1 BE IT RESOLVED, that, upon the petition of Victor Rosenblum, as documented in Finance
2 Department File Number 16-1998, public properties hereinafter described are hereby vacated and
3 discontinued as public property: and, subject to the herein stated exceptions, the easements within those
4 public properties are hereby released.

6 The property to be vacated is described as follows:

8 Parcel "A"
9 All that part of platted Iglehart Avenue (Formerly Iglehart Street) lying west of the southerly
10 extension of the east line of Lot 22, Block 5, College Park, and easterly of the Soo Line Railroad
11 right-of-way, all in the Southeast Quarter of Section 33, Township 29 North, Range 23 West,
12 Ramsey County, Minnesota.

16 Parcel `B"
17 Except the easterly 45.0 feet, that part of Lot 1, Block 9, College Park, north of said Soo Line
18 Railroad right-of-way.

20 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
21 Saint Paul Legislative Code as amended, and to the following conditions:
22
23 1. That the petitioners, their successors and assigns, shall pay $500.00 as an administrative fee for
24 the vacation of Parcel "A" which is due and payable within 60 days of the effective date of this
25 resolution.

27 2. That a permanent snow storage easement shall be retained on, over and across the easterly 10.00
28 feet of the vacated area of Iglehart Avenue on behalf of the City of Saint Paul, Department of
29 Public Works.

31 3. That the petitioner shall be responsible for, and pay all costs and expenses for, any street
32 reconstruction at the east end of the vacated area which will be necessary to properly eliminate
33 the appearance of a public thoroughfare, including but not limited to, costs for new curbs,

1 sidewalks, boulevards, storm drains, additional signage, and removal of existing street lights and
2 street signs, all to the satisfaction of the Department of Public Works.

4 4. That the petitioner must assume ownership of the existing water pipe located within the proposed
5 vacated street area by means of an agreement with the Board of Water Commissioners. The
6 Board of Water Commissioners requires that the Petitioner enter into an Agreement with the
7 Board so that ownership of the water pipe within the vacated street area can be transferred to the
8 petitioner, its successors and assigns according to the following conditions:

10 a. The petitioner shall pay the Water Utility the actual cost to install a 2-inch service valve
11 approximately 7 feet east of the eastern line of the vacated area and abandon the existing
12 service valve located within the vacated easement area.

14 b. The petitioner, its successors and assigns, shall assume ownership of the water service
15 within the petitioned vacated street area in its present condition, and additionally assume
16 ownership and responsibility for the repair and maintenance of the resulting water
17 service. Owner shall maintain the water service in accordance with Water Utility
18 standards.

20 c. The petitioner, its successors and assigns, agree to indemnify, defend and hold harmless
21 the Board of Water Commissioners, its officers and employees from all suits, actions or
22 claims of any character brought on account of this vacation or petitioner's use of this
23 property, including but not limited to a claim brought because of any act of omission,
24 neglect, or misconduct of said petitioner or because of any claims or liability arising from
25 any violation of any law or regulation made in accordance with the law, whether by the
26 petitioner or any of their agents or employees.

28 5. That permanent utility easements shall be retained within the vacated area to protect the interest
29 of Northern States Power Company. Said easements are described as follows:

31 a. Easement to construct, operate, maintain, use, rebuild, or remove electric transmission
32 lines with towers, structures, poles, crossarms, cables, wires, guys, supports,
33 counterpoises, fixtures, and devices over and across a 40 foot wide strip of land lying
34 parallel with and abutting to the Soo Line Railroad right-of-way.

36 b. Easement to excavate for, construct, install, mark, inspect, operate, repair, alter, replace,
37 reconstruct, remove and maintain gas facilities over the East 35 feet of the North 33 feet
38 of the area of Iglehart Street to be vacated.

40 6. That a permanent easement for access purposes be retained over the entire area of vacated
41 Iglehart Street in favor of the Saint Paul Department of Fire and Safety.

43 7. That the petitioner, its heirs and assigns, shall pay the City $25,7765.00 as compensation for the
44 vacation of Parcel `B" which is due and payable within 60 days of the effective date of this
45 resolution.

16 9. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
17 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
18 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in
19 all respects with these terms and conditions.

21 ALSO BE IT RESOLVED, that the Council of the City of Saint Paul hereby authorizes the proper City
22 officials to grant a Quit Claim Deed which conveys the vacated Parcel `B" to the petitioner subject to the
23 conditions of this vacation.

petition the Council of the City of Saint Paul to vacate Its interests In the property(ies)legally described as follows: That portion

by that Southerly projection of the East line of Lot 22 in Block 5,
College Park Addition to Ramsey County Minnesota to its
intersection with the right of way with the Soo Line Railroad, and
there terminating.
The following are the owners according to the land records contained in the
office of the Ramsey County Recorder of all property abutting the above
described property.
Parcel 1 : Lots 16, 17, 18, 19, 20, 21 & 22, Block 5, and the easterly 45 feet of Lot
1, which lies northerly of the right of way with the Soo Line Railroad,
Block 9, all in College Park.
Victor Rosenblum is the owner of parcel 1, as shown by Warranty Deed
dated November 21, 1966, filed for record November 25, 1966 as
Document No. 1689109 and by Warranty Deed dated September 16,
1988, filed for record September 21 , 1988 as Document No. 2460261 .
(See Attached Exhibit "A")
Parcel 2: That part of Lot 1 , Block 9, College Park, which lies northerly
of the right of way with the Soo Line Railroad and westerly of a line
run parallel with and distant 215 feet westerly of the east line of
Section 33, Township 29, Range 23 West.
State of Minnesota is the owner of parcel 2, as shown by Final
Certificate dated February 23, 1993, filed for record February 25,
1993 as Document No. 2705053.

Parcel 3: That portion of the railroad right-of-way in the southeast quarter of
Section 33, Township 29, Range 23, lying west of Iglehart Avenue and
running in a northwesterly direction from the most northwest corner of
land described at parcel 2 to a point 10.1 feet east of the southwest
corner on the south line of Lot 16, Block 5, College Park.
Soo Line Railroad Company fka The Chicago, Milwaukee and Saint Paul
Railway Company is the owner of parcel 3, as shown by Warranty Deed
dated April 28, 1879, filed August 8, 1879, in Book 80 of Deeds, page
241. (See Attached Exhibit "C")
