1 BE IT RESOLVED, that, upon the petition of the Neighborhood Development Alliance , as
2 documented in Finance Department File Number 9-1996, public properties hereinafter described
3 are hereby vacated and discontinued as public property: and, subject to the herein stated
4 exceptions, the easements within those public properties are hereby released.
5 The property to be vacated is described as follows:

7 Parcel 1. The east 20.00 feet of the west 36.00 feet of vacated Mt. Hope Street lying
8 northerly of a line running from the southeast corner of Block 3, Woodbury &
9 Case's Addition to Saint Paul, to the southwest corner of Block 2, Woodbury &
10 Case's Addition to Saint Paul, and southerly of the south line of Lot 18, Auditor's
11 Subdivision No. 30.

13 Parcel 2. The North Twenty (20) feet measured parallel to the extended North line of Lot A,
14 Block Three (3), Woodbury and Case's Addition, of the West sixteen (16) feet of
15 that portion of vacated Mt. Hope Street lying between Block Two (2) and Block
16 Three (3), Woodbury and Case's Addition.

18 This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of
19 the Saint Paul Legislative Code as amended, and to the following conditions:

21 1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative
22 fee for this vacation which is due and payable within 60 days of the effective date of this
23 resolution.

25 2. That a permanent utility easement shall be retained, on behalf of the City of Saint Paul,
26 Department of Public Works, to reserve the right of the City to maintain and operate any
27 sewer in or upon said easement and to enter upon said easement or any portion thereof at
28 any time and from time to time, for the purposes of future construction, reconstruction,
29 inspecting, maintaining or repairing the same or any part thereof and shall be subject to
30 the following conditions:

32 a. No buildings, structures, trees or any temporary structure, material storage, fixture,
33 or any other objects that will prohibit normal access to utility facilities for
34 maintenance purposes will be permitted within the easement area.

1 b. Improvements in or upon the above described easement that do not prohibit the
2 City from exercising its reserved rights may be allowed by obtaining written
3 permission from the Department of Public Works Sewer Division with the
4 understanding that the restoration and costs of such improvements shall be the sole
5 responsibility of the petitioner, its successors and assigns in the event the City
6 exercises its reserved easement rights.

8 c. No change from the existing grade within the easement area will be permitted
9 without written permission from the Department of Public Works.

11 d. No change in surfacing within the easement area will be permitted without written
12 permission from the Department of Public Works.

14 e. The petitioner, its successors and assigns shall indemnify, defend, and save
15 harmless the City of Saint Paul, its officers, agents, employees, and servants from
16 all suits, actions, or claims which shall arise from any injuries or damages received
17 or sustained by any break in any service pipe or connection in said reserved
18 easement arising out of or resulting from any action or negligence of the petitioner,
19 its employees, agents, or business invitees.

21 3. That a permanent utility easement shall be retained within the vacated area to protect the
22 interest of Northern States Power Company.

24 4. That a permanent utility easement shall be retained within the vacated area to protect the
25 interest of U.S. West Communication, Inc.

27 5. That a permanent utility easement shall be retained within the vacated area to protect the
28 interest of Continental Cablevision, Saint Paul, Inc.

30 6. That a temporary vehicular access easement shall be retained across the southerly 133.74
31 feet of Parcel 1 to protect access to the east-west alley, such temporary access to be
32 released upon the earlier of: (a) Vacation of the east-west alley; or (b) Replatting of the
33 area with provision for alternate access to the east-west alley.

35 7. That with the exceptions noted above and with the accompanying Utility Easement
36 Certificates of Intended Non-Use, filed voluntarily on behalf of U.S. West
37 Communications, Incorporated, Northern States Power Company, District Energy St.
38 Paul, Incorporated, MCI Metro, Incorporated, Continental Cablevision, The Water
39 Utility, and The Department of Public Works, made a part hereof by this reference and
40 filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of
41 these corporations and departments, does hereby waive the right to the utility easements
42 in the vacated area described above.

We requested prints as per attached letters and resolutions. As of today's date we have not
received them.
Council File 97-401 requested June 30, 1997
You had agreed to provide us with prints within a three week time-frame or to let me know
when I could expect these prints. This time-frame has not been met and I am now requesting
a one week turn-around time so as not to delay the filing of this vacation any longer. I will
expect the prints to be here by September 26, 1997.
If this time-frame cannot be met please notify me immediately and let me know when I
can expect to receive these prints so I may notify the citizen of the reason for the delay.

We,the undersigned, constituting a majority of the owners or their legally designated
representatives of the abutting properties, do hereby petition the Council of the City of Saint Paul
to vacate its interest in the properties legally described as follows:
1. A travel easement located in the West 1/2 of v?sated Mt. I-Ic:pc Street adjacent to Lot 1
and Lot A, Block 3, Woodbury and Case's Addition; and,
2. An alley located in the north 20 feet of the south 133.74 feet of Lots 1, 2, 3 and 4, Block
3, Woodbury and Case's Addition; and,
3. An alley located in the north 20 feet of Lot 5, C.F. Meyer's Rearrangement of Lot 6,
Woodbury and Case's Addition.
3. Requesting Certificates of Intended Non-Use from any utilities having easements within
the foregoing.
The Petitioners request this vacation for the following reasons:
a. The vacation of the easements will permit the replatting of a portion of the adjacent
property for redevelopment(six copies of the preliminary plat are attached);
b. The vacation will add to the south portion of Lot 1, Block 3, sufficient land to permit
construction of a garage;
c. The vacation will eliminate a hazardous traffic condition associated with vehicles
entering and backing out of a dead-end alley;

We, the undersigned, constituting a majority of the owners or their legally designated
representatives of the abutting properties, do hereby petition the Council of the City of Saint Paul
to vacate its interest in the properties legally described as follows:
1. A travel easement located in the West 1/2 of vacated Mt. Hope Street adjacent to Lot 1
and Lot A, Block 3, Woodbury and Case's Addition; and,
2. An alley located in the north 20 feet of the south 133.74 feet of Lots 1, 2, 3 and 4, Block
3, Woodbury and Case's Addition; and,
3. An alley located in the north 20 feet of Lot 5, C.F. Meyer's Rearrangement of Lot 6,
Woodbury and Case's Addition.
3. Requesting Certificates of Intended Non-Use from any utilities having easements within
the foregoing.
The Petitioners request this vacation for the following reasons:
a. The vacation of the easements will permit the replatting of a portion of the adjacent
property for redevelopment(six copies of the preliminary plat are attached);
b. The vacation will add to the south portion of Lot 1, Block 3, sufficient land to permit
construction of a garage;
c. The vacation will eliminate a hazardous traffic condition associated with vehicles
entering and backing out of a dead-end alley;
