MEREAS, Subject to the terms and conditions imposed in Cctancil Resolution
C.F. No. 272416 and Chapter 228 of the Saint Paul Legislative Code, the Council of
the City of Saint Paul did vacate the folluding described public apro erty located in
the City of Saint Paul:
T•at part of Grotto Street lying between the extended South line of
Lot 1, Block 3, Joseph R. Weide's Rearrangement of Block 3 and North one-half
of Block 2, Winters Addition to St. Paul, Minnesota and the extended North
line of said Lot 1; also
Hubbard Avenue from the extended easterly line of Lot 16, Block 11,
Butterfield Syndicate No. 2, to the West line extended of Lot 20, Block 3,
Josh R. Weide's Rearrangement of Block 3 and North one-half of Block 2,
Winters Addition to St. Paul, Minnesota
and
1S, Section 228.05(e) of the Saint Paul Legislative Code provides that the
resolution granting the vacation shall be nmll and void unless the text and condi-
tions of the vacation resolution are accepted in writing and net within Thirty (30)
days publication of said resolution;
!- S, Petitioner, B & S Rigging and Erection, Inc., in Council Resolution
C.F. No. 272416, has failed to meet the requirenents as imposed in said resolution;
1484 THEREFORE BE IT RESQLVID That Council Resolution C.F. No. 272416 is h ereby
rescinded and the public property sought to be vacated therein continues for the
benefit of the public in accordance with the same use in existence prior to the
petition to vacate.
