Subject expressly to the following terms and conditions : 1. That the vacation be subject to all the terms and conditions of Chapter 130 , codified March 1, 1981 , of the Saint Paul Legislative Code, as amended. 2 . That the petitioner , his heirs and assigns shall pay to the City $1 ,560 as compensation for the half of the alley which will accrue to Lot 4 , Block 1, Edgcumbe Place Addition as a result of this vacation. The sewer division has advised that access is provided for maintenance of these sewers . A letter was also received from Mrs. Leslie Steen which, in part, pointed out that the original site plan showed all of the alley adjoining Walsh Park on the north, west and south was to be vacated rather than just the northerly part. The final plat as approved by the City Council does not make mention of the vacation however. I understand that Walsh Park which is adjacent to this alley was dedicated as a park "forever" in the original plat of the area filed November 24 in the year 1884 . With this understanding and in view of the lack of any objections by any of the City departments or other governmental agencies , I am filing an affirmative report. 1 III. As Valuation Engineer , I recommend that the subject property be vacated subject to the following terms and conditions : 1 . Stoplestad Gentlemen: I have been asked to represent that neighbors who appeared at a meeting yesterday in connection with the vacation of property abutting Walsh Park. From the information which they are able to give me, it appears that the Petitioner has not furnished sufficient information to enable either the Council or the neighbors to determine his reason for requesting the vacation as it relates to the existing plat. It appears that the plat which is now of record is being changed and that change is not made a part of these proceedings . The copy of a proposed plat which is attached to the notice sent to the Highland Area Community Council shows only a portion of the total . It does not identify in any meaningful way the lots and blocks which are to be a part of that plat. Without this information, it appears to me that it is impossible for either the Council or the neighbors to make an informed judg- ment as to Mr . Stoplestad' s petition nor is it clear from his petition where the property now designated as alley originally came from. In any event, since this is presently city property, it does not seem appropriate the City should be giving up its interest in property which is more appropriately a part of the park. I have a prior commitment for the time of the hearing, and I have requested this letter be presented in my behalf with the request Department of Finance and Management Services Page 2 August 5, 1987 that the matter be tabled for an appropriate period of time so that a complete examination can be made of all of the records to determine what objection should be made to the proposed vacation. Petitioner, 1500 First National Bank Building, Saint Paul, Minnesota, is the attorney for Terrence E. Troy, 1594 Edgcumbe Road, Saint Paul, Minnesota. Mr. Troy owns certain land to be known as Lots 4 and 5, Edgcumbe Place Addition, once the City approves the plat for Edgcumbe Place Addition. 2. Petitioner requests the City to vacate that part of the unimproved public alley located adjacent to and south and southeasterly of Lot 4, Edgcumbe Place Addition, which alley lies between Lot 4 and Walsh Park between the southeasterly extension of the easterly line of Lot 4 and the easterly extension of the southerly line of Lot 4 . Petitioner requests that the full 30 foot width of the vacated alley accrue to Lot 4. 3. Petitioner also requests the City to vacate that part of the unimproved public alley located adjacent to and easterly of Lot 5, Edgcumbe Place Addition, which alley lies between Lot 5 and Walsh Park between the easterly extension of the northerly line of Lot 5 and the easterly extension of the southerly line of Lot 5. Petitioner requests that the full 30 foot width of the vacated alley accrue to Lot 5. 4.
