discontinued as public alley:
All of the alley in Block 2, Greene ' s Addition to the
City of St. Paul
Subject expressly to the following conditions and reservations:
1. That the vacation be subject to all the terms and conditions
of Chapter 130, codified March 1, 1981, of the St. Paul Legislative
Code; as amended.

2 . That the petitioner pay to the City the sum of $2, 700. 00 as
compensation for the vacation within 60 days of the effective date
of this resolution.
3. That the petitioner, its successors or assigns, by accept
ance of the terms and conditions of this vacation, agrees to indemnify,

employees from all suits, actions or claims of any character, includ-

Dear Mr. Weyandt:
The sixty days after publication of the City Council Resolution providing
for the above vacation were up April 24, 1985.
The compensation was to have been paid and the acceptance of the terms of the
resolution was to have been signed and filed by that date.
Until the compensation is paid and the acceptance filed, the City retains
its interest in the property petitioned to be vacated.
We need immediate payment and acceptance, or the vacation will be null and
void.
If you no longer wish to have the street vacated, kindly let me know and the
City will begin action to rescind the resolution granting the vacation.

This is to advise that the petition of Donald Kloek, Ace Auto Parts, for the
vacation of subject alley is in proper form and has been signed by the
requisite number of property owners. The purpose of this vacation is
expansion of existing salvage yard.
This vacation is located in City Council District 5, Neighborhood Planning
District 6 and 7.

PETITION FOR VACATION OF PUBLIC ALLEY

The undersigned, as owners of the abutting property, present this petition
requesting vacation of the public alley which is described below:
1. Description of Property: Acker Street from Rice Street to Park Street,
South side of Acker between lot's 6,7,8,9, and 10 of block 2 of Greene's
Addition and lot 18 of Guerin's Outlots.
2. Reason for Request and Intended Use: Abutting owner, Ace Auto Parts
Co. Inc. located on lots 8-15 of block 1 also lot's 2,3,5,6,7,80-2,9,and
10 of block 2 in Greene's Addition, would like additional property in
order to expand existing salvage yard.

The Public Works Committee at its meeting of January 9, 1985 took the
following action:
1 . VACATION: Petition of City of St. Paul for the vacation of Lots 7
& 8, Block 82, Banning and Oliviers Addition for the purpose of
developing residential housing ( located at Chippewa & Baker Sts) .
Hearing Date: 1/15/85.
Recommended this property be retained as park land.
2. VACATION: Petition of Ace Auto Parts Co. Inc. , for the vacation of
part of the alley in Block 2, Greens Addition for the purpose of
expansion of the existing salvage yard.
Hearing Date: 1/22/85.
Recommended approval .
3. RATIFICATION OF ASSESSMENTS: For grading & paving the N-S alley in
Wallraff's Como Place and Como Addition, B1k. 1 from Rose to the
south line of Wallraff's Add. Grade & pave the E-W alley in said
addition from the east line of Como Add. Blk. 1 to the east line of
Lot 6 extended Wallraff's Add. (bounded by Rose, Grotto, Maryland
and E. Como Blvd. ) .
Hearing Date: 1/15/85.
Recommended to the Council that the assessments be split— 50% to
property owners involved and 50%, to School Department.
4. RATIFICATION OF ASSESSMENTS: For improving Sims & Hazelwood to
approx. 350 feet east to cul-de-sac; grade & pave, curb & gutter,
and sewer service connections. Also rough grade Hazelwood to 100
feet north & south of Sims. Construct storm water draining
facilities in Hazelwood. Sanitary sewer in Sims from Hazelwood to
approx. 350 feet east & in Hazelwood from Sims to Case. Construct
water main in Hazelwood between Case & Sims and in Sims from
Hazelwood to east 400 feet to cul-de-sac. Also water service
. connections.
Hearing Date: 1/15/85.

5. FINAL ORDER: Improving Fillmore Avenue from State St. to Plato
Blvd. by constructing a concrete overlay and doing all other work
necessary to complete said improvement.
Hearing Date: 1/15/85.
Recommended approval with stipulations.
6. FINAL ORDER: Acquiring by condemning and taking a 40 feet wide
permanent sewer easement over, under and across certain properties ,
for the Front-St. Albans Storm Sewer Project.
Hearing Date: 1/22/85.
Recommended approval .
