the terms and conditions
of Section 228 of the Legislative Code as amended.
3. That a specific sewer easement be retained in Idaho Avenue and
that part of Arkwright Street north of the extended south

land remains low density residential, I would recommend that the vacation
be denied since the vacation of the streets would seriously restrict
access to the abutting properties without a replatting or rededication
of other street right-of-ways for this area.

Hearing: September 2, 1970
The petition seeks the vacation of the platted streets and alleys lying
within the area bounded by Wheelock Parkway on the north, Edgemont on
the west and the Soo Line Railway right-of-way on the south and east, for
the purpose that the lands can be developed into one piece of property
for the construction of a building development. The area is vacant, un-
improved and generally covered with wild growth.
The staff of the City Planning Board has reviewed this matter and notes
the following:
1. The property fronting on these streets and alleys is the
subject of three petitions currently before the City to
rezone from "A" to "C" Residence.
2. This staff has recently suggested the possibility of a linear
park along the northwesterly side of the Soo Line Right-of-
way in this vicinity. Such a linear park would be part of a
network connecting major facilities providing hiking, bicycle
and horseback trails, and could be about 100 feet in width.
3. If the property in Blocks 1 and 4, Dawson's 5th Addition, is to
be used for multiple-family purposes as proposed by the re-
zoning petitions, the subject right-of-ways will not be needed
for street purposes, assuming development as one plot.
4. If the property in Blocks 1 and 4 are to be used for low-density
residential, as presently zoned, it would be desirable to replat
this immediate area to provide a better street layout and more
useable parcels.
Consequently, it is the Planning Staff's recommendation that a final decision
on these vacations be delayed until after decisions are made on the pending
rezonings. If the rezonings are not granted, they recommend that the vacation

Regardless of the outcome of the rezoning petitions, they recommend that
the availability of necessary land along the railroad right-of-way be assured
for park purposes as a result of the proposed vacation.
The Department of Public Works reports the need for permanent sewer easements
in Arkwright Street and E. Idaho Avenue for future sewers.
The Board of County Commissioners of Ramsey County, Minnesota adopted, at
the meeting held on August 24, 1970, a Resolution to protect their interests
in that certain tax-forfeit parcel of land shown shaded blue on the attached
plan and described as follows:
Part southwesterly of Wheelock Parkway and north of extended
south line of Idaho Avenue of part of the south 891 feet of
the east 1/2 of the northwest 1/4 of the northwest 1/4, north-
westerly of M. St. P. & S. Ste. M. Ry. R/W in Section 20, Town-
ship 29, Range 22.
A copy of said Resolution is attached hereto.
Since the vacation of the streets and alleys as proposed is dependent upon
the land use in the area pursuant to the report of the City Planning Board,
and in lieu of the foregoing information, I recommend that this matter be
laid over indefinitely with a rehearing to be set on this matter on the
same date as the hearings on the related rezoning matters with new notices
to the affected property owners.

VACATIONS PROCEDURE
(See also Chapter 228 of the Legislative Code)
1. Prepare a petition addressed to the City Council asking for the vacation.
Accurately describe the portion of street or alley to be vacated and set out
a reason or reasons for the request. The petition must be signed by a
majority of the abutting owners (all of them if possible), and must be
verified by one of the signers before a Notary Public.
2. File the petition in the office of the City Clerk, 386 City Hall, together
with a blue print or accurate scale drawing showing the street. or alley to
be vacated, the boundary streets and all abutting property, including legal
descriptions of such property, and a statement of ownership of all abutting
property certified by the Ramsey County Abstract Clerk or St. Paul Abstract
and Title Guarantee Co.
3. A filing fee of $100.00 is required with the petition to cover administra-
tive costs.
4. The petition is referred to the Corporation Counsel for approval as to form
and as to sufficiency of signatures.
5. When and if approved by the Corporation Counsel, the petition is presented
to the City Council and is referred by them to the City Clerk to set a date
for public hearing and to the Valuation and Assessment Engineer, 286 City
Hall, for recommendation as to whether or not the petition should be granted
and if granted, the terms and conditions to be imposed.
6. The City Clerk sets a date for hearing and prepares a notice of hearing
which is published once a week for four successive weeks in the official
newspaper of the City. Notices of hearing are mailed to abutting owners by
the Commissioner of Finance.
At the hearing the City Council hears all those wishing to be heard, and may
grant, deny or lay over the matter.
7. If granted, the City Council sets conditions which must be complied with by
petitioners within 30 days. These include payment of compensation to the
City in an amount fixed by the Council, the filing of a Surety Bond to in-
demnify the City, and the filing of an acceptance of the terms of the reso-
lution of vacation signed by the petitioners or some of them. The bond and
acceptance should be delivered to the City Clerk's Office and the compen-
sation presented there.
8. When all conditions have been complied with, the City Clerk will prepare
completion certificates and certified copies of the resolution and file
them in the office of the Register of Deeds.

WHEREAS, a hearing on a petition to vacate East Idaho Avenue
from Edgmount to Arkwright, and Arkwright Street from the Soo Line
right—of—way to Wheelock Parkway will come before the St, Paul
City Council on September 2, 1970,
WHEREAS, certain tax forfeited land hereinafter described which
abutts Arkwright Street at the intersection of East Idaho Avenue
would become landlocked as a result of said vacation;
Part southwesterly of Wheelock Parkway and north of extended
. south line of Idaho Avenue of part of the south 891 feet of
the east 1/2 of the northwest 1/4 of the northwest 1/4, north-
westerly of M. St. P. & S. Ste. M. Ry. R/W in Section 20/
