10 City Clerk of Saint Paul, the City for itself and on behalf of these corporations and departments,
11 waives the right to utility easements in the vacated areas as described in the certificates incorporated
12 herein.

14 NOW THEREFORE, BE IT RESOLVED, pursuant to Section 130.06 of the Saint Paul Legilative
15 Code and on behalf of the City of Saint Paul and those persons for whom the City has reserved
16 easements, the Council of the City of Saint Paul does hereby waive and release the retained Utility
17 Easements in the vacated public property as described above.

19 BE IT FURTHER RESOLVED, that upon passage of this resolution, the City Clerk is hereby
20 authorized and directed to record a copy of this resolution in the office of the Registrar of Deeds,
21 Ramsey County, and that the City Clerk shall maintain a copy of all Certificates of Intended Non-Use
22 referenced in this resolution on file in the office of Citizen Services.

Dear Mayor Byrne and Gentlemen:
Please be advised that Mrs. Maria Carbone opposes the vacation of
the alley in Block 26, Kittson's Addition to Saint Paul, by reason of the
fact that Lot 6, Block 26, Kittson's Addition to Saint Paul, in which Mrs.
Carbone has an interest, would become landlocked, if this vacation were
completed.
While Lot 6, Block 26, Kittson's Addition to Saint Paul, is in
the names of Salvatore Carbone and Maria Carbone, husband and wife as joint
tenants, Salvatore Carbone died on April 17, 1967. The State of Minnesota
in condemnation proceedings is taking this entire parcel of ground, but
under provisions of Chapter 161 of Minnesota Statutes, in Sections 161.23
and 161.44, the owner is entitled, under certain conditions, to re-conveyance
of those portions of the land condemned that is not needed for the highway.
Although this property abuts Seventh Street, it is in mid-block and the
State will not permit any vehicular access by either driveway or curb side
parking to the subject premises that may be re-conveyed to Mrs. Carbone.
For this reason the only access to the property is through the alley
extending in an easterly-westerly direction along its rear lot line.
Negotiations are being carried on with the Twin Tool Company,
who is the petitioner for the vacation of this alley, as to the acquisition
of the Carbone interests, but if these negotiations are not completed, then
the continuation of this alley is absolutely essential to the continued
use and enjoyment of that portion of Lot 6 that is not being taken and
used for highway purposes.
For the foregoing reasons it is respectfully requested that Your
Honorable Body either deny the application for vacation, or continue the
matter until such time as the negotiations between Mrs. Carbone and the
Twin Tool Company are resolved one way or the other.

alley in Block 26, Kittson's Addition to St. Paul.

The portion of the alley petitioned to be vacated is a strip 20 feet
wide by 200 feet long in the block bounded by Seventh, Eighth, Olive
and John Streets. The southerly half of this block has been acquired
by the State of Minnesota for highway purposes, and if vacated, the
portion of the alley adjacent will accrue to the State of Minnesota.
The City of St. Paul is the owner of 75 feet of frontage on the pro-
posed vacation, and a strip 10 feet wide by 75 feet will accrue to
the City's ownership. The remaining strip, 10 feet wide by 125 feet,
will accrue to the Twin Tool, Inc. The petitioners in this case are
the City of St. Paul and Twin Tool, Inc. The compensation to be paid
does not apply to that portion of the alley to accrue to the City of
St. Paul.
There are no objections to the vacation from any of the public offices
involved, but both the Northern States Power Company and the North-
western Bell Telephone Company report installations in the area which
require protection.
The Public Works Department requests that an easement be retained for
ingress and egress until such time as the Department of Public Works
discontinues the use of the storage equipment building now located at
Eighth and Olive Streets.
I, therefore, recommend that the petition be granted, subject to the
following terms and conditions:
1. That the description of the alley to be vacated be as
follows: All of the alley as platted and lying within
Block 26, Kittson's Addition to St. Paul.
2. That the vacation be subject to all of the terms and
conditions of Section 228 of the Legislative Code, as
amended, regulating the procedure and prescribing con-
ditions for the vacation of public grounds, streets,
alleys, and highways in the City of St. Paul.
3. That a specific easement be retained for the protection
of the existing public utilities of the Northern States

Power Company and the Northwestern Bell Telephone Com-
pany.
4. That an easement for ingress and egress be retained
until such time as the Public Works Department dis-
continues the use of the storage and equipment build-
ing now located at Eighth and Olive Streets, said
easement to include and be over all of the alley in-
cluded in this vacation petition.
5. That Twin Tool, Inc. pay to the City the sum of $3,250
as compensation for the vacation and provide the City
with a bond in the amount of $1,000.

Dear Mr. Beaubien:
Recently you made inquiry about the possibili 'y of vacating the east-west
alley lying north of Seventh Street and between Oli a and John Streets.
The possible vacation of this alley has, several times in the past year or
so, come up for consideration. The Department of Public Works has opposed it.
Opposition to the vacation by this department has been based on an expec-
tation that when the freeway ramp west from Olive Street is opened interference
with our trucking operation will occur on Olive Street. Therefore, it has been
the intention of the operating people at this location to place a door in the
south side of the building and use the alley way for loading. The concern has
been more for the future than for a current use.
From our conversation with you in this office the other day, it is our
understanding that you would be agreeable to the alley vacation with a reserva-
tion by the city for a use easement so long as our maintenance service function
remained at our present location on the southeast corner of Eighth and Olive.
As you know, it is our intention to try to work out some alternate location as
soon as possible so that we might have a better facility for the performance of
the activities involved.
If the alley vacation could be arranged in the manner indicated above, we
would withdraw our objection. After you have had a chance to restudy the matter
we would be pleased to discuss it further with you at any time.

The above proposed vacation area has been checked by this company.
Our Overhead Electric Engineering Department reports that we have one
pole with attached overhead electric wires located in the proposed
vacation area. There are also two Telephone Company poles to which
we attach our wires located in this proposed vacation area. Attached
is a sketch outlining in red the proposed vacation area with the three
poles and attached wires marked thereon.
There are no gas facilities within the proposed vacation area.

Dear Mr. Donovan:
The hearing on the proposed vacation of the alley in Block 26,
Kittsons Addition to St. Paul, which is bounded by 7th. St, 8th. St.,
Olive St., and John St., is scheduled on April 26, 1967.
The Department of Public Works objected to this vacation on
previous hearings, however, upon further review of this matter with
our sewer, grading, paving, traffic and maintenance engineers, it
was concurred by all that the vacation be granted subject to an
easement for ingress and egress until such a time when the Department
of Public Works discontinues the use of the storage and equipment
building now located at 8th. and Olive Streets.
Attached hereto are two copies of a drawing, showing the alley
shaded in red.

Pursuant to Section 129 of the City Charter, we the undersigned,
constituting a majority of the record owners of the real estate abutting the
alley sought to be vacated, petition your Honorable Body to vacate the following
described property:
All of the alley as platted in Block 26,
Kittsonts Addition to Saint Paul
Petitioners request this vacation because they desire to incorporate the
vacated land with other assembled property for the purpose of parking.
Petitioners further state that said alley is no longer a through alley and
would not be of any further benefit to the City of Saint Paul as a dedicated alley.
Attached hereto and forming a part hereof is the Certificate from St. Paul
Abstract and Title Guarantee Company setting forth the owners of the property
abutting said alley, and a plat of this property to be vacated.
W HE RE FORE , Petitioners pray the City Council of the City of Saint
Paul take all appropriate actions to cause said alley to be vacated within the
boundaries described herein.
