1 WHEREAS, on August 21, 1998, the Council approved CF#98-671 vacating the City's right-of-way
2 interest in that part of Forbes Avenue lying easterly of the east right-of-way line of Smith Avenue and
3 northwesterly of the northwest right-of-way line of West Seventh Street; and

5 WHEREAS, the said vacation was contingent upon the petitioners' meeting certain specified conditions;
6 and

10 THEREFORE BE IT RESOLVED, that the vacation of the City's interest in the above described part

Enclosed is a copy of Council File 98-671 which was adopted by the City Council on
August 5, 1998. The resolution provides for the vacation of that portion of Forbes
Avenue as more fully described in the attached resolution.
Your company had asked for an extension of time before having to comply with the
terms of the resolution. I believe that date was April 1, 1999. From recent newspaper
articles it appears you may be ready to go ahead with your project. This letter is a
reminder that I have not yet received the signed acceptance of the terms (another is
enclosed) of the resolution or the $500 administrative fee.

1 BE IT RESOLVED, that, upon the petition of the Salvation Army, as documented in Finance
2 Department File Number 6-1998, public properties hereinafter described are hereby vacated and
3 discontinued as public property.
4 The property to be vacated is described as follows:
5 that part of Forbes Avenue lying easterly of the east right-of-way line of Smith Avenue and
6 northwesterly of the northwest right-of-way line of West Seventh Street
7 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
8 Saint Paul Legislative Code as amended, and to the following conditions:
9 1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
10 this vacation which is due and payable within 60 days of the effective date of this resolution.
11 2. That a permanent utility easement shall be retained on, over, under and across the vacated area on
12 behalf of the City of Saint Paul, Department of Public Works to reserve the right of the City to
13 maintain and operate any sewer in or upon said easement and to enter upon said easement or any
14 portion thereof at any time and from time to time, for the purposes of future construction,
15 reconstruction, inspecting, maintaining or repairing the same or any part thereof and shall be
16 subject to the following conditions:
17 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
18 other objects that will prohibit normal access to utility facilities for maintenance purposes
19 will be permitted within the easement area.
20 b. Improvements in or upon the above described easement that do not prohibit the City from
21 exercising its reserved rights may be allowed by obtaining written permission from the
22 Department of Public Works Sewer Division with the understanding that the restoration
23 and costs of such improvements shall be the sole responsibility of the petitioner, its
24 successors and assigns in the event the City exercises its reserved easement rights.
25 c. No change from the existing grade within the easement area will be permitted without
26 written permission from the Department of Public Works.
27 d. No change in surfacing within the easement area will be permitted without written
28 permission from the Department of Public Works.

2 City of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or
3 claims which shall arise from any injuries or damages received or sustained by any break

5 from any action or negligence of the petitioner, its employees, agents, or business
6 invitees.

22 4. That a permanent utility easement shall be retained within the vacated area to protect the interest
23 of Northern States Power Company.
24 5. That a permanent utility easement shall be retained within the vacated area to protect the interest
25 of U.S. West Communication, Inc.
26 6. That a permanent utility easement shall be retained within the vacated area to protect the interest
27 of Continental CableVision, Saint Paul, Inc.
28 7. That plans for the use of the vacated area shall be subject to site review by the Office of License,
29 Inspection and Environmental Protection.
30 8. That the petitioner shall pay all costs and expenses of reconstructing the Forbes/Smith and
31 Forbes/W. Seventh intersections, including but not limited to, new curbs, sidewalks, boulevards,
32 storm drains and street sign removal, which may be necessary to properly eliminate the
33 appearance of a public thoroughfare. Such reconstruction shall be consistent with requirements
34 of the Department of Public Works.
35 9. That, concurrently with the reconstruction of curbing and at its own cost and expense, the
36 petitioner shall install new lighting conduit on the east side of Smith Avenue. Such installation
37 shall be consistent with requirements of the Department of Public Works.
38 10. That the petitioner shall bear all costs and expenses associated with the abandonment of the two
39 poles feeding City street lights in the vacated area.

1 11. The petitioner shall be responsible for the costs and expenses of rerouting the existing catch
2 basin on West Seventh Street just south of the vacated area, as well as any street grade changes
3 that may be necessary to properly drain the intersections of Forbes at West Seventh. Such
4 reconstruction shall be consistent with requirements of the Department of Public Works Sewers
5 Division.
6 12. That the petitioner agrees to landscape and maintain the street to be vacated and its property lying
7 southerly thereof, easterly of Smith Avenue and northwesterly of West Seventh Street to conform
8 to the site plan approved by the Office of License, Inspection and Environmental Protection.
9 13. That the two existing catch basins within the vacated area of Forbes shall become the
10 responsibility of the petitioner.
11 14. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
12 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
13 brought as a result of injuries or damages received or sustained by any person, persons or
14 property on account of this vacation or petitioners' use of this property, including but not limited
15 to a claim brought because of any act of omission, neglect or misconduct of said petitioner or
16 because of any claims or liability arising from any violation of any law or regulation made in
17 accordance with the law, whether by the petitioner or any of their agents or employees
18 15. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
19 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution,
20 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in
21 all respects with these terms and conditions.
16. That the petitioner convey to the owner of the property located at 203 Forbes
Avenue a permanent access easement, running with the land, over and across the
northerly 20.00 feet of the southerly one half of the area to be vacated.

that part of Forbes Avenue lying easterly of the east right-of-way line of Smith Avenue and
