RESOLVED, that upon the petition of Michael and Amy Dickson, per
Finance Department File No. 13-1991, that part of the alley in
Block 6, Summit Park Addition to St. Paul, bounded by Snelling,
Ashland, Saratoga, and Portland, hereinafter described, is hereby
vacated and discontinued as public property.
The vacated area is described as follows:
All of the alley in Block 6, Summit Park Addition to
St. Paul.
This vacation shall be subject to the following terms and
conditions:
1. That this vacation shall be subject to the terms and
conditions of Chapter 130, codified March 1, 1981,
of the Saint Paul Legislative Code, as amended.
2 . That the petitioners, their heirs, and assigns shall
pay $4 ,702 as compensation for this vacation
which is due and payable within 60 days of the
publication date of this resolution.
3 . That a permanent easement be retained within the
vacated area to protect the interests of U. S. West.
4 . That a permanent easement be retained with the
vacated area to protect the interests of Northern
States Power Company.
5. That the petitioners, their successors, and assigns,
by acceptance of the terms and conditions of this
resolution, hereby agree to indemnify, defend, and
save harmless the City of Saint Paul, its officers,
and employees, against all suits, actions, or claims
of any character brought as a result of injuries or
damages received or sustained by any person, persons,
or property on account of this vacation or
petitioner's use of this property including but not
limited to a claim brought because of any act of
omission, neglect, or misconduct of said petitioner
or because of any claims or liability arising from
any violation of any law or regulation made in
accordance with the law whether by the petitioner
or any of its agents or employees.

The Petitioners Michael and Amy Dickson, Margaret M. Lindorfer and Super America Group
Inc. do hereby petition the Council of the City of St. Paul to vacate the public property
described as follows:
The alley situated between 1563 Portland Avenue (legally described as Summit
Avenue Addition to the City of St. Paul Subject To the Easement over North
loft the West 50ft of lots 1,2 and 3, Block 6) and Super America, 56 Snelling
Avenue North (legally described as Summit Avenue Addition to The City of
St. Paul East 47.68ft of lot 4,5 and 6, Block 6). This alley is a graveled
surface that nobody has used for many years. It was part of a t-shaped
alley that no longer exists and now is a dead end. It has been maintained by
the owners of 1563 portland Avenue since they have lived there in 1987.
The purpose for this petition is to aquire land for the owners of 1563 Portland Avenue to have
the space to build a driveway and a garage. There is not enough land to do so with thier current
property line. .
The contacts for this vacation who will be responsible for payment of compensation and
acceptance of the conditions of the vacation are Mike and Amy Dickson. They can be reached
at 647-0853.
Michael and Amy Dickson are the owners at 1563 Portland Ave, a single family dwelling along
the East side of the alley.

Department of Public Works has no objection to the vacation
proposal.
