FOR ACCESS PURPOSES
THE JASAKA COMPANY, a partnership under the laws of
Minnesota, Grantor , in consideration of the sum of One Dollar and
other good and valuable consideration, to them in hand paid and
the receipt of which is hereby acknowledged , does hereby Grant ,
Bargain , Sell , and Convey to the CITY OF SAINT PAUL, a municipal
corporation of the State of Minnesota, its successors, and
assigns , as Grantee , a permanent easement for access purposes on,
over , and across the following tract of land being in the County
of Ramsey and State of Minnesota described as follows:
All that part of the southerly 90 feet of the
easterly 15 feet of vacated Arundel Street
lying northerly of the north line of Orange
Avenue , also described as part of Lot 40 ,
Cottage Homes.
To have and to hold the same forever . The Grantor does
covenant that it is well seized in fee of the land and premises
aforesaid , and has good right to sell and convey the same free of
all encumbrances.
The Grantor also covenants that the above granted easement
is in the quiet and peaceable possession of the Grantee. The
Grantor will warrant and defend against all persons lawfully
claiming the whole or any part thereof, subject to encumbrances ,
if any hereinbefore mentioned .
It is intended and agreed that this agreement shall be a
covenant running with the land and shall be binding to the
fullest extent of law and equity for the benefit of the public .
It is further intended and agreed that this agreement and
covenant shall remain in effect without limitation as to time.

WHEREAS , the Council of the City of Saint Paul , on February 28 ,
1991 , by resolution C.F. 91-333 , approve the vacation of part of
Arundel Street described as follows:
All that part of Arundel Street lying between the north
and south right-of-way line of Orange Avenue in Cottage
Homes
WHEREAS , the Department of Public Works in its letter of August
6 , 1991 , to the Department of Finance and Management Services
states that condition no . 2 of said resolution no . 91-333 which
refers to the dedication of street right-of-way to the City from
the petitioner is no longer required .
THEREFORE BE IT RESOLVED, that condition no. 2 of said resolution
C.F. 91-333 is hereby deleted . The description of said condition
no. 2 reads as follows :
That the petitioner , its successors , and assigns shall ,
by recordable deed , grant a permanent easement for
right-of-way purposes , to the City of Saint Paul, on ,
over and across the following described property:
All that part of Lot 40 , Cottage Homes which lies within

Department File No . 26-1990 that part of Arundel Street lying
between the north and south right-of-way line of Orange Avenue ,
hereinafter described , is hereby vacated and discontinued as
public property.
The vacated land is described as follows :
All that part of Arundel Street lying between the north
and south right-of-way line of Orange Avenue in Cottage
Homes.
This vacation shall be subject to the following conditions :
1. That this vacation shall be subject to all the terms
and conditions of Chapter 130 , codified March 1,
1981 of the St. Paul Legislative Code , as amended .
2 . That the petitioner , its successors , and assigns shall ,
by recordable deed , grant a permanent easement for
right-of-way purposes , to the City of Saint Paul , on ,
over , and across the following described property:
All that part of Lot 40 , Cottage Homes which

is permitted without written permission from the
Director of Engineering Construction.
d. That the petitioner , its successors, and assigns
shall indemnify, defend , and save harmless the
City of Saint Paul, its officers , agents ,
employees , and servants from all suits , actions or
claims which shall arise from any injuries or
damages received or sustained by any break in any
service pipe or connection in said reserved
easement , arising out of or resulting from any
action or negligence of the petitioner , its
employees , agents or business invitees .
5 . That the petitioner , its successors , and assigns shall
pay $500 .00 administrative fee for this vacation which is
due and payable within 60 days of the publication date
of this resolution.
6 . That the petitioner , its successors , and assigns , by
acceptance of the terms and conditions of this vacation
agree to indemnify, defend , and save harmless the City
of Saint Paul, its officers, and employees from all
suits , actions , or claims of any character brought as a
result of injuries or damages received or sustained by
any person , persons , or property on account of this
vacation or petitioner ' s use of this property, including
but not limited to a claim brought because of any act of
omission, neglect, or misconduct of said petitioner or
because of any claims or liability arising from any
violation of any law or regulation made in accordance
with the law whether by the petitioner or any of its
agents or employees.

Proposed vacation of Arundel Street,
between the north and south right-of-way of Orange Street,
located west of Western Avenue and north of Maryland Avenue
A review of the proposed vacation of the above referenced street has been completed. The proposed
vacation is a 60 foot by 50 foot area, at the intersection of Arundel Street and Orange Avenue, which was
improved in 1965.
The vacation proposal will be affected by Public Works' 1991 Maryland/Dale CSSP Project. See the
attached memo from Tom Kuhfeld regarding agreements arrived at pertaining to this matter.
A permanent sewer and access easement must be retained over the east 15 feet of Arundel Street for the
protection and maintenance of the existing Troutbrook interceptor and access purposes.
The Petitioner must dedicate an access easement on the easterly 15 feet of vacated Arundel Street, from
the north line of Orange Avenue to 90 feet north, for the purpose of maintenance vehicle access.
The Petitioner must dedicate additional right-of-way on the west side of Arundel Street to provide a 50
foot radius cul-de-sac with a center radius of 50 feet south of the south line of Orange Avenue (vacated)
and 15 feet west of the center line of Arundel Street.
Therefore, the Department of Public Works has no objection to the proposed vacation subject to the
dedications and easements as indicated above.

SUBJECT: Proposed Vacation of Arundel Street at Orange Avenue
I met in the field with Bill Freeman one of the petitioners for this vacation regarding
their proposed construction. We arrived at an agreement which will allow us to get the
additional easements we need for our 1991 Maryland/Dale CSSP Project and will
allow them to proceed with their construction this spring. Subject to the following
conditions, the vacation should be allowed to proceed so the petitioner can construct
their proposed building at the same time as the 1991 Maryland/Dale CSSP area work
is in progress. Basically the developers agreed to move the proposed building 15'
west to provide an access area which we need. But in order to do so, they need to
move the building to the south onto the proposed vacation area to avoid encroaching
on railroad property.
1. A permanent sewer and access easement must be retained over the east 15' of
Arundel Street for the protection and maintenance of the existing Trout Brook
interceptor and access purposes.
2. The petitioner must dedicate an access easement on the easterly 15' of vacated
Arundel Street from the north line of Orange Avenue to 90' north for the purpose of
