PETITION FOR VACATION OF A UTILITY EASEMENT
IN WESTGATE OFFICE-INDUSTRIAL CENTER
TO: THE HONORABLE COUNCIL PRESIDENT AND MEMBERS OF THE CITY
COUNCIL
The undersigned does hereby petition the City Council of
the City of Saint Paul to vacate the utility easement in
Westgate Office- Industrial Center described in the attached
Exhibit . Your Petitioner , Rivertown Trading Company ,
respectfully states and alleges that it is the fee owner of
record of the real estate abutting the easement as further
described as follows :
All that part of Lots 1 , 2 , 3, 4 and Outlot B, Block 1 ,
West Gate Addition No . 4 that lies Southerly of the following
described line : Commencing at the Northeast corner of said Lot
4 ; thence North 0°10 '01" East , along the East line of said
Outlot B , a distance of 20. 00 feet to the point of beginning of
the line to be described; thence South 89°47 '02" West a
distance of 148. 67 feet; thence North 56°45 ' 56" West a distance
of 506 .81 feet to a point on the West line of said Lot 1 that
is 5 . 90 feet North of the Southwest corner thereof and
Northerly of the following described line : Commencing at the
Northwest corner of said Lot 4; thence South 0°10 '02" West ,
along the East line of said Lot 4 a distance of 10 .00 feet to
the point of beginning of the line to be described; thence
South 89°47 '02" West a distance of 157 .48 feet; thence North

The proposed vacation is required because the easement will
be exchanged for a water utility easement on the northerly part
of the property described as follows :
That part of Lot 2 , Block 1 , West Gate Addition that lies
Easterly of the following described line :
Commencing at the Southeast corner of said Lot 2 ; thence
North 0 °06' 47" East , along the Easterly line of said Lot 2 , a
distance of 16 .47 feet; thence North 6°39 '55" West , on said
Easterly lot line , a distance of 463 . 09 feet to the point of
beginning of the line to be described; thence North 0°06 '47"
East , parallel the most Easterly line of said Lot 2 a distance
of 75 .55 feet to the Northerly line of said Lot 2 and there
terminating except the Easterly 30. 00 feet thereof .

Your Petitioner herein further requests that the provisions
of the Saint Paul Legislative Code , Chapter 130, pertaining to
the reservations of easements , rights and other claims for the
installation, maintenance and operation of any sewer, water ,
gas , telephone , or electrical main , pipe or conduit , or any
other conduit of public instrumentality for the City of Saint
Paul and for other persons or corporations having public
instrumentalities in the land to be vacated , be waived upon
presentation to and approval by the City Council of statements
to the effect that any such instrumentality will be abandoned.
WHEREFORE , your Petitioner respectfully requests your
Honorable Body to vacate the easement for the purpose above
stated .
