Hathaway et al, that section of public alley hereinafter
described, be and the same hereby is vacated and discontinued
as a public alley:
Vacate that portion of the alley in
Block 4, Edmund Rice' s Fourth Addition,
lying between the south line of Case
Avenue and the extended north line of
the south 10 feet of Lot 16, in Block
4, Edmund Rice' s Fourth Addition;
subject expressly to the following conditions and reservations :
1. That the vacation be subject to all the terms
and conditions of Chapter 228 of the St. Paul
Legislative Code, as amended.
2. That the petitioner agree not to provide
vehicular access to York Avenue across Lot
17 of said Block 4.
3. That the Petitioner pay to the City $11,050.00
as compensation for the vacation and provide
the City with a bond in the amount of $2,000.00.

As per Section (E) Legislation Code #22805, may I
respectively request a 30 day extension of the Vacation Resolution
dated July 3rd and published July 13, 1974. This vaction covers
alleys between Mississippi and Terrence running from York to Case.
Our negotiations for finance for the proposed develop-
ment on the property between Case and York and Mississippi and
Terrence has not been completed yet and we would appreciate a
30 day extention.

WHEREAS, The Council of the City of Saint Paul, upon petition
of }arrel and Marjorie Hathaway, at al. , by Resolution C. F.
263808, approved July 3, 1974, vacated a portion of a public
alley in Block 4, Edmund Rice's Fourth Addition, 'subject to certain
terms and conditions contained therein; and
WHEREAS, In accordance with Section 228.05(e) of the Saint •
Paul Legislative Code, the Council did by Resolution C. F. 263995,
approved August 2, 1974, granted a thirty-day extension to the
petitioners to comply with the said terms'and conditions; and
W}E REAS, The City Clerk reported to the City Council that the
terms and conditions set forth in Resolution C. F. 263308 have not
been complied with and in accordance with Section 228.08, the
Council should adopt a resolution rescinding of the vacation of
alley resolution; now, therefore, be it •
RESOLVED,. That the Council of the City of Saint Paul for the
reason set forth above and in accordance with Section 228.08 of the
Saint Paul Legislative Code does hereby rescind vacation of alley
resolution, C. F. 263808, said resolution vacating that portion
of the alley in Block 4, Edmund Rice's Fourth Addition, lying be-
tween the South line of Case Avenue and the extended North line of
the South 10 feet of Lot 16, in Block 4, Edmund Rice's Fourth
Addition, and the City Clerk is hereby directed to transmit a copy
of this resolution to the petitioners and to all affected City •
Departments.

vacation of the alley in Block 4, Edmund Rice's Fourth
Addition
The petitioner seeks the vacation in order to form one contiguous area for
development purposes. The alley is unimproved, dedicated to a width of 20
feet, extends to a length of 663 feet, comprising an area of 13,260 square
feet. The abutting properties are zcned "B" Residential and Light Industrial.
The proposed zoning code has this property designated for RI -2 (multi-
residence) .
The Department of Public Works reports it has no objection to the proposed
vacation provided the development 'Dien does not include access to York Avenue
from Lot 17, Block 4, Edmund. Rice's Fourth Addition, because of its proximity
to the Highway 35E frontage road.
The staff of the City Planning Board has no objection to the alley vacation
as proposed provided the owner of Lot 18, said Block 4, agrees.
There were no objections from any other public or private agencies involved.
In view of the foregoing, and subject to owner of Lot 18, said Block 4, not
objecting to the vacation, I recommend the vacation be approved subject to
the following terms and conditions:

Subject: Petition of Marrel and Marjorie Hathaway et al for the
vacation of the alley in Block 4, Edmund Rice's Fourth
Addition
The petitioner seeks the vacation in order to form one contiguous area for
development purposes. The alley is unimproved, dedicated to a width of 20
feet, extends to a length of 663 feet, comprising an area of 13,260 square
feet. The abutting properties are zoned "B" Residential and Light Industrial.
The proposed zoning code has this property designated for RM-2 (multi-
residence) .
The Department of Public Works reports it has no objection to the proposed
vacation provided the development plan does not include access to York Avenue
from Lot 17, Block 4, Edmund Rice's Fourth Addition, because of its proximity
to the Highway 35E frontage road.
The staff of the City Planning Board has no objection to the alley vacation
as proposed provided the owner of Lot 18, said Block 4, agrees.
There were no objections from any other public or private agencies involved.
In view of the foregoing, and subject to owner of Lot 18, said Block 4, not
objecting to the vacation, I recommend the vacation be approved subject to
the following terms and conditions:
1. That the description of the vacation read as follows:
Vacate that portion of the alley in
Block 4, Edmund Rice's Fourth Addition,
lying between the south line of Case
Avenue and the extended north line of
the south 10 feet of Lot 16, in Block
4, Edmund Rice's Fourth Addition.
2. That the vacation be subject to all the terms and
conditions of Chapter 228 of the St. Paul Legislative
Code, as amended.

3. That the petitioner agree not to provide vehicular
access to York Avenue across Lot 17 of said Block 11.
4. That the Petitioner pay to the City $11,050.00 as
compensation for the vacation and provide the City
with a bond in the amount of $2,000.00.
I further recommend that a hearing on this matter be held before the City
Council on June 19, 1974.
