RESOLVED, That upon the petition of Holm and Olson, Inc. ,
that section of public street hereinafter described, be and
the same hereby is vacated and discontinued as a public street:
All that part of Erie Street lying
North of the North right-of-way line
of the alley in Block 3, Norwood
Addition to the City of St. Paul ex-
tended Easterly and lying South of
South right-of-way line of Interstate
35-E;
subject expressly to the following conditions and reservations:
1. That the vacation be subject to all the terms
and conditions of Chapter 130, codified March
1, 1981 of the St. Paul Legislative Code, as
amended, including the retention of all public
utilities easements.
2. That a specific easement be retained to protect
the interest of Northern States Power Company
within the said vacated street.
3 . That a specific easement be retained to protect
the existing Northwestern Bell Telephone Company' s
aerial cable and poles now located within the
limits of Erie Street sought to be vacated.

value the sum of $7, 500.00 as compensation for
the vacation.
5. That the petitioner furnish the City with a bond
in the amount of $5,000.00, and in addition
thereto, by acceptance of the terms and conditions
of this vacation, agrees to indemnify, defend and save
harmless the City of Saint Paul, its officers and
employees from all suits, actions, or claims of any
character, including, but not limited to, a claim
brought because of any injuries, or damages received
or sustained by any person, persons or property, on
account of this vacation; or because of any act or
omission, neglect or misconduct of said petitioner;
or because of any claim or liability arising from
or based on any violation of any law or regulation
made in accordance with the law, whether by the
petitioner or any of its agents or employees.

Public Hearing - September 29, 1981
The petitioner, Holm and Olson, Inc., a florist company, and the only
abutting owner to subject property, requests that this vacation be
granted to combine their property into one parcel. The land will be
used as part of their greenhouse business. The area to be vacate •

reports it has no objection to it.
The Department of Planning and Economic Development has reviewed this
vacation and finds no objection to the vacation as proposed.
Northwestern Bell Telephone Company has an aerial cable and two poles
along Erie Street in the proposed vacation area. They request that
their interest be protected.
Northern States Power Company reports they have two poles and two gas
services in the proposed vacation area. They request that their
interest be protected.
There were no other objections or recommendations from any other public
or private agencies involved.
In view of the foregoing I recommend that the vacation be approved,
subject to the following terms and conditions:
1. That the description of that part of Erie Street
to be vacated read as follows:
All that part of Erie Street lying North
of the North right-of-way line of the alley
in Block 3, Norwood Addition to the City of
St. Paul extended Easterly and lying South
of South right-of-way line of Interstate 35-E.

Your letter and attached map of July 11, 1981 indicated part
of Erie Street north of Superior Street has been petitioned
for vacation by Holm and Olson Inc.
The Telephone Company has an aerial cable and two poles along
Erie Street in the proposed vacation area. This cable crosses
Erie Street at the south side of the alley and goes north to
the north end of the street and then is buried to the east.
This cable provides service for Holm and Olson. In order to
continue to serve this customer we wish to continue our
utility easement in Erie Street in the area shown to be vacated
on your map.

In regards to the petition of Holm and Olson, Inc. for the vacation
of part of Erie Street, as shown on the attached plan, this office
has no objection. If I35-E or the alternate parkway is built along
the Pleasant Avenue Corridor, it is very unlikely that this portion
of Erie Street would intersect the new road.

1. That part of Erie Street that is adjacent to Holm & Olson
property on b9th sides and dead ends into the Pleasant Ave. ,

2. The reason for vacation is to connect our property.
3. The land will be used for our greenhouse business.
