FURTHER RESOLVED, That Mayor George Latimer, as Chief Executive Small Cities

that part of Bradley Street between Whitall Street and York Avenue hereinafter
described be and the same is hereby vacated and discontinued as a public street:
All that part of Bradley Street lying south of York Avenue and north of
the arc of a ninety foot circle, the center of which is located 330 feet north
i of Whitall Street and 45 feet east of the east line of Block 3, Edmund
Rice's First Addition to Saint Paul, also all that part of the east twenty
feet of said Bradley Street lying north of the north line of Whitall Street
! and south of the arc of said ninety foot circle in Edmund Rice's First

j Subject expressly to the following conditions and reservations:
1. That the vacation be subject to all the terms and conditions of Chapter 130,

2. That the petitioner and his contractor shall pay all expenses incurred for
the improvement of Bradley Street between Whitall Street and a 90 foot cul-de-
sac the center of which is located 330 feet north of said Whitall Street and 45 feet

subject to the approval of the Department of Public Works.
3. That as a condition of this vacation, the petitioner at his own cost and
expense shall replat the land he intends to develop which adjoins the vacated

WHEREAS , the Council of the City of Saint Paul by Council
Resolution C.F. 86-242 approved March 5, 1986 did vacate certain
public right-of-way which is more particularly described in said
resolution; and,
WHEREAS, the terms and conditions of said resolution incorporate
the requirement in Chapter 130 of the Saint Paul Legislative Code that
the terms and conditions imposed therein be completed within 60 days;
and,
WHEREAS , the purpose of this vacation is to permit the
construction of a residential apartment complex; and,
WHEREAS , the petitioner , Mr. Bradley Stark, is requesting an
extention of the compliance date to September 30 , 1986 due to
unforeseen delays in the overall closing of this project,
THEREFORE, BE IT RESOLVED, that the compliance date of resolution
C.F. 86-242 is hereby extended until September 30 , 1986 and that the
compensation due for this vacation be assessed interest at the rate of
12% per annum from May 7 , 1986; and
BE IT FURTHER RESOLVED that in all other respects , Council
resolution C.F. 86-242 shall remain in full force and effect.

I . PURPOSE OF THE REQUESTED VACATION AND BACKGROUND INFORMATION
The purpose of this vacation is to use the subject land for
multiple residential construction. The area to be vacated
consists of approximately 18 , 900 square feet and is zoned
RM-2.
II . The Department of Public Works , The Department of Community
Services , The Department of Plannini and Economic
Development , Water Utility, Police Department, Fire and
Safety. Services , Northwestern Bell Telephone Company,
Northern States Power Company, District Heating Development,
Western Union and Continental Cablevision have no objections
to the vacation.
III. As Valuation Engineer , I recommend that the subject
property be vacated , subject to the following terms and
conditions:
1 . That the vacated area be described as follows:
All that part of Bradley Street lying south of York
Avenue and north of the arc of a ninety foot circle,
the center of which is located 330 feet north of
Whitall Street and 45 feet east of the east line
of Block 3, Edmund Rice ' s First Addition to Saint
Paul , also all that part of the east twenty feet
of said Bradley Street lying north of the north
line of Whitall Street and south of the arc of
said ninety foot circle in Edmund Rice ' s First
Addition to Saint Paul.
2 . That the vacation be subject to all the terms and conditions

within 60 days of the publication date of this resolution .
8. That the petitioner, its successors or assigns, by acceptance
of the terms and conditions of this vacation , agrees to

SUBJECT: Proposed vacation of a portion of Bradley Street
between Whitall Street and York Avenue
A review of the proposed vacation of a portion of Bradley Street has been completed.
Bradley Street is an unimproved, 66 foot wide by 585 foot long , street R/W.
The developer plans to vacate the east 20 feet of Bradley Street and also the north 250 feet
(approx.), subject to the dedication of a cul-de-sac at the north end of the remaining street
R/W. See the attached map.
The developer plans to improve Bradley Street, at its own cost and expense, all to the
satisfaction and approval of the Department of Public Works.
The developer plans to construct an interior private roadway to be officially named and approved
by Resolution by the City of St. Paul, subject to certain conditions. See the attached proposed
Resolution. This roadway will be used to address the proposed rental units to be constructed.
See the attached map.
The developer plans to construct, at his own cost and expense, a private sidewalk along the east
side of Bradley Street on said developers property.
The developer must submit a storm water drainage plan for approval by the sewer engineer
prior to the development of this property.
The developer, at his own expense, must replat the property to be developed to include the
dedication of the proposal turn-around area all to the satisfaction and approval of the
Department of Public Works.
Therefore,the Department of Public Works recommends that the proposed vacation be approved
subject to the completion of the above plans, conditions, requirements and/or responsibilities.

WHEREAS, Bradley D. Stark & Associates is the owner and developer of
property described as all that part of the lots 4 through. 13, Block 2 and lots
18 through 20, Block 3 "Edmund Rices first Addition to St. Paul" according to
the plat thereof on file in the office of the County Recorder, Ramsey County,
Minnesota
WHEREAS, Bradley D. Stark's site provides insufficient public street frontage
to properly address the proposed apartment complex consisting of 47
townhomes for rental, and
WHEREAS, Stark & Associates plans to provide vehicular access to the
apartment. complex via private drives so located and described on attached
map, and
RESOLVED, That the private drives shall hereafter he known and designated
by the name of VICTOR LANE, and VICTOR COURT and shall remain as
privately owned drives, and be it further
RESOLVED, That. the Department of Public Works shall issue house numbers
for the apartment. complex using VICTOR LANE, and VICTOR COURT, as the
designated street names, and be it further
RESOLVED,That the developer and/or its successors in interest shall place

The Police Department has no objections to the vacation outlined in
File No. 19-1985.
We do object to the vacations proposed in File No. 23-1985 (Amended) ,
which involves both Sibley and Jackson Streets from Kellogg Blvd. to
Fourth Street. Both Jackson and Sibley Streets serve as feeder/egress
routes to the Shepard/Warner corridors and carry larger volumes of
traffic. This area has been a major traffic bottleneck for years and
conditions cannot be expected to improve.

The Public Works Committee at its meeting of February 5, 1986 took the

between the City and the Chicago and North Western

Avenue Pedestrian Bridge truss on Transportation Company
property ( laid over from 1-22-86) .

3. 1 /7/86 RESOLUTION: amending Chapter 113 pertaining to snow
removal - this change will remove exemption of weekends
and holidays from the time the division is required to
allow for removal of snow & ice from sidewalks ( laid over
from 1-22-86) .

4. 1/21/86 RESOLUTION: approving settlement for appeal of assessment
for alley improvement at 904 Aldine Street aka Lot 13,
Blk. 3, Cottage Place, Taylor's Division.
Recommended approval .
5. 2/11/86 FINAL ORDER: To decide on improving Maryland Avenue from
Payne Avenue to Burnquist Street by grading and paving
with bituminous material , constructing concrete curb and
gutter, constructing drainage structures, ornamental
lighting system and signal system, planting trees, and
doing all other work necessary to complete said
improvement.
Sent back to City Council without recommendation.

Edmund Rice' s First Addition to Saint Paul.
Subject expressly to the following conditions and reservations:
1. That the vacation be subject to all the terns and condtions
of Chapter 130, codified March 1, 1981, of the St. Paul Legislative
Code, as amended.

Street and a 90 foot cul-de-sac the center of which is locates}.

7. That the petitioner, his successors or assigns, by acceptance

defend and save harmless the City of Saint Paul, its officers and
employees from all suits, actions or claims of any character, includ-
ing but not limited to a claim brought because of any injuries
or damages received or sustained on account o - -this vacation, by
any persons or property; or because of any act or omission; neglect
or misconduct of said petitioner; or because of any claims or liabil-

The easterly twenty (20) feet of public Roadway Bradley Street,
boardering lots numbered 6, 7, 8, and 9, Block 2, Edmund Rices
First Addition, Two Hundred Eighty five (285) feet North of
the property line that boarders Whitall Avenue.
The reason for vacation being, to allow for the construction of improvements
on said area as part of an apartment project that will be constructed in

To Whom it may Concern:
The following are the directions and instructions regarding the
improvement of a portion of Bradley Street between Whitall Street and
York Avenue in Saint Paul . It is the desire of Bradley Stark and
Associates to improve Bradley Street from Whitall Street to the extent
of approximately 285 feet of roadway and 28 feet wide, 9' of boulevard
on each side , with a seventy foot diameter cauldesac and 10' of maintenance
easement as demonstrated on the attached drawings. Specific engineering
drawings to govern the final dimensions.
In addition to the blacktop and curb improvements to Bradley Street
it is requested that a two (2) inch copper supply line be installed and
an eight (8) inch sanitary sewer line be installed. Firehydrant as to
be determined by the Public work Department.
No storm lines will be required. No lamp posts will be required
in the public improvement right of way. No sidewalks will be required
in the public improvement right of way.
