1. That the vacation be subject to all the terms

1, 1981, of the St. Paul Legislative Code, as

2 . That the petitioners must at their expense replat

Subject: Petition of Earl A. Brown, Developers Inc. et al,
for the vacation of a portion of Hazelwood Street
lying between East Idaho and Larpenteur Avenue.
Public Hearing - June 22, 1982
The petitioners Earl A. Brawn, Developers Inc. , et al, request this va-
cation be granted so they may replat the area and construct five (5)
townhouses on the site. They also plan to construct and dedicate to the
City, a cul-de-sac on the south portion of the remaining part of Hazelwood
Street at no cost to the City. The portion of Hazelwood Street right-of-way
to be vacated is approximately 238 feet long and 66 feet wide, consisting
of approximately 15,048 square feet with the abutting property being
zoned RT-1 and R-3.
The Department of Public Works recommends that the petitioners must agree
to replat the area of this development by January 1, 1983, to include the
dedication of the cul-de-sac to the satisfaction of the Public Works
Department.
The Department of Planning and Economic Development has no objections to
this vacation but recommends that a cul-de-sac be put in for proper access
to the properties along the northern part of the remaining portion of Hazel-
wood.
There were no other objections, recommendations or restrictions received
from any City department or utility company in response to my letter of
inquiry sent them on March 31, 1982.
In view of the foregoing, I recommend that the vacation be approved subject
to the following terms and conditions:
1. That the description of the portion of said street
to be vacated be described as follows:
All that part of Hazelwood Street lying
Northerly of a line run Northeasterly from
the Southeast corner of Lot 1, Block 1,
Phalen Heights, to the most Southerly corner

Prosperity Road to approximately 240 feet north.
A review of the proposed vacation of Hazelwood Street has been completed.
Hazelwood Street is an unimproved, 66 foot wide by approximately 240 foot
long street.
The petitioner plans to vacate this portion of street right-of-way for the
development of townhouses. A new plat will be prepared dedicating a cul-
de-sac at the end of the remaining part of Hazelwood Street.
The petitioner must agree to replat the area of his development, to include
the dedication of the cul-de-sac all to the satisfaction of the Public Works
Department and file said plat for record prior to January 1, 1983.

REASONS FOR VACATION:
LOT A -
Upon purchasing my property I was lead to believe that I owned the subject
property. Upon further inquiry I found that my dwelling was about four feet
off the City right-of-way if the future street were ever constructed. The change
we are requesting would make it possible for me to build a detached garage on
my property with good access to the street and maintain a reasonable sized
yard on the property.

Our present dwelling sits very close to the back property line. Vacation
oftthe subject property would grant me a more conventional rear yard in line
with similar properties in the neighborhood. Presently my side yard is of
little value because of its shape and size.

own expense to construct and develop a cul-de-sac. In addition I would like
to construct a new dwelling on a portion of the vacated street(please see

to the City for the proposed cul-de-sac in exchange for that portion of the street
acrruing as a result of the vacation. It is further my desire to develop the
area in the best interest of all residents involved aad thereby necessary to

hereinafter described, be and the same hereby is vacated
and discontinued as a public street:
All that part of Hazelwood Street lying
Northerly of a line run Northeasterly

1, Phalen Heights, to the most Southerly

as follows: Commencing at the Northwest

1. That the vacation be subject to all the terms
and conditions of Chapter 130, codified March
1, 1981, of the St. Paul Legislative Code, as
amended.
2 . That the petitioners must at their expense replat
the area of their development, including the
dedication of the cul-de-sac right-of-way to
the satisfaction of the Department of Public
Works and in a manner and form approved by the
City Attorney by January 1, 1983 .
3. That the petitioners will be responsible for all
costs and expenses in the construction of the
new Hazelwood Court, including the new proposed
cul-de-sac all to the satisfaction of the Depart-
ment of Public Works.
4. That the petitioners pay to the City as market
value the sum of $8,400.00 as compensation for
the vacation.
5. That the petitioners furnish the City with a
bond in the amount of $5,000.00, and in addition
thereto, by acceptance of the terms and conditions
of this vacation agree to indemnify, defend and
save harmless the City of Saint Paul, its officers
