RESOLVED, That upon the petition of Theodore Hamm Brewing
Company, that section of street hereinafter described, be and the
same hereby is vacated and discontinued as a public street :
Greenbrier Street between Reaney Avenue and Minnehaha
Avenue ;
subject expressly to the following conditions and reservations:
1 . That the vacation be subject to all the terms and con-
ditions of Section 228 of the Legislative Code as amended.
2 . That a specific easement be retained to protect the in-
place Northern States Power Company' s stub gas lines.
3. That the petitioner reconstruct the street opening at
both Minnehaha Avenue and Reaney Avenue to give the appearance of
a private driveway; said work to be done pursuant to City permit
and in accordance with Department of Public Work' s design standards
and at the petitioner' s expense; said reconstruction is to include
the relocation of the street drainage facilities as required by
the Department of Public Works.
4. That the petitioner agrees to file a petition with the
City of St. Paul requesting the vacation of the alley in Block 57 ,
Arlington Hills Addition.
5 . That the petitioner make application to the City of St.
Paul for an Off-Street Parking Special Use Permit embracing the
area of Greenbrier Street sought to be vacated and herein de-
scribed, pursuant to the requirements of the City Zoning Code .
6. That the petitioner pay the City the amount of $14,200.00
as compensation for the vacation and that the bond required by
Section 228 of the Legislative Code be set at $15 ,000.00.

Gentlemen:
We have been informed that because of the current mail
strike, the hearing which was scheduled before the
Council on April 1, 1970 has to be delayed until sufficient
legal notice, etc. , can be given by the City.
The vacation of Walsh Street is particularly urgent because
we plan to immediately begin construction of a building
thereon once it is vacated. This building will house
special new keg filling machinery, which has already been
ordered.
Consequently, we respectfully request that the proceeding
for the vacation of Walsh Street be held as soon as
possible.

Postponed hearing - May 7, 1970
The subject petition has been filed by the petitioner because of their urgent
need for space in connection with the operation of the Hamm Brewing Company.
The petitioner proposes to post private road signs for Greenbrier at Reaney
and Minnehaha Avenues and it is their intent to construct a loading dock
which will extend into the portion of Greenbrier Street petitioned for
vacation. The loading dock will be used primarily by tractors and semi
trailers but the petitioner does state that this use may change depending
upon the future needs of the Brewery.
The portion of Greenbrier Street petitioned for vacation measures approximately
271 feet by 63 feet and contains an area of 17,038 sq. ft. The adjacent lands
are zoned heavy industrial to the west and light industrial to the east and
these lands are presently improved with Brewery buildings constructed up to
the street line and measuring roughly 50 feet in height. The east side of
the street has been improved with a public sidewalk and the west side of the
street is being used for perpendicular parking by Hamm employees.
The alley in Block 57, Arlington Hills Addition which is the alley in the
block immediately east of the subject segment of Greenbrier Street is a
graded alley and presently has egress and ingress from Greenbrier Street.
The vacation of Greenbrier will deadend this alley at its western extremity
and insofar as all the property in said Block 57 is under the ownership of
the Hamm Brewing Company, it would appear that this alley should also be
vacated.
The Staff of the City Planning Board reports no objections to the vacation.
However, their field investigation reveals that private parking currently
exists within the street right-of-way. They recommend that the vacation
include the condition that application be made for an off-street parking
Special Use Permit as required by the zoning code.

The Department of Public Works recommendsthat the proposed vacation be approved
subject to the petitioner agreeing to submitting a vacation petition to the
City of St. Paul for the vacation of the alley in Block 57, Arlington Hills
Addition extending from Greenbrier Street to Walsh Street. They also request
that the street openings at Minnehaha and Reaney Avenues be reconstructed as
a driveway to remove the appearance of a public street in accordance with the
Department of Public Work's deign standards and at the petitioner's expense.
There are two catch basins at linnehaha Avenue and one catch basin at Reaney
Avenue which will have to be relocated by the petitioner at his cost and
expense and the work should be accomplished by a licensed contractor under
a City permit.
The Northern States Power Company reports the existence of a 4" gas stub that
extends five feet south of Reaney and a 4" round gas stub that extends eight
feet north of Minnehaha and they have requested that their interest be pro-
tected.
There were no objections from any of the other City Departments or utility
agencies involved.
In view of the foregoing, I recommend that the vacation petition be granted
subject to the following terms and conditions:
1. That the description reads as follows: Vacate Greenbrier Street
from the north line of Minnehaha Avenue to the south line of
Reaney Avenue.
2. That the vacation be subject to all the terms and conditions
of Section 228 of the Legislative Code as amended.
3. That a specific easement be retained to protect the in-place
Northern States Power Company's stub gas lines.
4. That the petitioner reconstruct the street opening at both
Minnehaha Avenue and Reaney Avenue to give the appearance of
a private driveway; said work to be done pursuant to City
permit and in accordance with Department of Public Work's

Dear Sir:
You recently submitted to our office a request for an opinion as to
the vacating of Greenbrier St. between Minnehaha Ave. and Reaney Ave.,
and Walsh St. between Reaney Ave. and Bush Ave.
In each instance, the vacating will be one block in length. Generally,
the vacating of a street one block in length creates very few problems
- if any - as far as fire protection is concerned. However, we feel that
in this instance there should be brought to the attention of the peti-
tioner seeking thc?action that fact there tie is somewhat of a water
supply problem in the immediate area as far as fire protection is con-
cerned.
The water mains on Minnehaha, Reaney and Bush Avenues do not continue
through the Burlington Northern (NP) right-of-way. This means that many
of the hydrants in the area are dead-end hydrants, the nearest substantial
cross-gridding to the east being as far away as Arcade St. In the event
of a multiple alarm fire, hose lines laid to these hydrants might draw
insufficient volumes of water as far as good fire extinguishment is
concerned.
The fronts of the two buildings now facing on Greenbrier St. are largely
windowless and approximately fifty feet tall. They already present a
fire problem as far as entry from Greenbrier St. is concerned. If the
petitioner intends to join the two buildings that now exist withthe
same type of construction, such as a solid monolithic building front
facing either on Reaney Ave., or Minnehaha Ave., such a construction,
considering questionable water supply, will aggravate already existing
fire fighting problems.
It is not our intention to oppose closing of either street in any way.
We are merely informing you and the petitioner of the problems involved
as far as fire protection in the area is concerned. 7)

This is written in response to your letter of February 25, 1970,
requesting our comments on two street vacation petitions that are to
be considered by the City Council April 1, 1970.
GREENBRIER STREET between Reaney and Minnehaha Avenues--the staff of the
City Planning Board finds no objection to this vacation. However, field
investigation reveals that private parking currently exists within the
right-of-way. Therefore, we recommend that the vacation resolution
include the condition that application be made for an off-street parking,
special use permit as required by the Zoning Code.
WALSH STREET between Bush and Reaney Avenues--the staff of the City
Planning Board has reviewed this matter and notes that the proposed
vacation would leave Bush Avenue west of Weide Street without an
outlet. The same situation would occur with the alley in the block
abutting on the east. We would, therefore, recommend that this petition
not be granted until such time as provisions are made for correction of
the above-noted situation.

Dear Mr. Donovan:
The proposed vacation of Greenbrier Street has been laid over 2 weeks
to April 15, 1970.
The Department of Public Works Sewer Engineer indicates that, upon
reconstruction of the street openings on Greenbrier Street at Minnehaha
Avenue E. and at Reaney Avenue, there are 2 catch basins at Minnehaha
Avenue E. and I catch basin at Reaney Avenue which will have to be relocated.
The relocation of any catch basins will be done at the petitioners expense,
and accomplished by a licensed contractor with the City of St. Paul under
a City permit.
The Department of Public Works further recommends that the proposed
vacation be approved subject to the petitioner agreeing to submit a °.'acation
petition to the City of St. Paul for the vacation of the alley in Block 57,
Arlington Hills Add. , extending from Greenbrier Street to Walsh Street.
The Department of Public :forks, therefore, recommends that the proposed
vacation of Greenbrier Street be approved subject to the above named conditions

TO VACATE GREENBRIER STREET
BETWEEN REANEY AND MINNEHAHA AVENUES
To: City Council
City of St. Paul
County of Ramsey
State of Minnesota
Petitioner hereby requests the vacation of Greenbrier
Street between Reaney and Minnehaha Avenues.
The reason for this request is that petitioner urgently
needs the space for operation of its Brewery. Petitioner
intends to post "Private Road" signs for Greenbrier at
Reaney and Minnehaha Avenues and will construct a loading
dock which will then extend out into what was Greenbrier
Street. Tractors and semi-trailers will use the loading
dock for loading and unloading advertising material, etc.
Said use may, of course, change as future operations of
the Brewery dictate.
Petitioner is the owner of all abutting property (Lots
9 and 10, Block 57 ; Lots 1 and 26, Block 3) , as shown
by the attached certified Statement of Ownership.
A drawing, showing street to be vacated, is Exhibit A,
attached hereto.
